VACATED O'BRIEN STREET FOR A DISTANCE OF 107 FEET MORE
OF LESS AND A WIDTH OF 12 FEET. BEING A PART OF OAK GROVE
ADDITION, PORTAGE TOWNSHIP, CITY OF SOUTH BEND, ST.
JOSEPH COUNTY, INDIANA.
STATEMENT OF PURPOSE AND INTENT
Pursuant to Indiana Code Section 36-7-3-12, the Common Council is
charges with the authority to hear all petitions to vacate public ways or public
places within the City.
The following Ordinance vacates the above described public property.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL
OF THE CITY OF SOUTH BEND, INDIANA, as follows:
SECTION I. The Common Council of the City of South Bend having held a
Public hearing on the petition to vacate the following property:
THE ALLEY TO BE VACATED IS THE FIRST EAST-WEST ALLEY
NORTH OF WASHINGTON STREET, EXTENDING FROM THE FIRST
NORTH-SOUTH ALLEY EAST OF HUEY STREET, EAST TO THE NOW
VACATED O'BRIEN STREET FOR A DISTANCE OF 107 FEET MORE
OF LESS AND A WIDTH OF 12 FEET. BEING A PART OF OAK GROVE
ADDITION, PORTAGE TOWNSHIP, CITY OF SOUTH BEND, ST.
JOSEPH COUNTY, INDIANA.
hereby determines that it is desirable to vacate said property.
SECTION II. The City of South Bend hereby reserves the rights and
easements of all utilities and the Municipal City of South Bend, Indiana, to
construct and maintain any facilities, including, but not limited to, the following:
electric, telephone, gas, water, sewer, surface water control structures and
ditches, within the vacated right-of-way, unless such rights are released by the
individual utilities.
SECTION III. The following property may be injuriously or beneficially
affected by such vacating:

SECTION IV. The purpose of the vacation of the real property is to allow
the owners to benefit from the most applicable use of their property which lies
adjacent to the petitioned alley and contains 100% of the alley's frontage.
SECTION V. This ordinance shall be in full force and effect from and after
its passage by the Common Council and approval by the Mayor.

Dear Mr. Lang:
On September 24; 2007, the Board of Public Works reviewed your petition to vacate the
above alley. The following comments and recommendations were submitted from the
Engineering Division, Area Plan Commission, Community & Economic Development, Fire
Department, Police Department, Solid Waste Division and the City Attorney's Office:
Area Plan stated that the vacation would not hinder the growth or orderly development of
the unit or neighborhood in which it is located or to which it is contiguous. Four houses use the
alley for garbage pick-up. The vacation would not make access to the lands of the aggrieved
person by means of public way difficult or inconvenient. The vacation would not hinder the
public's access to a church, school or other public building or place. The vacation would hinder
the use of a public right of way by the neighborhood in which it is located or to which it is
contiguous.
The Department of Solid Waste stated tl2at vacating this alley would affect garbage
collection in the area. The Police Department is concerned with garbage pickup for the residents
of the 100 block of North Huey Street. Community & Economic Development stated that there
appears to be four residents on Huey Street with garages on the alley. The garages do not have
access to the street. '
The Board recommended the above vacation favorably pursuant to the garbage and
garage access issues being addressed. Evidence in the form of a plan for the resolution of these
issues with your adjoining property owners' signatures is required.

Several homes access garages off of the alley.
The staff recommends the entire alley not be vacated.

City to monitor lawn parking under new ordinance

Property owners who park vehicles on their lawns during Saturday's University of Notre
Dame -home football game will have their activities monitored and documented by city
Code Enforcement regulators and South Bend police officers.
The city's new special events parking ordinance was passed Sept. 24 by the South Bend
Common Council and is now in effect. Documentation collected during game day will be
referred to the city's Legal Department for enforcement decisions. Saturday's home game
against Boston College is the first since the ordinance's passage.
Under the legislation now in effect, city property owners wanting to park vehicles on
lawns during Notre Dame home football games need to submit an application and pay a
$5 fee by 4:45 p.m. the Thursday before game day. Violators risk a citation and a $50
fine for the first offense. Subsequent offenses will result in higher fines and the risk of
cancellation or prohibition of future lawn parking. Fines can reach as high as $2,500 for
chronic violators.
City law prohibits parking in front yards in residential neighborhoods, but the new special
events ordinance defined exceptions for Residential One-Day Conditional Use lawn
parking with specific terms and conditions.
As of today, no applications had been filed with the city's Department of Administration
and Finance for aspecial-events parking permit, although about one dozen applications
were requested by residents.
"This first weekend of enforcement will give us the sense of the amount of resources the
city needs to commit to ensuring that public safety is maintained," said City Attorney
Chuck Leone. "The extensive discussion of this ordinance before its passage should help
provide a high level of cooperation and compliance,."
Applicants may pick up a form in the Administration and Finance office, 12th floor,
County-City Building, 225 W. Jefferson Blvd.
In order to ensure general public safety, the city will continue to enforce its Municipal
Code regarding:
^ Parking that blocks or hinders access by public-safety vehicles on all public streets
and right of ways.
^ Parking that blocks or impeded access to sidewalks, fire hydrants and driveways.
^ Driving over curbs and sidewalks, other than on a paved driveway.
^ Park in a designated "No Parking" zone.
The special events ordinance also includes other provisions, including property owner
responsibilities for the removal of trash as well as tents and trash containers within a
specified time period. In addition, the ordinance prohibits the use of outdoor portable
toilets, except for religious uses, schools or parks, as needed for special events.
The ordinance will continue to be enforced for the remaining Notre Dame home games:
^ Oct. 20 vs. USC
^ Nov. 3 vs. Navy
^ Nov. 10 vs. Air Force
^ Nov. 17 vs. Duke
