AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY
LOCATED AT 1201 WEST WASHINGTON STREET, COUNCiLMANIC
DISTRICT 2, IN THE CITY OF SOUTH BEND, INDIANA
STATEMENT OF PURPOSE AND INTENT
The property at 1201 West Washington Street is now zoned MU, Mixed Use, and
it is requested to rezone the property to SF 2 (Single Family 2). When the last
neighborhood rezoning took place, 1201 West Washington Street was a
combination of a single family home with an attached street front commercial
space. There are no remaining viable commercial structures located on the 1200
block of West Washington Street today. South Bend Heritage Foundation
purchased 1201 West Washington Street with the intent of returning the property
to its original single family use. To date, the attached commercial storefront has
been removed and today the property is being substantially restored to single
family use. When renovations are complete, the property will be sold to an
income eligible low and/or moderate income homebuyer.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City
of South Bend, Indiana as follows:
SECTION 1. Ordinance No. 9495-04, is amended, which ordinance is commonly
known as the Zoning Ordinance of the City of South Bend, Indiana, be and the
same hereby is amended in order that the zoning classification of the following
described real estate in the City of South Bend, St. Joseph County, State of
Indiana:
Lots Numbered Seven (7) and Eight (8) as shown on the recorded Plat of
Joseph Rockafeller's First Addition to the City of South Bend, St. Joseph County,
Indiana, excepting therefrom a strip of land Fifty (50) feet in width off of and from
the entire length of the West side of Lot Numbered Eight (8).
be and the same is hereby established as SF 2 (Single Family 2).
SECTION II. This ordinance shall be in full force and effect from and after
its passage by the Common Council, approval by the Mayor, and legal
publication.

We, the undersigned, make application to the Common Council of the City of South Bend,
Indiana to amend the zoning ordinance as herein requested.
1. The property sought to be rezoned is located at 1201 West Washington Street, South
Bend, Indiana, 46601.
2. The owner of the property is South Bend Heritage Foundation, located at 803
Lincolnway West, South Bend, Indiana, 46616, 574/289-1066.
3. There is no contingent purchaser at this time.
4. It is desired and requested that this property be rezoned from MU (Mixed Use) to SF
2 (Single Family 2).
5. This rezoning is requested to allow for the sale of the home once substantial
rehabilitation is complete to a qualified low and/or moderate income homebuyer.
6. Attached is a copy of: (a) the legal description of the property; (b) seventeen (17)
preliminary site plans; (c) a statement of purpose and intent; (d) a list of names and
addresses of all property owners and the tax key numbers for all properties within 300
feet of the petition property; and, (f) a location map, drawn to scale, including

STATEMENT OF PURPOSE AND INTENT
South Bend Heritage Foundation requests this rezoning of 1201 West Washington Street
from MU (Mixed Use) to SF 2. When the most recent revision of the zoning ordinance
was enacted, the existing MU designation was continued for this property as a youth
community center was meeting periodically in the commercial storefront attached to the
front of this single family home.
South Bend Heritage Foundation purchased this property last year with the intention of
substantially rehabilitating the property for sale to a qualified low and/or moderate
income family. The commercial storefront has been removed and the front wall of the
house rebuilt. It is anticipated that the construction work will be completed within the
next few months so that the home can be marketed.
In order to allow private mortgage financing to be obtained, the property must be
properly zoned. Therefore, South Bend Heritage Foundation is requesting that the
property be rezoned SF 2, the predominant single family zoning category in the Near
West Side neighborhood so that an additional family can become a homeowner in the
Near West Side neighborhood.

I hereby Certify that the above referenced ordinance of South Bend Heritage Foundation was legally
advertised on Thursday, March 9, 2006 and that the Area Plan Commission at its public hearing on
Tuesday, March 21, 2006 took the following action:
Upon a motion by Gary Gilot, being seconded by Roland Kelly and unanimously carried, the
proposed ordinance of South Bend Heritage Foundation to zone from "MU" Mixed Use to
"SF2" Single and Two Family Residential, property located at 1201 West Washington Street,
City of South Bend is sent to the Common Council with a favorable recommendation. The
rezoning is consistent with the Comprehensive Plan neighborhood policy. It is also
consistent with the West Washington-Chapin Plan (1991), which is to shift land use to single
family in order to strengthen the residential character of the neighborhood. The rezoning
would be an extension of the northern and southern "SF2" Single-Family Residential
Districts. It is compatible with the surrounding single family houses.
The deliberations of the Area Plan Commission and points considered in arriving at the above decision
are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a
part of this report.

Requested Action:
The petitioner is requesting a zone change from "MU" Mixed Use to "SF2" Single-Family
Residential to allow asingle-family home.
Land Uses and Zoning:
On site: On site is an existing single family home zoned "MU" Mixed Use
North: To the north is single family housing zoned "SF2" Single Family Residential.
East: To the east is The Patch Barbershop zoned "MU" Mixed Use.
South: To the south is single family housing zoned "SF2" Single Family Residential.
West: To the west is a vacant building zoned "MU" Mixed Use.
District uses and development standards:
The "SF2" Single Family Residential District is established to protect, promote and maintain the
development of single family dwellings and two family dwellings in the urban core of the City of
South Bend as well as to provide for limited public and institutional uses that are compatible with
an urban residential neighborhood.
Site plan description:
The corner lot is approximately 10,000 square feet. A site plan is not required for single-family
zoning.
Zoning and land use history & trends:
This site was previously zoned "B" Multifamily Residential district. The City Zoning Map,
-...a~,~ :.~ ...,.,,~,~ which_became effective on May 7, 2004, designated the site for."MU".Mixed Llse=siistrd~t.- _Oaz.:-,:.:,.;-.,._~ _.
November 28, 2005, the City Council denied the Catholic Workers located at 1126 West
Washington Street a rezoning from "SF2" Single-Family Residential to "MF1" Multifamily
(APC#: 2333-OS). In December 2005, a storefront located in the southwest corner of the lot was
removed.
Traffic and transportation considerations:
West Washington Avenue has two lanes. Elm Street has two lanes made of cobblestone. There
is an alley adjacent to the north property line.
Utilities:
Municipal water and sewer are available to this site.
5 Criteria (per IC 36-7-4-603):
1. Comprehensive Plan:
Policy Plan:
Goal 3: Strengthen the neighborhoods of the County and its municipalities.
Objective A: Promote the development and/or maintenance of community and
neighborhood character. Policy ii. Ensure that infill residential development in older

neighborhoods is consistent with the housing characteristics and physical fabric of the
existing neighborhood.
This rezoning is consistent with the Comprehensive Plan's neighborhood policy.
Land Use Plan:
The Land Use Plan does not recommend this area for a specific use.
Plan Implementation/Other Plans:
The West Washington-Chapin Development Plan (1991) recommends the lot for medium
density residential land use (APC#: 1410-91).
The rezoning is consistent with the plan, which is to shift land use to single family in order
to strengthen the residential character of the neighborhood. The proposed "SF2" Single-
FamilyDistrict will be more conforming with the plan than "MU" Mixed Use District.
Residential Area Policy:
2. Current conditions and character:
The existing single-family house is located in a neighborhood with single family houses,
apartments, and a local business.
3. Most desirable use:
The most desirable land use is for single family residential.
4. Conservation of property values:
Rezoning this property to "SF?" Single-Family Residential District should conserve the
surrounding residential property values.
5. Responsible development and growth:

Recommendation:
Based on information available prior to the public hearing the staff recommends that this petition

Analysis:
The rezoning is consistent with the Comprehensive Plan neighborhood policy. It is also

family in order to strengthen the residential character of the neighborhood. The rezoning would
