Attached is a professional service proposal from Lawson-Fisher Associates to provide
engineering services for an access study for Norman Street at South Michigan Street. The
purpose of the proposal is to study traffic patterns at and around the intersection and to
make determinations if the lane restrictions made on South Michigan Street can be modified
to provide safer access to Norman Street. Improved access to Norman Street would help
Culver's Restaurant currently located at the intersection as well as improve the
developability of the land to the north of Norman Street.
The proposal is a not to exceed amount of $2,500.00. Staff requests favorable approval of
this proposal.

Based upon several conversations, e-mails, and our meeting with you and Carl
Littrell on July 12, 2010, Lawson-Fisher Associates P.C. is submitting this proposal to
provide Professional Engineering Services for a Traffic Access Study and Report at the
referenced intersection. The following is a Project Description, Scope of Services, Fee
and Schedule for the project:
PROJECT DESCRIPTION
Problem Statement
In 2007, the City completed an LPA reconstruction project of the intersection of
South Michigan Street and Ireland Road. The project included improvements to
the existing street and drive approaches from south of the intersection north to
the intersection of South Michigan and Chippewa Avenue. Part of those
improvements was the construction of anon-mountable concrete center curb
from the Ireland Road intersection north to a point approximately 36-feet north of
the intersection of South Michigan Street and Norman Street. The purpose of the
center curb was to add to/replace a concrete divider used for access control and
channelization (protection) of the high volume of left turn traffic on the
southbound approach to the signal at South Michigan and Ireland Road. This
treatment was also constructed on the eastbound and northbound approaches.
Since the completion of construction in 2007, the City has been requested to
remove the concrete center curb directly in front of the Norman Street approach
in order to allow southbound Michigan Street traffic access for turns onto Norman
Street. The City has been mindful of those requests; however, it has considered
that traffic should be allowed sufficient time to become operationally accustomed
to the intersection, as well as to ascertain if overall traffic volumes would increase
at the intersection.

It appears that the traffic volume growth may be less than anticipated, and that
nothing indicates that the center curb should be extended further to the north on
this southbound approach. Driver awareness of the purpose and use of the
south bound double left turn lanes appears to be substantially complete, as well
as the use of the center left turn lanes immediately north of the concrete center
curb.
Therefore, the City is considering a change in access control, and needs a traffic
engineering study to determine if and what changes should be made.
SCOPE OF SERVICES, FEE AND SCHEDULE
Engineering services to be provided by LFA include:
• Determining the type of field information (traffic counts, gap studies, crash
records) needed.
• Coordinating and communicating the field work to and from City staff.
• Analysis of data.
• Preparation of a Traffic Engineering Access Report and Recommendations
for draft review and final completion of the study. This will include meetings,
sketch drawings, and field reviews.
• We anticipate that our recommendations and the City's final determination
will involve a considerable amount of engineering judgment and past
experience in access control.
We propose to complete the Traffic Access Study and Report on an hourly basis
in accordance with Attachment "A". The estimated fee is $2,500 based on the above
Scope of Services and fourteen (14) hours of engineering time, with two (2) hours of
support/administrative time. Traffic counting, gap measurements, and Construction Plan
Services are not included in the estimated fee. We will start the Project immediately
upon receipt of a Notice to Proceed and complete the Study in approximately 15 days,
exclusive of field work scheduling delays.
You may accept this proposal by signature in the space provided below.

PAYMENTS TO ENGINEER
1. Methods of Payment for Services and Expenses of ENGINEER. OWNER shall pay ENGINEER for professional
Services and Expenses as follows:
1.1 Basic Services•
1.1.1 General. For Services rendered an amount equal to ENGINEER's Salary Costs times a factor of 2.37 for all time for
Basic Services rendered by principals and employees engaged directly on the Project.
1.1.2 Resident Project Services. For services of ENGINEER'S Resident Project Representative (and assistants) furnished for
the project on the basis of Salary Costs times a factor of 2.37 for services rendered by principals and employees assigned
to Resident Project representation.
1.1.3 Professional Associates and Consultants. For services and Reimbursable Expenses of independent professional
associates and consultants employed by ENGINEER to render Basic Services, the amount billed to ENGINEER therefor
times a factor of 1.10.
1.1.4 Operational Phase Services. For Operational Phase services furnished, an amount equal to ENGINEER'S Salary Costs
times a factor of 2.37 for services rendered by principals and employees engaged directly on the Project.
1.2 Additional Services:
1.2.1 General. For Additional Services of Engineer's principals and employees engaged directly on the Project and rendered
(except services as witness), on the basis of ENGINEER'S Salary Costs times a factor of 2.37.
1.2.2 Professional Associates and Consultants. For services and Reimbursable Expenses of independent professional
associates and consultants employed by ENGINEER to render Additional Services, the amount billed to ENGINEER
therefor times a factor of 1.10.
1.2.3 Serving as a Witness. For services rendered by ENGIlVEER's principals and employees as consultants or witnesses in
any litigation, arbitration or other legal or administrative proceeding at the rate of 1.35 times the rates in Pazagraph
1.2.1. Compensation for ENGINEER's independent professional associates and consultants will be on the basis
provided in paragraph 1.2.2.
1.3 Reimbursable Expenses. In addition to payments provided for in paragraphs 1.1 and 1.2, OWNER shall pay
ENGINEER the actual costs (except where specifically provided otherwise) of all Reimbursable expenses incurred in
connection with all Basic and Additional Services.
1.4 Specialized Equipment. In addition to payments set out above, a chazge may be made for specialized equipment usage
as required.
2. Times of Payments.
2.1 Engineer shall submit invoices covering each calendaz month for Basic and Additional Services rendered and for
Reimbursable Expenses incurred. OWNER shall pay ENGINEER promptly within thirty (30) calendaz days following
the ENGINEER'S rendering of these invoices to the OWNER.

3. Other Provisions Concerning Payments:
3.1 If OWNER should fail to make any payment due ENGINEER for services and expenses within sixty (60) calendaz days
after receipt of ENGINEER's statement therefor, the amounts due ENGINEER will be increased at the rate of 1% per
month from said sixtieth day, and in addition, ENGINEER may, after giving seven days written notice to OWNER,
suspend services under this Agreement until ENGINEER has been paid in full all amounts due for services, expenses
and chazges.
3.2 In the event of termination by OWNER upon the completion of any phase of the Basic Services, progress payments due
ENGINEER for services rendered through such phase shall constitute total payment for such services. In the event of
such termination by OWNER during any phase of the Basic Services, ENGINEER also will be reimbwsed for the
chazges of independent professional associates and consultants employed by ENGINEER to render Basic Services, and
paid for services rendered dwing that phase on [he basis of ENGINEER's Salary Costs times a factor of 2.37 for services
rendered during that phase to date of termination by ENGINEER's principals and employees engaged dn•ectly on the
Project. In the event of any such termination, ENGINEER will be paid for all unpaid Additional Services and unpaid
Reimbwsable Expenses, plus all termination expenses. Termination expenses mean additional Reimbursable Expenses
duectly attributable to termination, which, if termination is at Owner's convenience, shall include an amount computed
as a percentage of total compensation for Basic Services earned by ENGINEER to the date of termination, as follows:
20% if termination occurs after commencement of the Preliminazy Design Phase but prior to
commencement of the Final Design Phase; or
10% if termination occurs after commencement of the Final Design Phase.
3.3 Records of ENGINEER'S Salary Costs pertinent to ENGINEER'S compensation under this Agreement will be kept in
accordance with generally accepted accounting practices. Copies will be made available to OWNER at cost, if
requested prior to final payment for ENGINEER'S services.
3.4 Whenever a factor is applied to Salary Costs in determining compensation payable to ENGINEER, that factor may be
adjusted periodically and equitably to reflect changes in the various elements that comprise such factor. All such
adjustments will be in accordance with generally accepted accounting practices as applied on a consistent basis by
ENGINEER and consistent with ENGINEER's overall compensation practices and procedwes.
4. Definitions:
4.1 The Salary Costs used as a basis for payment mean salaries and wages (basic and incentive) paid to all ENGINEER'S
personnel engaged directly on the Project, including, but not limited to, engineers, architects, swveyors, designers,
draftsmen, specification writers, estimators, other technical and business personnel; plus the cost of customary and
statutory benefits including, but not limited to, social security contributions, unemployment, excise and payroll taxes,
workers' compensation, health and retirement benefits, sick leave, vacation and holiday pay and other group benefits.
The amount of customary and statutory benefits of all personnel of ENGINEER will be considered to be equal to 33%
of the salaries and wages, subject to equitable adjustment to reflect changes in ENGINEER's overall compensation
procedwes and practices.
4.2 Reimbwsable Expenses mean the actual expenses incurred by ENGINEER or ENGINEER'S independent professional
associates or consultants directly or indirectly in connection with the Project, such as expenses for: transportation and
subsistence incidental thereto; obtaining the bids or proposals from Contractor(s); providing and maintaining field office
facilities including furnishings and utilities; subsistence and transportation of Resident Project Representatives and their
assistants; toll telephone calls and telegrams; reproduction of Reports, Drawings, Specifications, Bidding Documents
and similaz Project-related items in addition to those required under Section 1; and if necessary, overtime work required
higher than regular rates.
