2010 South Bend Common Council
The July 12, 2010 meeting of .the Zoning and Annexation Committee of the South Bend Common
Council was called to order by its Chairperson Council Member AI "Buddy" Kirsits at 4:00 p.m. in
the Council's Informal Meeting Room, 4t Floor of the County-City Building.
Persons in attendance included Council Members: Dieter, Puzzello, Varner, Rouse, Kirsits, and
and White; Rita Kopola, Derek Spier, Catherine Pittman, Mark Lyons, Public Works Director Gary
Gilot, P.E., David L. Mirkin, Todd Stull, and Kathleen Cekanski-Farrand, Council Attorney, .and
members of the television media.
Council Member Kirsits noted that the committee members include Council Members Oliver Davis
who is the Vice-Chairperson, Dr. Varner, Thomas LaFountain and himself. Council Member Kirsits
stated that Council Member Oliver Davis is attending the funeral of his Mother and extended his
deepest sympathy to him and his family. He also noted that Council Member LaFountain is on
vacation with his family. As a result there is not a quorum present and all Bills will be heard and
will be sent to the Common Council without recommendation.
Substitute Bill No. 24-10 Rezoning Request for 850 Fellows Street
Council Member Kirsits called for a report from Area Plan on Substitute Bill No. 24-10.
Derek Spier, a Planner with Area Plan gave the report. He noted that the request is from H.G.
Christman Construction Company, Inc. and is requested a zone change from LI Light Industrial
District to GI General Industrial District to allow a wrecker service on 2.3 acres. At the June 15,
2010 the Area Plan Commission held a public hearing where there were no remonstrators. The
Area Plan Commission sends the request to the Council with a favorable recommendation.
Mr. David L. Mirkin, an attorney with offices at112 West Jefferson Boulevard, Suite 400 in
downtown South Bend made the formal presentation. Mr. Mirkin that he represents LTODD, LLC
whose principal owner is Todd Stull who is present with him today.) They operate a company
called Bestway Towing who does the majority of their business towing for the City of South Bend.
Approximately 60% to 70% of their business is for the city where they need a vehicle impounded or
towed. They will move from their current location on Walnut Street.
In response to a question from Dr. Varner, Mr. Mirkin stated that they do not do any long time
storage.
In response to a question from Council Member White, Mr. Mlrkin stated that they average 35-45
vehicles being towed per week.
Council Member Kirsits noted that he play Park League ball with Todd Stull and has known him for
many years. He will be supporting this request this evening.
There was no one from the public to speak in favor or in opposition. In light of a quorum not being
present, no formal action was taken on the Bill by the Committee.

Substitute Bill No. 10-31 Special Exception Request for 850 Fellows Street
Council Member Kirsits called for a report from the Board of Zoning Appeals on Bill No. 10-31.
Mark Lyons of the Building Department reported that a hearing was held before the Area Board of
Zoning Appeals to permit a special exception use for a wrecker service required by the City Code
to permit outdoor storage or operations. The Board sends the request with a unanimous favorable
recommendation.
Mr. Mirkin stated that every time that a towing company is requesting outdoor storage that the
Code requires to City Council to look at each one pursuant to their special exception regulations.
There was no one from the public to speak in favor or in opposition. In light of a quorum not being
present, no formal action was taken on the Bill by the Committee.
There was no miscellaneous business.
Council Member Kirsits then adjourned the meeting at 4:08 p.m.
