EXECUTIVE SESSION
OCTOBER 7, 2005
The Board of Public Safety met in the Executive Session at 1:30 p.m. on Friday, October 7, 2005,
with Board President Jesusa Rodriguez with Board Members Juanita Dempsey, Wesley Taylor and
Donald L. Alford present. Also present were Police Chief Thomas H. Fautz and Board Attorney
Thomas Bodnar.
The meeting was held in the Mayor=s Conference Room, 14`h Floor, County City Building, South
Bend, Indiana, for the purposes specified in I.C. 5-14-1.5-6.1 (b) (2) (B) and (b) (6) (B) and
adjourned at 3:25 p.m.
SPECIAL MEETING OCTOBER 7, 2005
A special meeting of the Board of Public Safety was convened at 3:32 p.m. on Friday, October 7,
2005, by Board President Jesusa Rodriguez with Board Members Juanita Dempsey, Wesley Taylor
and Donald L. Alford present. Also present was Board Attorney Thomas Bodnar.
DECISION ON HEARING-NATHAN CANNON
President Rodriguez advised that this was the date set for the Board=s Public Hearing concerning the
matter of Corporal Nathan Cannon of the South Bend Police Department. President Rodriguez
acknowledged that the Board was not prepared to make a decision on the matter and asked that the
attorneys involved agree to a continuance at a later date to complete witness testimony. Mr. Thomas
Bodnar, the attorney for Chief Fautz, stated that he would like to resolve the issue, but if the
continuance was in the best interest of the case, he is in agreement. Mr. Jeffrey Kimmel, the attorney
for Nathan Cannon, stated that he did not want to continue the matter except for the purpose of
additional testimony. Both attorneys agreed on October 20, 2005, at 2:00 p.m. for the date and time
for an Executive Session, if that time is acceptable for Mr. Joseph Simeri, the attorney for the Board,
in this matter. Upon a motion made by Ms. Dempsey seconded by Mr. Alford and carried, the
continuance was accepted and approved.
DECISION ON HEARING -RONALD JOHNSON
President Rodriguez advised that the board would announce their decision on the above referred to
matter at the regular meeting on October 26, 2005.
ADJOURNMENT
There being no further business to come before the Board, President Rodriguez declared the meeting
adjourned at 3:37 p.m.
