PUBLIC AGENDA SESSION JUNE 24, .2..010 174 The Public Agenda Session of the Board of Public Works was convened at 10:35 a.m. on Thursday, June 24, 2010, by Board President Mr. Gary A. Gilot, with Board Members Donald E. Inks and Carl P. Littrell present. Also pxesent was Board Attorney Cheryl Greene. Board of Public Works Clerk, Linda M. Martin, presented the Board with a proposed agenda of items presented by the public and by City Staff. ADDITION TO THE AGENDA Mr. Gilot noted the addition to the agenda of a request to advertise for the Coveleski Housing Block and Demolition of Fred's Transmission and Clutch. AWARD PROPOSAL - COVELESKI STADIUM FIELD LIGHTING _ PROJECT NO. 110- 008D (SBCDA T'IF~ In a memo to the Board, Mr. Bill Schalliol, Community and Economic Development, advised that on June 14, 2010, proposals were received and opened for the above referred to project. Mr. Dave Rafinski, Wightrnan Petrie, informed the Board that there was a five (5) member panel to evaluate the above proposals. Based on the scoring matrix, it was unanimous that Musco Lighting scored the highest in all categories. Musco scared a total of 441 points, and Gaylor scared a total of 324 points. The matrix was based on cost, energy consumption, service and maintenance, warranty, and experience. Mr. Rafrnski noted that Musco submitted two proposals, and the panel voted to award the more expensive one due to better energy efficiency and tweniy- five year warranty versus a ten year warranty. He stated that in their proposal, Musco guaranteed their lighting would maintain minimum lighting requirement. The warranty, however, read that the lighting could drop or rise ten percent (10%} which is not acceptable to baseball standards. Mr. Rafinski required they send an addendum to their warranty that warrants the lighting will never drop below minimum baseball standards. Mr. Phil Custard, Purchasing, questioned what was to become of the old light poles once they were removed. Mr. Rafinski stated the wording of their agreement states that Musco will demo the existing poles and place them an a site of the City's choosing. Mr. Inks suggested they might be used in another park. After reviewing the proposals, Mr. Schalliol recommended that the Board award the contract to Musco Lighting, 100 ls` Avenue West, Oskaloosa, Iowa 52577, in the amount of $421,500.00, Therefore, Mr. Gilot made a motion that the recommendation be accepted and the proposal be awarded as outlined above. Mr. Inks seconded the motion, which carried. APPROVAL OF RECOMMENDATION TO ENCROACH ONTO PUBLIC RIGHT-OF-WAY - KRG, EDDY COMMONS, LLC Mr. Gilot advised that the Board is in receipt of a request from Kite Realty to build a permanent outdoor seating area at 1234 N. Eddy St., Ste. 125, Eddy Commons, South Bend, Indiana. The request received favorable recommendations from the Division of Engineering, Building Department, Community and Economic Development, and Downtown South Bend. Board Attorney, Cheryl Greene, noted the Board should have wording in the agreement addressing the possibility of a change of ownership and who will pay to have the encroachment removed if that becomes necessary, and the requirement that the encroachment is to stay as is, with no expansion. Mr. Inks noted there will be three parking spaces lost. Mr. Gilot stated that the light pole should stay where it is, but the applicant wi11 need to relocate the bike rack, trash receptacle, and trench drain. Mr. Gilot noted this potential business was requesting a view of the Notre Dame Campus and this was their solution. Mr. Inks added that Kite Realty, the owner of the property, will be paying for the construction costs. Mr. Gilot advised the Board is in receipt of favorable recommendations concerning this Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Solid Waste, Community & Economic Development and Engineering. Area Plan stated the vacation would not hinder the growth or orderly development of the unit or neighborhood in which it is located or to which it is contiguous. The vacation would not snake access to the lands of the aggrieved person by means of public way difficult or inconvenient. The vacation would not hinder the public's access to a church, school or other public building or place. The vacation would not hinder the use of a public right-of--way by the neighborhood in which it is located or to which it is contiguous. Mr. Phillip Griffin, NIPSCO, stated that there is an active gas line in the alley. The gas line feeds the South Bend Public Housing complex east of the alley. NIPSCO needs to maintain access to the 2-inch steel gas main for maintenance purpases and states no structure can be built on top of the gas line.
