HomeMy WebLinkAbout07/07/10 Board of Public Safety Special MeetingSPECIAL MEETING JULY 7, 2010 54 The Board of Public Safety met in a Special Meeting at 8:18 a.m. on Monday, July 7, 2010, with Board President Juanita Demsey and Board Members Patrick Cottrell and Bruce BonDurant present. Board Members Laura Vasquez and Eddie Miller were absent. Board Attorney Thomas Bodnar was also present. The meeting was held in the Board of Public Works Meeting Room, 13`h Floor County City Building, South Bend, Indiana. FILING OF CHARGES - CHARGE — 2010 -03— DAVID SCHACKOW FACTUAL ALLEGATIONS In May and June 2010 David Schackow was a Captain in the South Bend Fire Department and was assigned as Captain of Engine 3 at Station 3 of the South Bend Fire Department. As part of his duties he was to complete by the end of his tour of duty each day Fire Incident Reports concerning every run in which the engine company was the first to arrive at the scene and enter them into the computer (handwritten reports when the computer reporting system is down). From May 9, 2010 through June 15, 2010 he failed to complete and enter any reports on the computer (or by hand if the computer was down) for each of the following runs made by Engine 3: DATE TIME ADDRESS 05/09/2010 14:51 1206 N. Patty Ln., South Bend, IN CHARGEI On May 9, 2010 at approximately 12:51 p.m. Engine 3 was dispatched to 1206 N. St. Louis Boulevard, South Bend, Indiana. David Schackow was the Captain on Engine 3, the first arriving company on the scene, but when his tour of duty day was completed he did not enter the necessary Fire Incident Report for the run. This failure to timely enter a report violated Rules 202.05 and 204.07 of the South Bend Fire Department Duty Manual and South Bend Fire Department Standard Operating Procedure 231.002. This was conduct unbecoming an Officer of the South Bend Fire Department and a violation of I.C. 36- 8- 3- 4(b)(2)(A),(B),(C) and (H). CHARGE H On May 11, 2010 at approximately 12:19 p.m. Engine 3 was dispatched to 2530 E. Edison Road, South Bend, Indiana. David Schackow was the Captain on Engine 3, the first arriving company on the scene, but when his tour of duty day was completed he did not enter the necessary Fire Incident Report for the run. This failure to timely enter a report violated Rules 202.05 and 204.07 of the South Bend Fire Department Duty Manual and South Bend Fire Department Standard Operating Procedure 231.002. This was conduct unbecoming an Officer of the South Bend Fire Department and a violation of I.C. 36- 8- 3- 4(b)(2)(A),(B),(C) and (H). CHARGEIH On May 27, 2010 at approximately 2:23 a.m. Engine 3 was dispatched to 1706 E. South Bend Avenue, South Bend, Indiana. David Schackow was the Captain on Engine 3, the first arriving company on the scene, but when his tour of duty day was completed he did not enter the necessary Fire Incident Report for the run. This failure to timely enter a report violated Rules 202.05 and 204.07 of the South Bend Fire Department Duty Manual and South Bend Fire Department Standard Operating Procedure 231.002. This was conduct unbecoming an Officer of the South Bend Fire Department and a violation of I.C. 36- 8- 3- 4(b)(2)(A),(B),(C) and (H). CHARGEIV On June 14, 2010 at approximately 2:44 p.m. Engine 3 was dispatched to 215 S. Coquillard Drive, South Bend, Indiana. David Schackow was the Captain on Engine 3, the first arriving company on the scene, but when his tour of duty day was completed he did not enter the necessary Fire Incident Report for the run. This failure to timely enter a report violated Rules 202.05 and 204.07 of the SPECIAL MEETIN G JULY 7, 2010 55 South Bend Fire Department Duty Manual and South Bend Fire Department Standard Operating Procedure 231.002. This was conduct unbecoming an Officer of the South Bend Fire Department and a violation of I.C. 36- 8- 34(b)(2)(A),(B),(C) and (H). CHARGE V On June 14, 2010 at approximately 7:02 p.m. Engine 3 was dispatched to 107 N. St. Louis Boulevard, South Bend, Indiana. David Schackow was the Captain on Engine 3, the first arriving company on the scene, but when his tour of duty day was completed he did not enter the necessary Fire Incident Report for the run. This failure to timely enter a report violated Rules 202.05 and 204.07 of the South Bend Fire Department Duty Manual and South Bend Fire Department Standard Operating Procedure 231.002. This was conduct unbecoming an Officer of the South Bend Fire Department and a violation of I.C. 36- 8- 34(b)(2)(A),(B),(C) and (H). CHARGE VI On June 14, 2010 at approximately 7:56 p.m. Engine 3 was dispatched to 3454 E. Douglas Road, South Bend, Indiana. David Schackow was the Captain on Engine 3, the first arriving company on the scene, but when his tour of duty day was completed he did not enter the necessary Fire Incident Report for the run. This failure to timely enter a report violated Rules 202.05 and 204.07 of the South Bend Fire Department Duty Manual and South Bend Fire Department Standard Operating Procedure 231.002. This was conduct unbecoming an Officer of the South Bend Fire Department and a violation of I.C. 36- 8- 34(b)(2)(A),(B),(C) and (H). CHARGE VII On June 14, 2010, at approximately 8:55 p.m. Engine 3 was dispatched to 1617 E. McKinley Avenue, South Bend, Indiana. David Schackow was the Captain on Engine 3, the first arriving company on the scene, but when his tour of duty day was completed he did not enter the necessary Fire Incident Report for the run. This failure to timely enter a report violated Rules 202.05 and 204.07 of the South Bend Fire Department Duty Manual and South Bend Fire Department Standard Operating Procedure 231.002. This was conduct unbecoming an Officer of the South Bend Fire Department and a violation of I.C. 36- 8- 3- 4(b)(2)(A),(B),(C) and (H). CHARGE VIII On June 14, 2010 at approximately 11:06 p.m. Engine 3 was dispatched to 956 N. Patty Lane, South Bend, Indiana. David Schackow was the Captain on Engine 3, the first arriving company on the scene, but when his tour of duty day was completed he did not enter the necessary Fire Incident Report for the run. This failure to timely enter a report violated Rules 202.05 and 204.07 of the South Bend Fire Department Duty Manual and South Bend Fire Department Standard Operating Procedure 231.002. This was conduct unbecoming an Officer of the South Bend Fire Department and a violation of I.C. 36- 8- 34(b)(2)(A),(B),(C) and (H). CHARGEIX On June 15, 2010 at approximately 12:54 a.m. Engine 3 was dispatched to 920 N. Patty Lane, South Bend, Indiana. David Schackow was the Captain on Engine 3, the first arriving company on the scene, but when his tour of duty day was completed he did not enter the necessary Fire Incident Report for the run. This failure to timely enter a report violated Rules 202.05 and 204.07 of the South Bend Fire Department Duty Manual and South Bend Fire Department Standard Operating Procedure 231.002. This was conduct unbecoming an Officer of the South Bend Fire Department and a violation of I.C. 36- 8- 34(b)(2)(A),(B),(C) and (H). RECOMMENDATION Due to Captain David Schackow not following a direct order in compliance with the Duty annual Section 300.03 Rules of Conduct, Fire Chief Howard Buchanon recommended that he be receive five (5) eight -hour day's (40 hours) suspension without pay equaling $697.20. The Chief also recommended the demotion to the rank of Engineer because Captain Schackow has not tried to rectify the situation. President Dempsey stated the Board would accept the charges for filing and instructed the Clerk to prepare a letter to serve the Charges on Captain David Schackow. Upon a motion made by Mr. BonDurant, seconded by Mr. Cottrell and carried, the charges were accepted and filed and Chief Buchanan's recommendation was approved. POLICE DEPARTMENT SPECIAL MEETING JULY 7, 2010 56 APPROVAL OF ADMINISTRATIVE LEAVE – CORPORAL ANTHONY SCOTT In a letter to the Board, Chief Boykins, Police Department, stated that Corporal Anthony Scott was arrested and charged with Domestic Battery (Misdemeanor), in Grandville, Michigan. Chief Boykins is requesting the Board, pursuant to IC 36 -8 -3 -4 (n), place Corporal Anthony Scott on Administrative Leave without pay effective July 7, 2010, until the disposition of the criminal charges in the trial court. Upon a motion made by Mr. Cottrell, seconded by Mr. BonDurant and carried, the Administrative Leave without pay was approved effective July 7, 2010. ADJOURNMENT There being no further business to come before the Board, Ms. Dempsey declared the meeting adjourned at 8:20 a.m. BOARD OF PUBLIC SAFETY Juanita Dempsey, President i Patrick D. Miller, Member ATTEST: EXECUTIVE SESSION JULY 7, 2010 The Board of Public Safety met in the Executive Session on Wednesday, July 7, 2009 at 3:30 p.m. The meeting was held in the Common Council Conference Room, 4`f' Floor, County City Building, South Bend, Indiana, for the purposes specified in I.C. 5- 14- 1.5 -6.1 (b) (6) (A) & (B).
