HomeMy WebLinkAbout06/08/1978 Special Mtg Board of Public Works MinutesIME SPECIAL MEETING JUNE 8, 1978 A special meeting of the Board of Public Works was convened at 2:10 p.m. on Thursday.. June 8, 1978 by Chairman Pro -Tem Peter H. Mullen, in the absence of President Patrick M. McMahon, with Mr. Mullen and Mr.-Brunner present. Mr. Mullen explained that the purpose of the meeting was to consider a "Promise to Insure" with regard to the Wall Hangings at Century Center. The St. Joseph County Hotel /Motel Tax Board has entered into a lease agreement with the First Bank and Trust Company and the bank has requested this indemnification. Upon motion made by Mr. Mullen, seconded by Mr. Brunner and carried, the following agreement was.approved: PROMISE TO INSURE Because the Wall Hangings which are the subject of a lease between the First Bank and Trust Company of South Bend, lessor, and the St. Joseph County Board of Managers for Hotel /Motel Tax, lessee, are to be hung in Century Center and because the City of South will benefit thereby, the City of South Bend hereby promises and agrees that should such Wall Hangings be damaged or destroyed by any cause whatsoever, after their delivery to Century Center and before the termination of the above - mentioned lease, then the City of South Bend shall, at its option, either pay all necessary monies to have the Wall Hangings restored to their original condition, natural wear and tear excluded, or shall pay to the First Bank and Trust Company all monies remaining due under the lease. The City of South Bend further agrees to indemnify and save harmless the First Bank and Trsut Company from any and all liability arising out of the use or maintenance of said Wall Hangings.
