AUGUST 25, 2010 67
The Board of Public Safety met in the Public Agenda Session at 8:00 a.m. on Wednesday, August
25, 2010 with Board President Juanita Dempsey, and Board Members Patrick D. Cottrell, Bruce J.
BonDurant, and Eddie Miller present. Also present were Board Attorney Thomas Bodnar, Police
Chief Darryl Boykins, and Fire Chief Howard Buchanon.
The meeting was held in the Board of Public Works Meeting Room, 13"' Floor, County City
Building, South Bend, Indiana.
Board members discussed the following items:
- Addition to the Agenda
Mr. Bodnar noted the addition of a letter of request for a demotion for the Police Department.
Employee of the Month — Police Department
Chief Darryl Boykins stated Corporal Mark Walsh was selected for the Employee of the
Month for June, 2010. The Chief noted that Corporal Walsh saved a life in the parking lot of
Walmart by applying CPR. Corporal Walsh also helped make an arrest and solve the case of
over $200,000.00 in counterfeit checks produced.
Letter of Recommendation for New Fire Department Chaplain
Board Attorney Thomas Bodnar noted the Board has the authority to appoint the Chaplain..
Swearing in of Officers -- Police Department
Chief Darryl Boykins stated the three individuals being sworn in today came through earlier
than anticipated and will bring the department up to full staff for now. He noted there are
some retirements anticipated to be coming up. Chief Boykins stated two of the candidates
have their degrees. He also stated two of the candidates come from employment at the
County Jail and one is currently unemployed.
ADJOURNMENT
There being no further business to come before the Board, President Dempsey declared the meeting
adjourned at 8:29 a.m.

POLICE SELECTION PANEL AUGUST 25, 2010 68
The Police Selection Panel met at 8:29 a.m. on Wednesday, August 25, 2010 in the Board of Public
Works Meeting Room, 13th Floor County City Building, South Bend, Indiana, for the purpose of
formulating a recommendation to be made to the Board of Public Safety. Present were Police Chief
Darryl Boykin, Board Attorney Thomas Bodnar, and Board President Juanita Dempsey. Upon a
motion by Ms. Dempsey, seconded by Mr. Bodnar and carried, the recommendation from Police
Chief Boykins to appoint Jason Borrell, Nicholas Pogotis, and Gregory Howard to the South Bend
Police Department as probationary employees for a period of one (1) year, effective August 25, 2010,
was approved. The Police Selection Panel adjourned at 8:31 a.m.

The Board of Public Safety met in the Executive Session on August 25, 2010, at 8:40 a.m. The
meeting was held in the Mayor's Conference Room, 14th Floor County City Building, South Bend,
Indiana, for the purposes specified in T.C. 5- 14- 1.5 -6.1 (b) (2) (A) and (b) (6) (A) and T.C. 5-14-1.5 -
6.1(b)(7). Board President Juanita Dempsey, Board Members Bruce J. BonDurant, Patrick Cottrell,
and Eddie Miller were present. Also present were Board Attorney Thomas Bodnar, Police Chief
Darryl Boykins, and Fire Chief Howard Buchanon. Board members did not discuss any subject
matter other than the subject matter as specified in the Public Notice. The meeting adjourned at 9:05
a.m.

REGULAR MEETING AUGUST 25, . 2010
The Board of Public Safety met in the regular meeting at 9:15 a.m, on Wednesday, August 25, 2010,
with Board President Juanita Dempsey, and Board Members Bruce J. BonDurant, Patrick D. Cottrell,
and Eddie Miller present. Also present were Police Chief Darryl Boykins, Fire Chief Howard
Buchanon and Board Attorney Thomas Bodnar.
The meeting was held in the Common Council Chambers, 4th Floor, County City Building, South
Bend, Indiana.
ACCEPT MINUTES OF PREVIOUS MEETING
President Dempsey stated that unless there were any objections, the Minutes of the August 4, 2010
meeting and the Special Meeting of August 18, 2010 would be accepted as presented.
POLICE DEPARTMENT
POLICE SELECTION PANEL
Upon a motion by Mr. Cottrell, seconded by Mr. BonDurant and carried, the Police Selection Panel
approved the recommendation of Police Chief Boykins and the recommendation of the Police
Selection Panel, that Jason Michael Borrell, Nicholas Keith Pogotis, and Gregory Russell Howard be
accepted for employment as probationary police officers with the South Bend Police Department for
a probationary period of one {1} year, beginning August 25, 2010.

Mr. John Voorde, City Clerk, was present and administered the Oath of Office for the swearing in of
the above officers. Chief Boykins joined the Board in congratulating the newly sworn in officers and
wishing them well in their endeavors with the South Bend Police Department.

ACCEPT AND APPROVE RETIREMENT — CORPORAL ERNEST NYBO
President Dempsey advised that Chief Darryl Boykins has submitted to the Board the Application
and Declaration for Retirement for Corporal Ernest Nybo effective August 30, 2010. Chief Boykin
noted that he has served the Department with loyalty and distinction during the last thirty -five (35)
years, four (4) months and three (3) days. Chief Boykins joined the Board in thanking him for his
commitment, dedication and years of distinguished service to the South Bend Police Department and
the citizens of South Bend. Upon a motion made by Mr. Cottrell, seconded by Mr. BonDurant and
carried, the retirement was accepted and approved.
ACCEPT AND FILE RECOMMENDATION FOR EMPLOYEE OF THE MONTH — JUNE 2010
In a letter to the Board, Chief Boykins stated that Corporal Mark-Walsh was selected as Employee of
the Month for June 2010. The award is to recognize officers, civilian employees, on the South Bend
Police Department who have demonstrated actions noted by supervisors or citizens from both a
professional law enforcement position and in support of the community policing efforts with citizens
of South Bend. There being no further discussion, President Dempsey stated the recommendation
would be accepted for filing.
FILING OF MONTHLY STATISTICAL ANALYSIS REPORT — JULY 2010
President Dempsey indicated that unless there were questions or objections by members of the
Board, the statistical analysis report for the month of July 2010, as submitted by the Police
Department, would be accepted for filing. There being no objections, the following report was
accepted for filing:
ACCEPT AND APPROVE DEMOTION REQUEST — HARVEY MILLS
In a letter to the Board, Chief Boykins recommended that Sergeant Harvey Mills be demoted
permanently, to the rank of Corporal effective August 25, 2010. Chief Boykins stated in his letter to
the Board that Sergeant Mills was in violation of the South Bend Police Department Duty Manual
Section 416, and Section 207 -04 (A)(8), not following -up with victims and witnesses until the
conclusion of investigations, and appearing in court in casual attire. Upon a motion made by Mr.
Cottrell, seconded by Mr. BonDurant and carried, the recommended demotion was approved.
FIRE DEPARTMENT
APPROVE LETTER OF RECOMMENDATION FORNEW FIRE DEPARTMENT CHAPLAIN —
REVEREND RICARDO TAYLOR
In a letter to the Board, Chief Buchanon requested the Board approve his recommendation of
Reverend Ricardo Taylor, Pastor of Mount Carmel Missionary Baptist Church, 137 E. Indiana
Avenue, South Bend, as the new Chaplain of the South Bend Fire Department, due to the retirement
of Reverend Don Neely. Reverend Taylor was present and introduced himself to the Board. He stated
he is looking forward to serving the City. Therefore, upon a motion by Mr. Miller, seconded by Mr.
BonDurant and carried, the recommendation was approved.
APPROVE REQUEST FOR DISABILITY PENSION ALLEN PRICE
In a letter to the Board, Chief Buchanon requested the Board approve his request for disability
pension for Lieutenant Paramedic Allen Price. Chief Buchanon noted he received a letter from Mr.

Price's doctors, a letter from the Dr. Vickie Wipperman, Medical Director for the City Fire
Department, and a letter from the local Pension Board and PERF, all recommending and approving
the request. Therefore, upon a motion by Mr. Miller, seconded by Mr. BonDurant and carried, the
requested disability pension for Lt. Paramedic Allen Price was approved. President Dempsey made a
motion that the approval be effective August 3, 2010, which was seconded by Mr. BonDurant and
carried.
FILING OF MONTHLY STATISTICAL ANALYSIS REPORT — JULY 2010
Chief Howard Buchanon submitted to the Board the Monthly Statistical Analysis report for the
month of July, 2010 compiled by the Prevention/Inspection Bureau of the Fire Department. The
following report was accepted for filing by the Board:
