A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION
AUTHORIZING THE DIRECTOR OF REDEVELOPMENT TO APPROVE AND
EXECUTE CONTRACTS ON BEHALF OF THE CITY OF SOUTH BEND, INDIANA,
DEPARTMENT OF REDEVELOPMENT
RELATED TO THE OPERATION AND MAINTENANCE OF
BLACKTHORN GOLF COURSE
(2011)
WHEREAS, the South Bend Redevelopment Commission (the "Commission ") is the
governing body of the City of South Bend Department of Redevelopment (the "Department ")
established under the Redevelopment of Cities and Towns Act of 1953, as amended, being
Indiana Code § 36- 7 -14 -1 et seq. (the "Act "); and
WHEREAS, the Commission owns the Blackthorn Gold Course ( "Blackthorn ") and has
entered into a Management Agreement (the "Agreement ") with Kitson & Partners (Club
Services), LLC (the "Manager "),; and
WHEREAS, the Commission has reserved in the Agreement the right of approval in all
contracts for the maintenance and operation of Blackthorn being proposed by the Manager; and
WHEREAS, the Commission desires to expressly authorize the Director of
Redevelopment for the Commission to approve and execute such contracts as necessary to
provide for the proper maintenance and operation of Blackthorn;
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND
REDEVELOPMENT COMMISSION AS FOLLOWS:
1. The Director of Redevelopment of the Commission, Donald E. Inks, or his
successor (the "Director ") is hereby authorized to approve and execute, on behalf of the
Commission, such contracts as necessary to provide for the proper maintenance and operation of
Blackthorn.
2. All such contracts approved and executed by the Director must be reported to the
Commission at its next meeting after execution of such contract and such contracts shall be
subject to ratification by the Commission.
3. The authority granted under this Resolution expires on December 31, 2011.
4. This Resolution shall be in full force and effect after its adoption.
ADOPTED at a meeting of the South Bend Redevelopment Commission held on
November 19, 2011, at 1308 County -City Building, 227 West Jefferson Boulevard, South Bend,
Indiana 46601.
