HomeMy WebLinkAbout06/23/10 Board of Public Safety MinutesPUBLIC AGENDA SESSION JUNE 23, 2010 48 The Board of Public Safety met in the Public Agenda Session at 8:03 a.m. on Wednesday, June 23, 2010 with President Juanita Dempsey, and Board Members Patrick D. Cottrell, Bruce BonDurant, Laura Vasquez, and Eddie Miller present. Also present were Police Chief Darryl Boykins, Fire Chief Howard Buchanon, and Board Attorney Thomas Bodnar. The meeting was held in the Board of Public Works Meeting Room, 13th Floor County City Building, South Bend, Indiana. Board members discussed the following items from that list: Resolution No. 41 -2010 — Commendation for Engineer Brandon May — Fire Department Fire Chief Howard Buchanon stated that Engineer May is an excellent swimmer and former member of the South Bend Fire Department River Rescue team, which helped him to jump in the river to rescue a citizen. Retirement — Police Department Chief Boykins informed the Board that Corporal Michael Carey is retiring to take another job. Monthly Statistical Analysis — Police Department Board Member Eddie Miller questioned Chief Boykin on the increase in residential burglaries. He asked if any progress was being made on catching kids involved in these neighborhood burglaries. Chief Boykins stated they need more help from the neighbors. This spike in break -ins is due in part to students out of school and without jobs. Burglary becomes a full -time occupation for them, and usually it is in their own neighborhoods. Vasquez, Member ATTEST: Eddie Miller, Member lidaYM± MinCle EXECUTIVE SESSION JUNE 23, 2010 The Board of Public Safety met in the Executive Session on Wednesday, June 23, 2010 at 8:20 a.m. The meeting was held in the Mayor's Conference Room, 14`h Floor, County City Building, South Bend, Indiana, for the purposes specified in I.C. 5- 14- 1.5 -6.1 (b) (2) (B) and (b) (6) (A). President Juanita Dempsey, and Board Members Patrick D. Cottrell, Bruce BonDurant, Laura Vasquez and Eddie Miller were present. Also present were Police Chief Darryl Boykins, Fire Chief Howard Buchanon, and Board Attorney Thomas Bodnar. Board members did not discuss any subject matter other than the subject matter as specified in the Public Notice. The meeting adjourned at 9:05 a.m. REGULAR MEETING ATTEST: Lifida M. Marti , Cler JUNE 23, 2010 49 BOARD OF PUBLIC SAFETY Juanita Dempsey, President Patrick .Cottrell, em er Bruce J. e�,Laura Vasquez, Member Eddie Miller, Membe REGULAR MEETING JUNE 23, 2010 The Board of Public Safety met in the regular meeting at 9:18 a.m. on Wednesday, June 23, 2010, with President Juanita Dempsey, and Board Members Patrick D. Cottrell, Bruce BonDurant, Laura Vasquez, and Eddie Miller present. Also present were Police Chief Darryl Boykins, Fire Chief Howard Buchanon and Board Attorney Thomas Bodnar. The meeting was held in the Board of Public Works Meeting Room, 13th Floor County City Building, South Bend, Indiana. APPROVE MINUTES OF PREVIOUS MEETINGS President Dempsey advised that if there were no objections by members of the Board, the minutes of the Public Agenda Session, Executive Session, and Regular meetings of the Board held on June 2, 2010, would be accepted with the noted change. There being no fisther discussion, the minutes were accepted. ADOPT RESOLUTION NO. 40 -2010 — A RESOLUTION OF THE BOARD OF PUBLIC SAFETY OF THE CITY OF SOUTH BEND INDIANA ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN ANNEXATION AREA IN CENTER TOWNSHIP (BERKHEISER ANNEXATION AREA Mr. Jeff Vitton, Community and Economic Development, presented the Board members with a map outlining the proposed annexation area. He noted the area is small, 115 of an acre, and includes only one home. The owners are requesting the annexation to hook up to City sewer and water. Mr. Vitton stated the Police and Fire Department services would not be increased or impacted. Mr. Vitton noted that they are incorporating income tax now for comparison of City and County levies and prorating based on the comparison results. He noted the rates were formally based solely on property taxes. President Dempsey requested for future annexation requests, the Board receive these comparisons to review and for their records. Upon a motion made by Mr. Cottrell, seconded by Mr. BonDurant and carried, the following Resolution was adopted by the Board of Public Works: REGULAR MEETING JUNE 23, 2010 50 RESOLUTION NO. 40-2010 A RESOLUTION OF THE BOARD OF PUBLIC SAFETY OF THE CITY OF SOUTH BEND, INDIANA, ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN ANNEXATION AREA IN CENTER TOWNSHIP (BERKHEISER ANNEXATION AREA) WHEREAS, there has been submitted to the Common Council of the City of South Bend, Indiana, an Ordinance and a petition by all (100 %) property owners which proposes the annexation of real estate located in Centre Township, St. Joseph County, Indiana, which is more particularly described at Page 13 of Exhibit "A" attached hereto; and WHEREAS, the territory proposed to be annexed encompasses approximately 0.2169 acres of land, which property is at least 12.5% contiguous to the current City limits, i.e., approximately 20% contiguous, generally located at the west side of S. Main Street just north of Pulling Street. It is anticipated that the annexation area will remain a single - family residence and utilize city water and sewer services... This use will require a basic level of municipal public services, including the provision of police and fire protection; and WHEREAS, the Board of Public Safety now desires to establish and adopt a fiscal plan and establish a definite policy showing: (1) the cost estimates ofpolice and fire protection to be furnished to the territory to be annexed; (2) the method (s) of financing those services; (3) the plan for the organization and extension of those services; (4) that those services will be provided to the annexed area within one (1) year after the effective date of the annexation, and that they will be provided in the same manner as those services are provided to areas within the corporate boundaries of the City of South Bend, regardless of similar topography, patterns of land use, or population density, and in a manner consistent with federal, state and local laws, procedures and planning criteria; and (5) the plan for hiring the employees of other governmental entities whose jobs will be eliminated by the proposed annexation. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC SAFETY OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. It is in the best interest of the City of South Bend and the area proposed to be annexed that the real property described more particularly at Page 13 of Exhibit "A" attached hereto be annexed to the City of South Bend. Section IL It shall be and hereby is now declared and established that it is the policy of the City of South Bend, by and through its Board of Public Safety, to furnish to said territory police and fire services within one (1) year of the effective date of annexation in a manner equivalent in standard and scope to similar services furnished by the City to other areas regardless of similar topography, patterns of land use, or population density and in a manner consistent with federal, state and local laws, procedures, and planning criteria. Section Ill. The Board of Public Safety shall and does hereby now establish and adopt the Fiscal Plan, attached hereto as Exhibit "A ", and made a part hereof, most particularly those provisions pertaining to police and fire protection at pages 5 and 7 of Exhibit "A ", for the furnishing of said services to the territory to be annexed. BonDurant, Member REGULAR MEETING s/Laura Vasquez, Member s/Eddie Miller, Member Attest: s /Linda Martin, Clerk FIRE DEPARTMENT JUNE 23, 2010 51 ADOPT RESOLUTION NO. 41-2010 — A RESOLUTION OF THE BOARD OF PUBLIC SAFETY OF THE CITY OF SOUTH BEND, INDIANA, COMMENDING ENGINEER BRANDON MAY Chief Howard Buchanon, Fire Department, read the following commendation and congratulated and thanked Engineer May for his outstanding rescue while off -duty. The Board joined Chief Buchanon in thanking and congratulating him. Engineer May stated he was in the right place at the right time, and it was due to the excellent training he has received in the South Bend Fire Department's River Rescue team that he was able to rescue the citizen from the river. He added he has since talked to the gentleman and he feels as though he was given a second chance in life and is grateful he was not successful in taking his own life. Chief Buchanon informed Engineer May that he submitted the commendation to the EMS Conference Committee to recommend him for award. Upon a motion made by Mr. Cottrell, seconded by Mr. BonDurant and carried, the following Resolution was adopted by the Board of Public Works: RESOLUTION NO. 41 -2010 COMMENDATION FOR ENGINEER BRANDON MAY WHEREAS, the Board of Public Safety wishes to issue commendations to individuals that perform meritorious service on behalf of the citizens of this community, and; WHEREAS, such service shall be recognized by the Board of Public Safety and appropriate commendation shall be presented to the individuals performing said meritorious service; NOW, THEREFORE, BE IT RESOLVED, that commendation be given to: Engineer Brandon May On June 1, 2010 at approximately 7:20 PM, Engineer Brandon May was on North Riverside Blvd. on his way home after a 50 mile bike ride when he noticed a male walking towards the riverbank, shortly disappearing over the edge of the riverbank and hearing a splash and a groan downstream. Brandon then rode his bike along the river edge attempting to sight the victim. With the help of some bystanders, he located the victim floating downstream approximately half way across the river. Without hesitation, he entered the cold, chilly, fast moving current and intercepted the victim without the aid a floatation device or thermal protection. After gaining control of the male and drifting under the Michigan St. Bridge, he swam the victim to shore where South Bend Fire Department personnel were able to assist Firefighter Brandon May and the victim out of the river. With the quick response from the bystanders and the efforts, courage and extensive training of Firefighter Brandon May the outcome of the event that day most certainly would have been tragic as the victim as not able to help himself. Be it further resolved that Firefighter Brandon May be commended and recognized for his quick actions, dedication, and professionalism. His actions reflect highly upon himself, the South Bend Fire Department, and the City of South Bend. ADOPTED this 23rd day of June, 2010. President Dempsey stated if there were no objections, the Board would accept the report for filing as presented. Chief Boyrs.ins noted that he has served the Department with loyalty and distinction during the last twenty (20) years. Chief Boykin joined the Board in thanking him for his commitment, dedication and years of distinguished service to the South Bend Police Department and the citizens of South Bend. Members also wished him a long and happy retirement. Upon a motion made by Ms. Vasquez, seconded by Mr. Miller and carried, the retirement was accepted and approved. FILING OF MONTHLY STATISTICAL ANALYSIS REPORT MAY 2010 President Dempsey indicated that unless there were questions or objections by members of the Board, the monthly statistical report for the month of April 2010 as submitted by the Police Department, would be accepted for filing. The report indicated the specialized training attended, the names of the officers who attended and the costs involved. There being no questions concerning this report, the Quarterly Report for Specialized Training as submitted was accepted and filed.
