Lieutenant Lanchsweerdt agreed if it's not covered in the matrix it gives the Chief flexibility,
but most offenses fall within the matrix. Mr. Bodnar added the Board is not bound by the
matrix minimum, and the Board still comes in when the offense requires more than five days
suspension. Mr. Bodnar asked the Chief if he,would like to receive feedback continents from
the Board members individually. Chief Boykins stated if they all meet together and come up
with a consensus, he would prefer that over individual comments. Mr. Bodnar stated that
setting policies cannot be done in the Executive Session; the Board should consider
discussing changes to the policy at the next Board of Safety Agenda Session. Lieutenant
Lanchsweerdt clarified the procedure on several offenses occurring at once. He noted the
maximum offense is looked at, and the other offenses are referred to as incidental.to the first
one. He stated this is the first policy that allows progression based on the number of offenses.
Repeated offenses can now lead to dismissal. Mr. Cottrell asked if there was a discipline
matrix for all other City employees with the exception of Fire and Police. Mr. Bodnar stated
he had distributed it previously. He added he would get all of the Board members copies
again today. Ms. Vasquez. Mr. BonDurant, and President Dempsey agreed this policy is a
good idea and is beneficial to the Chief. President Dempsey stated she likes that it gives the
officers better guidelines of what to expect also. The Board members agreed to look it over
before the next meeting.

There being no further business to come before the Board, President Dempsey declared the meeting
adjourned at 8 :49 a.m.

The Board of Public Safety met in the Executive Session on Wednesday, March 31, 2010 at 8:52
a.m. The meeting was held in the Mayor's Conference Room, 14`h Floor, County City Building,
South Bend, Indiana, for the purposes specified in I.C. 5- 14- 1.5 -6.1 (b) (2) (B) and (b) (6) (A).
President Juanita Dempsey and Board Members Patrick Cottrell, Bruce BonDurant, Laura Vasquez,
and Eddie Miller were present. Also present were Police Chief Darryl Boykins, Fire Chief Howard
Buchanon, and Board Attorney Thomas Bodnar. Board members did not discuss any subject matter
other than the subject matter as specified in the Public Notice. The meeting adjourned at 9:14 a.m.

ACCEPT AND APPROVE PROMOTION — BRIAN YOUNG
In a letter to the Board, Chief Boykins recommended that Lieutenant Brian Young be promoted to
the rank of Captain in the Investigative Division effective March 22, 2010. Upon a motion made by
Mr. BonDurant, seconded by Mr. Cottrell and carried, the recommended promotion was approved.
Chief Boykins pinned Captain Young's badge on him and the Board joined the Chief in
congratulating him. President Dempsey asked if he wished to speak. Captain Young stated he
appreciated the opportunity, and confidence the Chief has shown in him. He thanked everyone
present.
APPROVE PERMANENT PROMOTION — MARCUS WRIGHT
In a letter to the Board, Chief Boykins recommended that Sergeant Marcus Wright be promoted
permanently to the rank of Lieutenant effective April 8, 2010. Chief Boykins stated in his letter that
Sergeant Wright was placed in a special assignment as a Lieutenant in the Investigative Division on
April 8, 2009. This special assignment required several evaluations to be completed for one year to
note the progress he was making as a supervisor. Upon a motion made by Mr. BonDurant, seconded
by Mr. Cottrell and carried, the recommended permanent promotion was approved.
APPROVE RECOMMENDATION FOR EMPLOYEE OF THE MONTH — JANUARY 2010
JAMES MAXEY
Chief Boykins stated that Corporal James Maxey was selected as Employee of the Month for
January, 2010. The award is to recognize officers, civilian employees, on the South Bend Police
Department who have demonstrated actions noted by supervisors or citizens from both a professional
law enforcement position and in support of the community policing efforts with citizens of South
Bend. There being no further discussion, a motion to approve the recommendation was made by Mr.
BonDurant, seconded by Mr. Cottrell and carried.
FILING OF MONTHLY STATISTICAL ANALYSIS REPORT
— FEBRUARY 2010
President Dempsey indicated that unless there were questions or objections by members of the
Board, the monthly statistical report for the month of February 2010 as submitted by the Police
Department, would be accepted for filing. There being no objections, the following report was

The Board of Public Safety met in a special meeting at 1:30 p.m. on Monday, April 12, 2010 with
President Juanita Dempsey and Board Members Patrick Cottrell, Bruce J. BonDurant, Laura
Vasquez, and Eddie Miller present. Also present during the session were Police Chief Darryl
Boykin; Board Attorney Thomas Bodnar; Special Counsel Joseph Simeri; Attorneys for Nicholas
McKinley, Edward Merchant and Leo Blackwell; and Patrolman Nicholas McKinley. A court
reporter from Midwest Reporting was present to record the Hearing. The Hearing was held in the
Common Council Chambers, 4th Floor, County -City Building, South Bend, Indiana.
