PUBLIC AGENDA SESSION OCTOBER 26, 2005 The Board of Public Safety met in the Public Agenda Session at 8:05 a.m. on Wednesday, October 26, 2005 with President Jesusa Rodriguez and Board Members Juanita Dempsey and Donald Alford present. Board Member Wesley Taylor was not present. Also present were Police Chief Thomas H. •~ Fautz, Fire Chief Luther Taylor and Board Attorney Thomas Bodnar. The meeting was held in the Board of Public Works Meeting Room, 13`" Floor, County City Building, South Bend, Indiana. ,Agenda Item Added: The following item was added to the agenda: - Statistical Monthly Analysis -September 2005 -Police Department Board members discussed the following item(s) from that list. - Minutes Board members reviewed the minutes and found no changes. - Promotions -Police Department Mr. Bodnar stated the eighteen (18) month Sergeant automatic agreement for promotions has been eliminated. The two (2) Sergeant promotions were still in the paperwork process; there will be approximately two (2) more promotions to come before the Board that are in this phase. - Employee(s) of the Month -Police Department Chief Fautz stated the "Employeeof the Month" information will be forwarded to Board of Safety in the future. - Donations to Police Department Chief Fautz stated donations have been given to the Police Department from Kroger, Granger Missionary Church, Mr. Ross Elias and Antique Motors, Inc. Chief Fautz thanked the community for the generous donations. Monthly Statistical Analysis September 2005 -Police Department Chief Fautz stated the Police Department has made a good impact on crime in the last few weeks. He also reminded Board members of meetings where Police officials discuss solutions in solving crime in the City. - Filing of Factual Allegations/Charges - OS-03 -Fire Department - ~ Mr. Bodnar stated this is a matter of accepting the document for filing, and the Clerk should serve the appropriate paperwork. A special meeting is tentatively set for a special meeting on November 4 at 8:15 a.m. to set a meeting for a hearing, if needed. - Monthly Statistical Analysis -September 2005 -Fire Department Chief Taylor mentioned that the format is now more presentable and easier to read. Taylor was not present. Also present were Police Chief Thomas H. Fautz, Fire Chief Luther Taylor and Board Attorney Thomas Bodnar. The meeting was held in the Board of Public Works Meeting Room, 13`x' Floor, County City Building, South Bend, Indiana. APPROVE MINUTES OF PREVIOUS MEETINGS President Rodriguez advised that if there were no objections by members of the Board, the mimites of the Public Agenda Session, Executive Session, Regular and Special meetings of the Board held on October 5 and October 7, 2005 would be accepted. POLICE DEPARTMENT ACCEPT AND APPROVE PROMOTION -JUAN LORA In a letter to the Board, Chief Thomas Fautz requested that Corporal Juan Lora be promoted from the rank of Corporal to the rank of Detective Sergeant in the Investigative Division, Metro Special Operations, effective November 13, 2005. Upon a motion made by Mr. Alford, seconded by Ms. Dempsey and carried, the promotion was accepted and approved. ACCEPT AND APPROVE PROMOTION -SUZY DIETER In a letter to the Board, Chief Thomas Fautz requested that Corporal Suzy Dieter be promoted from the rank of Corporal to the rank of Detective Sergeant in the Investigative Division, as a School Resource Officer, effective November 3, 2005. Upon a motion made by Ms. Dempsey, seconded by Mr. Alford and carried, the promotion was accepted and approved. 1 ACCEPT AND APPROVE PROMOTIONS ' - PHILLIP HERMAN - - ANTWAIN JOHNSON •In a letter to the Board, Chief Thomas Fautz requested that Patrolman Phillip Herman and Patrolman Antwain Johnson be promoted from the rank of Patrolman to the rank of Corporal effective October ~~lA ... - .. r`P4a'-' REGULAR MEETING OCTOBER 26, 2005 30, 2005. Both officers have successfully completed three (3) years of service with the South Bend Police Department. Upon a motion made by Mr. Alford, seconded by Ms. Dempsey and carried, the promotions were accepted and approved. RECOGNITION OF 2005 EMPLOYEE OF THE MONTH AWARDS In a letter to the Board, Chief Thomas Fautz recognized the Employees of the Month for 2005. The award recognizes officers, civilian employees and volunteers within the Police Department who have demonstrated actions noted by supervisors or citizens from both a professional law enforcement position and in support of community policing efforts with the citizens of the City of South Bend. There being no further discussion in this matter, the Employee of the Month Awards were accepted and filed. ACCEPT DONATIONS TO SOUTH BEND POLICE DEPARTMENT In a letter to the Board, Chief Thomas Fautz stated that an auction was held on behalf of the Safetyville Miniature Village. As a result, generous donations were made to the South Bend Police Department by Mr. Ross Elias in the amount of $3,600.00 and Antique Motors, Inc., in the amount of $200.00. In addition, the Granger Missionary Church and Kroger made donations of gifts and assorted items for children, including "Kinderprint" fingerprint cards, which will be distributed at health and safety fairs and in classrooms, as well as individual requests. There being no further discussion, the donations were accepted. DECISION ON PETITION -RONALD JOHNSON President Jesusa Rodriguez stated Mr. Ronald Johnson, by counsel, and pursuant to IC 36-8-3-4(n) requested the Board of Public Safety to award him back pay. The Board, having heard evidence, including the exhibits introduced by the parties and the arguments of Counsel. After due and considered deliberation, it is the unanimous decision of the Board of Safety that the petition of Officer Ronald Johnson for back pay be denied. FILING OF MONTHLY STATISTICAL ANALYSIS REPORT -SEPTEMBER 2005 President Rodriguez indicated that unless there were questions or objections by members of the Board, the statistical report for the month of September 2005 as submitted by the Police Department. would be accepted for filing. FACTUAL ALLEGATIONS On or about September 24, 2005, Jeremy Downs, a sworn firefighter on the South Bend Fire Department, altered the passwords in a computer program at the South Bend Fire Department with the intent to send e-mails while using the names of other firefighters. On said date, Engineer Downs sent e-mails with attachments to numerous other firefighters using the names of other firefighters, which was false reporting and brought other members of the department to ill repute. Chief Taylor recommends that Engineer Downs be suspended for twenty (20) 8 consecutive calendar days. CHARGE Said conduct violates I.C. 36-8-3-4(b)2(B) and (H), being conduct which was unbecoming a firefighter and in violation of Rules 30.00 (9) and (10) of the South Bend Fire Department Duty Manual and in violation of Rules 4.2; 4.3, 4.5 and 5.8 of the City of South bend Computer Policies. There being no further discussion, Charge OS-03 was accepted and filed, and the Clerk of the Board was instructed to serve the appropriate paperwork to Engineer Jeremy Downs. FILING OF MONTHLY STATISTICAL REPORT -SEPTEMBER 2005 Chief Luther Taylor submitted to the Board the monthly report for the month of September 2005 - -~- complied by the Prevention/Inspection Bureau of the Fire Department.
