Indiana Ave. Date: November 19, 2010 This is the staff report for additional expenses related to the relocation of the private club located at 807 W. Indiana Avenue. On August 06, 2010, the Commission approved Resolution No. 2741 and an Administrative Settlement to acquire this property. As it was understood at the time, this settlement was adequate for the relocation of the club, which is being acquired and relocated for the southern expansion of Ignition Park. While going through the process of getting a special exception needed to relocate, the club was required by the City to install an 800 square foot hard surface off street parking area, in addition to planting arborvitae as a buffer along the alley. On October 01, the Commission approved a $3,500 payment to cover these expenses. It has now come to light that because the club's move into this building triggers a "change in use ", it must be brought up to City standards. What is needed to allow the club to move forward with their relocation, according to the Building Department, is to have an architect do a floor plan, to scale, that can be submitted down state for approval. This floor plan needs to show the current building layout with any City required changes. Upon approval by the state, building permits can be issued, the work completed, and an occupancy permit granted. This then would allow the club to relocate. Under our relocation policy, this cost would have been included in the amount paid. This club's membership is small, and they have already agreed to move themselves. Additionally, because of this delay, they will now have to heat and pay utilities on two buildings this winter. Architectural Design Group (ADG), working in conjunction with the Building Department, has submitted a proposal to draw up plans that will meet City specifications, and submit them for approval. Cost for these services by ADG is $11,500. It is anticipated the actual cost will be lower because construction oversight should not be required. What We Do Today Makes A Difference! Staff requests approval of this professional services agreement, to allow the relocation of the club to move forward. It is also anticipated that there will be further relocation costs that will be brought to the Commission for approval, once it is clear what the City will require the club to do. Jefferson Blvd. Suite 1200 -S South Bend, IN 46601 Code Compliance Work for Clubhouse Relocation 2602 Western Ave., South Bend Dear Mr. Relos: The following is our proposal to provide professional design services for architectural work as required to convert the former Kolacz Market building at the corner of Western Ave. and Meade into a clubhouse for the Hell's Angels motorcycle club. SCOPE OF WORK 1. ADG, Inc. will measure the existing building (3 levels) and draw existing floor plans. The drawings will be of sufficient detail to allow for code review by local and state building officials. 2. ADG will design architectural / structural improvements needed to bring the building into code compliance for the change of occupancy in the building. Improvements will include: redesign of the entrances and addition of accessible restrooms. 3. ADG will meet with local code officials to review the proposed work. ADG will assist the City in submitting the project to the Department of Homeland Security in Indianapolis in order to gain state approval for the work. 4. Based on the approved design, ADG will prepare bid specifications so that the project may be competitively bid by the City of South Bend. If required, ADG will incorporate the city's front end documents, including wage rate information, into the project manual. 5. During construction, ADG will perform the minimum construction inspection and administration work as required by the state to assure that the work is being done in compliance with the approved plans and specifications. 6. Preliminary discussions with the county Building Commissioner indicate that the existing mechanical and electrical systems will not need to be upgraded or brought into strict code compliance in order to get an occupancy permit, so we did not include general mechanical and electrical renovation work in this proposal. FEE For the scope of work outlined above, ADG proposes a fee of $11,500.00. We do not anticipate any substantial reimbursable expenses. Any typical reimbursable costs such as document printing, and the state plan review fee will be billed to you at cost.
