Quotations submitted by Art Emerson, for the repair of his car,
am-aged by Fire Department equipment, were delivered to the City Attorney
y Fire Chief, Richard J. Duck, who, being present, stated that in his
pinion, the Fire Department was at fault and Mr. Emerson is entitled
o redress in this instance.
The Fire Chief then presented quotations for the painting of Hose
Ouse No. 3. The Board examined these quotations and awarded this paint
ob to Modern Decorating Company, as having submitted the lowest and
est offer.
Captain's and Lieutenants Daily Reports, covering runs made into
utlying area by Engine Companies Il, 13 and 22, during the period of
une 23rd to July 5th inclusive, were examined and ordered filed.
LICE DEPARTMENT:
The Police Department application of Virgil F. Kulwicki, was examined
referred to the Director of Personnel.
In consideration of the fact that prices currently being paid for
i_res by the City, from a single source, are found to be out of line in
orrparison with the prices available for equal quality from other tire
endors, the Board directed that future tire business be divided among.

various models, deemed suitable for Fire Departmentts needs, were referred
to Fire Chief, Richard J. Duck for his consideration.
Then appeared before the Board, William R. ivlorris, , president of the
South Bend N.A.A.C.P. and pointed out to the Board the fact that the Police
Department has been unable to enforce the directive of the Board, issued_
under date of March 8, 1954.. Chief of Police, Richard J.. Gillen, being
present stated, "there is no deputy prosecutor available after certain.
hours, and especially that time of the day when the offense in question
usually occurs," and because of this fact, the City has been unable to
carry through in the matter of making arrests under the Board's directive.
Mr. Morris then advised that-this situation has been discussed with
the Prosecuting Attorney and the Prosecutor informed Mr. Morris and his
committee that the deputies can be called by telephone at their homes.
Chief Gillen then stated that the _Prosecutor has not notified the Police
Department in this connection. Chief Gillen further advised that in the
event the deputy prosecutor does appear, it will also require the presence
of the City Clerk, or Deputy City Clerk. A considerable amount of dis-
cussion ensued, taken part in mainly by attorney I. A. Hurwich, as chairman
of the Board of Public Safety, and Attorney Chas. A. Wills, speaking for
the N. A. A. C. P. It was the consensus of the Board, that the only safe
practice to follow is that of making no arrest without a warrant in these
cases involving discrimination.
