Home My WebLink About06/02/10 Board of Public Safety Meeting MinutesPUBLIC AGENDA SESSION JUNE 2 2010 42 The Board of Public Safety met in the Public Agenda Session at 8:02 a.m. on Wednesday, June 2, 2010 with President Juanita Dempsey, and Board Members Patrick D. Cottrell, Laura Vasquez, and Eddie Miller present. Board Member Bruce BonDurant was absent. Also present were Police Chief Darryl Boykins, Fire Chief Howard Buchanon, and Board Attorney Thomas Bodnar. The meeting was held in the Common Council Chambers, 4f1' Floor, County City Building, South Bend, Indiana. Board members discussed the following items from that list. - Police Selection Panel Recommendation Chief of Police Darryl Boykins informed the Board that this is the first time they have had Korean and Japanese candidates sworn in on the Police force. He noted that three of the candidates come from the Indiana University Police Department and already graduated from the Police Academy. - Commendation — Pump Engineer John Jennings Fire Chief Howard Buchanon commended Engineer Jennings for his professional response and life saving actions while off -duty at a local golf course. He noted that Engineer Jennings had to shock the unconscious, pulseless victim twice and perform chest compressions to bring back his pulse. Chief Buchanon noted he did not even know about the actions of Engineer Jennings, nor did anyone else on the Fire Department until the Director of Golf informed those present at the South Bend Park Board Meeting. Chief Buchanon applauded Engineer Jennings for his modesty in not bragging about his heroics. - Agreement — Charge No. 2010 -02 Board Attorney Tom Bodnar stated after consulting with his attorney,. Captain Paul Chlebowski agreed to accept Chief Buchanon's recommended discipline. Mr. Bodnar informed the Board they still have the right to reject the recommendation and reset the hearing of Charge 2010 -02. He noted if they accept the Agreement as presented, he will draw up the Findings of Facts for approval at today's meeting also, ADJOURNMENT There being no further business to come before the Board, President Dempsey declared the meeting adjourned at 8:15 a.m. ......._..... Cottre , Member Eddie Miller, Member POLICE SELECTION PANEL JUNE 2, 2010 43 The Police Selection Panel met at 8:25 a.m. on Wednesday, June 2, 2010 in the Common Council Chambers, 4th Floor, County City Building, South Bend, Indiana, for the purpose of formulating a recommendation to be made to the Board of Public Safety. President Juanita Dempsey, Board Attorney Thomas Bodnar, and Police Chief Darryl Boykins were present. BonDurant, Member Vasquez, Member Eddie Miller, Mem EXECUTIVE SESSION MARCH 10, 2010 The Board of Public Safety met in the Executive Session on Wednesday, June 2, 2010 at 8:40 a.m. The meeting was held in the Mayor's Conference Room, 14th Floor, County City Building, South Bend, Indiana, for the purposes specified in I.C. 5- 14- 1.5 -6.1 (b) (2) (B) and (b) (6) (A). President Juanita Dempsey, and Board Members Patrick D. Cottrell, Laura Vasquez and Eddie Miller were present. Board Member Bruce BonDurant was absent. Also present were Police Chief Darryl Boykins, Fire Chief Howard Buchanon, and Board Attorney Thomas Bodnar. Board members did not discuss any subject matter other than the subject matter as specified in the Public Notice. Martin, Cler REGULAR MEETING JUNE 2, 2010 The Board of Public Safety met in the regular meeting at 9:15 a.m. on Wednesday, June 2, 2010, with President Juanita Dempsey, and Board Members Patrick D. Cottrell, Laura Vasquez, and Eddie Miller present. Board Member Bruce BonDurant was absent. Also present were Police Chief Darryl Boykins, Fire Chief Howard Buchanon and Board Attorney Thomas Bodnar. The meeting was held in the Common Council Chambers, 4th Floor, County -City Building, South Bend, Indiana. APPROVE MINUTES OF PREVIOUS MEETINGS President Dempsey advised that if there were no objections by members of the Board, the minutes of the Public Agenda Session, Executive Session, and Regular meetings of the Board held on May 12, 2010, would be accepted. There being no further discussion, the minutes were accepted. POLICE DEPARTMENT POLICE SELECTION PANEL Upon a motion by Mr. Miller, seconded by Ms. Vasquez and carried, the recommendation from Chief Darryl Boykins in his letter dated March 8, 2010 to hire six (6) police officers, was accepted and approved. Mr. Miller also made a motion to approve the names read by Chief Boykins of the new officers. Ms. Vasquez seconded the motion, which carried. SWEARING IN OF POLICE OFFICERS - MARANDA LEIGH BAKER - JOSEPH ANTHONY COLE - ERNESTO ALONZO RAMIREZ - DAVID JACOBSEN TROUT - THOMAS ADAM SHORT - ANTHONY DAVID DERTZ Chief Darryl Boykin recommended that the above named officers be accepted for employment on a probationary basis with the South Bend Police Department effective June 2, 2010. Chief Boykins noted they have met the requirements of the application process of the South Bend Police Department. He also noted that Maranda Baker, Joseph Cole, and David Trout all worked for the Indiana University Police Department where they already attended the academy and graduated as Indiana Certified Police Officers. After the Orientation period is over, they will begin their fourteen (14) week Field Training Officer Program at the South Bend Police Department. Mr. John Voorde, City Clerk, was present and administered the Oath of Office to the above listed individuals. The Board congratulated them and wished them well in their endeavors with the South Bend Police Department. APPROVE PROMOTIONS TO CORPORAL - ANTHONY DAWSON - RUFINO GAYTON - KELLY HIBBS - BLAKE PATURALSKI In a letter to the Board, Chief Boykins recommended that Patrolmen Anthony Dawson, Rufino Gayton, Kelly Hibbs, and Blake Paturalski be promoted to the rank of Corporal effective June 18, 2010. Chief Boykins stated in his letter that all of the officers have successfully completed three (3) REGULAR MEETING JUNE 2, 2010 45 years of service with the South Bend Police Department. Upon a motion made by Mr. Miller, seconded by Ms. Vasquez and carried, the recommended promotions were approved. APPROVE PERMANENT PROMOTION — ANTHONY ROSS In a letter to the Board, Chief Boykins recommended that Corporal Anthony Ross be promoted permanently to the rank of Sergeant effective June 10, 2010. Chief Boykins stated in his letter that Corporal Ross was placed in a special assignment as a Sergeant in the Uniform Division, 3rd Detail, on June 10, 2009. His supervisor, Captain Jeff Rynearson, made an evaluation of the progress of Corporal Ross, and recommended permanent promotion based on his progress. Upon a motion made by Mr. Miller, seconded by Ms. Vasquez and carried, the recommended permanent promotion was approved. FIRE DEPARTMENT APPROVE PROMOTION LIST - Grant Baker - Jared Pearish - Jason Kratzer - Joshua Richhart - Shawn Kuminecz - Brandon Roark - Jason Mappes - Joshua Schoenthaler - Anthony Marvel - Troy Williamson In a letter to the Board, Chief Buchanon recommended the above listed individuals be approved for the list of candidates eligible for promotion from the rank of Firefighter I" Class to the rank of Engineer, effective May 24, 2010. Chief Buchanon noted that the list is in compliance with the 1994 Salary Ordinance which states that the rank of Engineer is a promotable rank. Upon a motion made by Mr. Cottrell, seconded by Ms. Vasquez and carried, the above list of candidates eligible for promotion to Engineer was accepted and approved. ADOPT RESOLUTION NO. 35 -2010 — COMMENDATION FOR PUMP ENGINEER JOHN JENNINGS The Board of Safety recognized Pump Engineer John Jennings for life - saving procedures he applied while off -duty, that saved the life of a man at Elbel Golf Course. The Board noted that it was due to the quick response, dedication, and professionalism on the part of Pump Engineer Jennings that the man's heart rhythm was restored. Chief Buchanon applauded his actions and modesty about them. He noted that Engineer Jennings is a nineteen year veteran of the Fire Department, and j ust happened to be in the right place at the right time, and responded correctly to the situation. Upon a motion by Mr. Cottrell, seconded by Ms. Vasquez and carried, the following Resolution was approved by the Board of Public Safety: RESOLUTION NO. 35-2010 COMMENDATION FOR PUMP ENGINEER JOHN JENNINGS WHEREAS, the Board of Public Safety wishes to issue commendations to individuals that perform meritorious service on behalf of the citizens of this community, and; WHEREAS, such service shall be recognized by the Board of Public Safety and appropriate commendation shall be presented to the individuals performing said meritorious service; NOW, THEREFORE, BE IT RESOLVED, that commendation be given to: Pump Engineer John Jennings On April 14, 2010 at approximately 4:30 PM, Pump Engineer John Jennings had just finished a round of golf while off-duty at Elbel Golf Course. An individual entered the club house, grabbed the AED out of the cabinet on the wall, and asked if anyone knew how to use it. Jennings asked what was going on and was told that someone had just gone down on #11 tee box; he identified himself as a South Bend Firefighter and accompanied the man to #I I on a golf cart. As they arrived at the tee, a man was performing chest compressions and another doing REGULAR MEETING JUNE 2, 2010 46 mouth to mouth ventilations on an unconscious, pulseless patient. Jennings assessed the patient and determined that he was indeed pulseless. He applied the pads from the AED and analyzed the patient's heart rhythm. Once it was determined that the patient had a shockable rhythm, he shocked the patient. Realizing the patient still had no pulse, Jennings began CPR. After two minutes of CPR, Jennings analyzed the heart rhythm again and determined that the patient was in a shockable rhythm. Again, he shocked the patient with the AED. Jennings felt for a pulse again. He felt that the patient had a faint pulse at this time, but lost it within seconds and began to perform chest compressions. The crew from Medic 11 arrived while Jennings was performing CPR and used their cardiac monitor to determine the patient's cardiac rhythm. They determined that he had a heart rate of 20 and had a pulse. Jennings assisted ventilating the patient with the ambulance crew's bag - valve -mask while they started an IV and addressed the patient's other needs. At that point, the patient's heart rate jumped up to 80 beats per minute and he was transported to Memorial Hospital. By the time the patient arrived at Memorial, he was beginning to regain consciousness. After undergoing several procedures at Memorial, the gentleman was discharged from the hospital. Quick response from bystanders and the efforts of Pump Engineer John Jennings were directly responsible for saving this man's life. Be it further resolved that John Jennings be commended and recognized for his quick actions, dedication, and professionalism. His actions reflect highly upon himself, the South Bend Fire Department, and the City of South Bend. ADOPTED this 2 °d day of June, 2010. Martin, Clerk ACKNOWLEDGE REQUEST FOR DISABILITY PENSION In a letter to the Board, Chief Buchanan stated the Local Board of the South Bend Firefighters Pension Board met on May 21, 2010, to review Lieutenant Allen Price's request for Disability Pension. The Board agreed with Lieutenant Price's physician that his impairment was favorable and approved his disability request. The Board also determined that his disability should be classified as "Class II Impairment" in light of the Physician's determination that his condition is in part caused by his employment as a firefighter. The Board further determined that the illness was not self-inflicted, pre - existing, or resulting from an accidental injury. President Dempsey stated the Notice of Request for Disability Pension would be accepted for filing as presented. APPROVE AGREEMENT — CHARGE NO. 2010 -02 Board Attorney Thomas Bodnar presented an Agreement signed by Mr. Thomas Lewis, III, Attorney for Captain Paul Chlebowski. In the agreement, Captain Chlebowski agrees to withdraw his Request for a Hearing of Charge No. 2010 -02, and accept the recommended discipline of Chief Howard Buchanon. The Agreement states if the Board votes to impose punishment that exceeds the recommendation of the Chief, Captain Chlebowski is entitled to a Hearing. Upon a motion by Mr. Cottrell, seconded by Ms. Vasquez and carried, the agreement stating the Board approve the Chief s recommended discipline of five (5) eight (8) hour days suspension without pay and a demotion to the rank of Engineer, was approved. APPROVE FINDINGS OF FACT — CHARGE NO. 2010 -02 — PAUL CHLEBOWSKI The Board found that for his actions, Captain Paul Chlebowski shall be demoted to the rank of Engineer and suspended without pay for five (5) eight (8) hour days. Upon a motion by Mr. Cottrell, REGULAR MEETING JUNE 2, 2010 47 seconded by Ms. Vasquez and carried, the Findings of Fact were approved.
