COLLEGE STREET, SOUTH BEND, INDIANA, COUNCILMANIC DISTRICT TWO (2) IN THE CITY OF SOUTH BEND, INDIANA STATEMENT OF PURPOSE AND INTENT The current zoning of the property is SF2 Single Family and Two Family District. The zoning will be changed to LI Light Industrial District so that the commercial building currently on the property maybe used to conduct business operations of MCE, INC, which include the remanufacture and sale of printer toner cartridges and printer repair and sales. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of South Bend, Indiana as follows: SECTION 1. Ordinance No. 9495-04 is amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Lots numbered two hundred fifty-one (251), two hundred fifty-two (252), two hundred fifty-three (253) and two hundred fifty-four (254) as shown on the recorded plat of Raff, Sibley & Fassnacht's Linden Place Addition to the City of South Bend, recorded May 26, 1891 in Plat Book 5, page 51, in the Office of the Recorder of St. Joseph County, Indiana. The rezoning is adjacent to the northern LI Light Industrial District. There have been no proposals to convert the existing site to any other uses. The rezoning will allow the re-use of a structure that might otherwise continue to deteriorate. Location: 619 College Street Jurisdiction: City of South Bend Requested Action: The petitioner is requesting a zone change from SF2 Single Family and Two Family Residential District to LI Light Industrial District to allow uses allowed in the LI Industrial District. Land Uses and Zoning: On site: On site is a vacant non-residential building zoned SF2 Single Family and Two Family District. North: To the north across Longley Avenue is a single family house zoned LI Light Industrial District. East: To the east across College Street is a single family house SF2 Single Family and Two Family District. South: To the south are two single family houses and undeveloped property zoned SF2 Single Family and Two Family District. West: To the west is an old rail road corridor. District uses and development standards: The LI Light Industrial District is established to provide for development of office/warehouse, warehouse/distribution, wholesale, assembly and manufacturing or processing facilities which are clean, quiet, free of hazardous or objectionable elements such as noise, odor, dust, smoke, or glare. Permitted uses in this district tend to generate heavy traffic, require extensive community facilities, and may require limited amounts of outdoor storage. The LI District is also intended to function as a transitional district between the more intense general industrial districts and other less intense districts. Site plan description: The site is 0.35 acres in size (15,180 square feet). The petitioner seeks to reuse the existing non- residential building for the following business operations of MCE, Inc: office, remanufacture of printer tone cartridges, printer repair services, printer sales, and delivery. The petitioner filed the following variances with the City Board of Zoning Appeals: setbacks to allow the building at its existing location, parking reduction from 12 to eight spaces, no residential landscape buffering on the west and south property lines, and planting three trees instead of landscape buffering along the east property line. Zoning and land use history & trends: The existing building was previously used for light industrial purposes. The previous zoning of the property was D Light Industrial with minimum setbacks between 0-5 feet. Traffic and transportation considerations: The property is bounded by College Street to the east, Longley Avenue to the north, the rail road corridor to the west, and an unpaved alley to the south. Utilities: The site is served by City of South Bend water and sewer. WHJ, Inc. #2402-06 Page 1 of 3 5 Criteria (per IC 36-7-4-603): 1. Comprehensive Plan: Policy Plan: Objective A: Ensure that suitable areas are available for future industrial development. The rezoning is consistent with the Comprehensive Plan economic objectives. 2. Current conditions and character: The property is located in a transitional area between single family houses to the south and commercial businesses to the north. 3. Most desirable use: Because of the existing building, the most desirable land use is light industrial or commercial. 4. Conservation of property values: The surrounding property values may be unaffected with the reuse of the building, which was not designed for single-family use. 5. Responsible development and growth: It is responsible development and growth to allow appropriate and compatible re-use of vacant buildings. Recommendation: Based on information available prior to the public hearing, the staff recommends the petition be sent to the Common Council with a favorable recommendation. Analysis: The rezoning is adjacent to the northern LI Light Industrial District. There have been no proposals to convert the existing site any other uses.
