OCTOBER 27.2010 88
The Board of Public Safety met in the Public Agenda Session at 8:08 a.m. on Wednesday,
October 27, 2010 with Board President Juanita Dempsey and Board Members Patrick D.
Cottrell, Bruce J. BonDurant, and Eddie Miller present. Board Member Laura Vasquez was
absent. Also present were Board Attorney Thomas Bodnar, Uniform Division Chief Jeff Walters,
Division Chief Steve Richmond, and Fire Chief Howard Buchanon.
The meeting was held in the Board of Public Works Meeting Room, 13th Floor, County City
Building, South Bend, Indiana.
Board members discussed the following items:
- Addition to the Agenda — Charges 2010 -06
Attorney Thomas Bodnar noted the addition to the Agenda of Charges 2010 -06. He
requested the Board start with that item, even though it was item number five of the
Police Department section of the agenda. He introduced Mr. Vincent Campini, Attorney
for Anthony Scott, and asked for Mr. Campini to be able to address the Board. Mr.
Campini stated he would like to ask the Board's permission for the majority of the
evidentiary hearing of Charges 2010 -06 to be presented in an Executive Session, rather
than a public Hearing. He noted he would forward a written request if the Board was in
agreement, today. Mr. Campini stated his reason for the request is due to the content of
the evidence being presented. He noted most of it is record of Mr. Scott's mental,
medical, personal, and family conditions. With regard to privacy laws in place,
information regarding his medical condition is not for public domain. Attorney Bodnar
stated the Board has a policy of keeping things as public as possible. He could recall one
time when a case needed to be done in an Executive Session, due to medical information
being revealed and the regulation of the Open Door Law. He noted there will be doctors
testifying regarding medication and medical conditions and with HIPAA laws in place,
there will be some privacy problems. Mr. Bodnar stated he would recommend, therefore,
that the Board agree to an Executive Session for the Evidentiary Hearing. The Board
agreed to set the Executive Session for 8:40 a.m.
- Promotion to Corporal
Mr. Bodnar informed the Board that the rank of Corporal will be done away with at the
beginning of 2011. He stated he would draw up paperwork for Patrolman John Gast to
,sign acknowledging that he will be re- classified as a Patrolman I" Class again after the
first of the year.
- Special Assignment to Rank of Lieutenant
Division Chief Steve Richmond informed the Board that Sergeant Eric Crittendon is also
currently a School Resource Officer at Washington High School. In his new assignment,
Sergeant Crittendon will supervise other SRO's and develop programs in schools to
address violence, including training teachers in Crisis Event. He will be managing
summer programs for students and school resource officers also. Chief Richmond noted
Sergeant Crittendon is very well prepared and organized and believes he can handle the
new assignment and still retain his position at the high school.
- Employee of the Month
Division Chief Jeff Walters informed the Board that Corporal Tyler Jackey was selected
for the employee of the month for August, 2010 because of his diligence and dedication
in pursuing a suspect in the armed robbery of a McClure Station on U.S. 31 South.
Corporal Jackey pulled over the vehicle with the suspect driving, approximately forty -
five {45) minutes after the armed robbery. When confronted, the suspect admitted to the
armed robbery. Chief Walters noted that due to Corporal Jackey's diligence in pursuing
the suspect, not only was this case solved, but future similar cases were potentially
avoided.
ADJOURNMENT
There being no further business to come before the Board, President Dempsey declared the
meeting adjourned at 8:23 a.m.

EXECUTIVE SESSION OCTOBER 27 2010
The Board of Public Safety met in the Executive Session on October 27, 2010, at 8:30 a.m. The
meeting was held in the Mayor's Conference Room, 14th Floor County City Building, South
Bend, Indiana, for the purposes specified in I.C. 5- 14- 1.5 -6.1 (b) (2) (A) and (b) (6) (A) and I.C.
5- 14- 1.5- 6.1(b)(7). Board President Juanita Dempsey, Board Members Bruce J. BonDurant,
Patrick Cottrell, and Eddie Miller were present. Board Member Laura Vasquez was absent. Also
present were Board Attorney Thomas Bodnar, Uniform Division Chief Jeff Walters, Division
Chief Steve Richmond, and Fire Chief Howard Buchanon. Board members did not discuss any
subject matter other than the subject matter as specified in the Public Notice. The meeting
adjourned at 9:00 a.m.

The Board of Public Safety met in the regular meeting at 9:15 a.m. on Wednesday, October 27,
2010, with Board President Juanita Dempsey, and Board Members Bruce J. BonDurant, Patrick
D. Cottrell, and Eddie Miller present. Board Member Laura Vasquez was absent. Also present

ACCEPT MINUTES OF PREVIOUS MEETING
President Dempsey stated that unless there were any objections, the Minutes of the October 6,
2010 meeting would be accepted as presented.
POLICE DEPARTMENT
APPROVE PROMOTION TO CORPORAL — JOHN GAST
In a letter to the Board, Chief Boykins recommended that Patrolman John Gast be promoted to
the rank of Corporal effective October 18, 2010, Chief Boykins noted that Patrolman Gast has
successfully completed three (3) years of service with the South Bend Police Department. Upon
a motion made by Mr. Cottrell, seconded by Mr. Miller and carried, the recommended promotion
was approved effective October 18, 2010,
APPROVE ASSIGNMENT TO LIEUTENANT IN SPECIAL ASSIGNMENT — ERIC
CRITTENDON
In a letter to the Board, Chief Boykins recommended that Sergeant Eric Crittendon be assigned
to the rank of Lieutenant in Special Assignment in the Investigative Division, in charge of the
SRO's, effective October 27, 2010. The Board congratulated Sergeant Crittendon on a job well
done. Sergeant Crittendon thanked the Board and Chief Richmond, Chief Walters, and Chief
Boykins. He stated he accepted all of the tasks put before him and hoped he would do a good
job. Sergeant Crittendon also gave thanks to his wife and parents. Upon a motion made by Mr.
Cottrell, seconded by Mr. Miller and carried, the recommended assignment was approved.
ACCEPT AND FILE RECOMMENDATION FOR EMPLOYEE OF THE MONTH — AUGUST
2010
In a letter to the Board, Chief Boykins stated that Corporal Tyler Jackey was selected as
Employee of the Month for August 2010. The award is to recognize officers, civilian employees,
on the South Bend Police Department who have demonstrated actions noted by supervisors or
citizens from both a professional law enforcement position and in support of the community
policing efforts with citizens of South Bend. Chief Walters stated due to his diligence and
dedication, Corporal Jackey was able to make an arrest in an armed robbery, preventing further
crimes by this suspect and solving this case. There being no further discussion, President
Dempsey stated the recommendation would be accepted for filing.
FILING OF MONTHLY STATISTICAL ANALYSIS REPORT — SEPTEMBER 2010
President Dempsey indicated that unless there were questions or objections by members of the
Board, the statistical analysis report for the month of September 2010, as submitted by the Police
Department, would be accepted for filing. There being no objections, the following report was
accepted for filing:

APPROVE REQUEST FOR EXECUTIVE SESSION — CHARGES 2010 -06
Attorney Thomas Bodnar stated he was in receipt of a faxed request from Mr. Vincent Campini
for an Executive Session for Charges No. 2010 -06. The request was for the evidentiary portion

of the Hearing to take place in an Executive Session, closed to the public. Mr. Campini noted in
his request that Officer Scott's medical and mental history is the primary aspect of the defense,
and sensitive information regarding such will be presented. Mr. Campini added that said
information is generally protected under various privacy laws and no purpose would be served
by allowing said information such as doctor's reports and records, and medical and mental
testimony being placed openly in the public domain. Attorney Bodnar stated that pursuant to
HIPAA laws and Indiana Code, medical conditions are considered private information, not for
public access. Therefore, upon a motion by Mr. Cottrell, seconded by Mr. BonDurant and
carried, the Executive Session for Charges 2010 -06 was approved for 8:40 a.m., on Friday,
October 29, 2010, in the Common Council Chambers, following the previously scheduled
Hearing at 8:30 a.m.
FIRE DEPARTMENT
APPROVE TRAVEL AND TRAINING EXPENSE REPORT — JUNE — SEPTEMBER 2010
Chief Howard Buchanon, Fire Department, submitted the Travel and Expense Report for the
months of June through September, 2010, for review. There being no further questions, the
report was accepted for filing.
FILING OF MONTHLY STATISTICAL ANALYSIS REPORT — SEPTEMBER 2010
Chief Howard Buchanon submitted to the Board the monthly report for the month of September,
2010, compiled by the Prevention/Inspection Bureau of the fire Department. President Dempsey
stated if there were no objections, the Board would accept the report for filing as presented.
