HomeMy WebLinkAbout11/16/05 Board of Public Safety Minutes 1 1 PUBLIC AGENDA SESSION NOVEMBER 16, 2005 The Board of Public Safety met in the Public Agenda Session at 8:03 a.m. on Wednesday, November 16, 2005 with President Jesusa Rodriguez and Board Members Juanita Dempsey and Donald Alford present. Board Member Wesley Taylor was not present. Also present were Police Chief Thomas H. Fautz, Fire Chief Luther Taylor and Board Attorney Thomas Bodnar. The meeting was held in the Board of Public Works Meeting Room, 13"' Floor, County City Building, South Bend, Indiana. Board members discussed the following item(s) from that list. - Resolution No. 75-2005 -Vacation Schedule -Police Department Mr. Bodnar stated the vacation schedule remains the same as the previous year, and pertains to personnel working 5 days on and 2 days off, and 6 days on and 3 days off -Request for Leave of Absence -Police Department Mr. Bodnar stated this individual is requesting an unpaid leave of absence, with continued health benefits until the disability pension is determined. -Donations to Police Department Mr. Bodnar stated the donations made to the Police Department are for two presentations made by the Police Department. - Monthly Statistical Analysis -Police Department Chief Tom Fautz indicated larcenies and auto thefts have declined, while burglaries have risen. - Request for Promotion -Police Department Chief Fautz stated the promotion is for a patrolman serving three (3) satisfactory years. - Hearing Rescheduled -Charge OS-03 -Fire Department Mr. Bodnar stated the hearing is being rescheduled to accommodate the schedules of board members and attorneys. - Resolution No. 76-2005 -Holiday Schedule -Fire Department Mr. Bodnar stated this holiday schedule is for personnel working 4 or 5 work days, and those with an eight-hour assignment. - Monthly Statistical Analysis -Fire Department Chief Luther Taylor made a few changes to the report. Jacob, erk ~ .'a .1~ EXECUTIVE SESSION NOVEMBER 16, 2005 The-Board of Public Safety met in Executive Session on Wednesday, November 16, 2005, at 8:30 a.m. The meeting was held in the Mayor's Conference Room, 14"' Floor, County City Building, South Bend, Indiana, for the purposes specified in LC. 5-14-1.5-6.1 (b) (2) (B) and (b) (6) (A) and adjourned at 8:55 a.m. President Jesusa Rodriguez and Board Members Juanita Dempsey and Donald Alford were present. Board Member Wesley Taylor was not present. Also present were Police Chief Thomas H. Fautz, Fire Chief Luther Taylor and Board Attorney Thomas Bodnar. Taylor, Jr., Member anita Dempsey, Member NOVEMBER 16, 2005 The Board of Public Safety met in the regular meeting at 9:00 a.m. on Wednesday, November 16, 2005, with President Jesusa Rodriguez and Board Members Juanita Dempsey and Donald Alford present. Board Member Wesley B. Taylor was not present. Also present were Police Chief Thomas H. Fautz, Fire Chief L~rther Taylor and Board Attorney Thomas Bodnar. The meeting was held in the Board of Public Works Meeting Room, 13`h Floor, County City Building, South Bend, Indiana. APPROVE MINUTES OF PREVIOUS MEETINGS President Rodriguez advised that if there were no objections by members of the Board, the minutes of the Public Agenda Session, Executive Session, and Regular meetings of the Board held on October 26, 2005 would be accepted. POLICE DEPARTMENT ADOPT RESOLUTION NO. 75-2005 -HOLIDAY SCHEDULE Upon a motion made by Ms. Dempsey, seconded by Mr. Alford and carried, the following Resolution was adopted by the Board of Public Safety: RESOLUTION N0.75-2005 WHEREAS, the Board of Public Safety of the City of South Bend, Indiana, is empowered by law to establish rules and regulations for the S~utr. ~ :.rd Police Department; and 1 i WHEREAS, it is in the interest of the City of South Bend that the Police Department ,; ~~, .y holidays be set with certainty. REGULAR MEETING NOW, THEREFORE, BE IT RESOLVED by the Board of Public Safety of the City of South 1 i Bend: SECTION I. That for all sworn police officers who are assigned to work as their regular schedule, 5 on and 2 off, Monday through Friday, the following holidays shall apply: New Year's Day Good Friday Memorial Day Independence Day Labor Day Veteran's Day Thanksgiving Day Day after Thanksgiving Christmas Day Officer's Birthday Monday, January 2, 2006 Friday, April 14, 2006 Monday, May 29, 2006 Tuesday, July 4, 2006 Monday, September 4, 2006 Friday, November 10, 2006 Thursday, November 23, 2006 Friday, November 24, 2006 Monday, December 25, 2006 Floating SECTION II. That for all sworn police officers who are assigned to work as their regular work schedule, 6 days on and 3 days off, there shall be no paid holidays. The following dates are designated as Critical Duty Days: New Year's Day Independence Day Thanksgiving Day Christmas Eve Christmas Day New Year's Eve Sunday, January 1, 2006 Tuesday, July 4, 2006 Thursday, November 23, 2006 Sunday, December 24, 2006 Monday, December 25, 2006 Sunday, December 31, 2006 For purposes of the Critical Duty Day stipend, the Critical Duty Day shall start at 6:00 a.m., and last 24 hours. SECTION III. Officers assigned to the South Bend Community School Corporation shall, while so assigned, follow the holiday schedule set by the South Bend Community School Corporation for its clerical Employees. Officers so assigned shall be eligible for Critical Duty Day pay only if assigned to the Uniform Division and otherwise eligible. SECTION IV. To be eligible for a Critical Duty Day stipend, the Officer must either work the entire shift or have suffered an injury on the job which prevents working the entire shift. Any Officer who works recall on a Critical Duty Day, whether voluntary or required, shall receive in addition to overtime pay the normal Critical Duty Day stipend. Jacob, Clerk NOVEMBER 16 2005 BOARD OF PUBLIC SAFETY s/Jesusa Rodriguez, President s/Donald Alford, Member s/Juanita Dempsey, Member APPROVAL OF LEAVE OF ABSENCE -PATROLMAN BILLY PELLETIER Chief Thomas Fautz stated Patrolman Billy Pelletier has requested an unpaid leave of absence, starting December 15, 2005, with continued health benefits until his disability pension is determined. Chief Fautz stated that pursuant to. I.C. 36-8-8-12.3(d)(a), there is no suitable or available work in the South Bend Police Department for which Patrolman Billy Pelletier is or may be capable of becoming qualified, considering reasonable accommodation to the extent required by the Americans with Disabilities Act. Also noted was the fact that Officer Pelletier was shot in the line of duty on April 25, 2005. Upon a motion made by Mr. Alford, seconded by Ms. Dempsey and carried, the request was approved. :: y;'r, ,v .~ i. REGULAR MEETING NOVEMBER 16, 2005 ACCEPT DONATION TO SOUTH BEND POLICE DEPARTMENT Chief Fautz advised the board a generous donation of $40.00 was made to the South Bend Police Department K9 Unit by the South Bend Public Library. This money was donated to the K9 Unit for a demonstration that was done at the downtown library on November 9, 2005. There being no further discussion, the donation was accepted. ACCEPT DONATION TO SOUTH BEND POLICE DEPARTMENT Chief Fautz stated the Crime Prevention Unit has received a check from the Policeman's Credit Union in the amount of $150 in appreciation for a mock robbery presentation that was held on October 11, 2005. There being no further discussion, the donation was accepted. FILING OF MONTHLY STATISTICAL ANALYSIS REPORT -OCTOBER 2005 President Rodriguez indicated that unless there were questions or objections by members of the Board, the statistical report for the month of October 2005 as submitted by the Police Department, would be accepted for filing. He has successfully completed three (3) years of service with the South Bend Police Department. Upon a motion made by Mr. Alford, seconded by Ms. Dempsey and carried, the promotion was approved. FIRE DEPARTMENT RESCHEDULE HEARING -CHARGE OS-03 -JEREMY DOWNS President Rodriguez stated the hearing date has been rescheduled to December I, 2005, at 2:30 p.m. in the Council Chambers, 4"' Floor, County-City Building, South Bend, Indiana. ADOPT RESOLUTION NO. 76-2005 -HOLIDAY SCHEDULE Upon a motion made by Ms. Dempsey, seconded by Mr. Alford and carried, the following Resolution was adopted by the Board of Public Safety: RESOLUTION NO. 76-2005 WHEREAS, the Board of Public Safety of the City of South Bend, Indiana, is empowered by law to establish rules and regulations for the South Bend Fire Department; and WHEREAS, it is in the interest of the City of South Bend that the Fire Department holidays be set with certainty. NOW, THEREFORE, BE IT RESOLVED, by the Board of Public Safety of the City of South Bend: SECTION I. That all firefighters vvho work 24-hour shifts are not entitled to holidays off. For all firefighters who work 24-hour shifts, Critical Duty Days areas set forth in Article 25 of the Collective Bargaining Agreement for the year 2006 SECTION III.
