Al "Buddy" Kirsits, Chairperson, Zoning and Annexation Committee called the meeting
to order at 4:13 p.m.

*John Byorni presents 3rd revision:
John Byorni, Executive Director of the Area Plan Commission, was given the opportunity
by Chairperson Kirsits to present the latest version of the APC's proposed changes for
Planned Unit Developments. More specifically the changes would revise criteria for
changes and time limits to obtain approval. The main sticking point in recent Council
proposal reviews seems to be in whether a developer would be granted an extension of 2
years from-the current three for changes to the preliminary plan. The Council's concerns
are about maintaining timely progression of a project as well as the type of changes.
Councilmember Rouse said he recognized the effect of the weak economy has had on
proposed projects. However he expressed concern over the deleterious impact a delayed
or suspended projects can become safety hazards, altogether having a negative effect on
nearby properties. Byorni suggested that it would be difficult to hold a developer to a
specific timetable. However, he said the Council would keep control over any changes to
the preliminary plan.
Councilmember Rouse along with Councilmember White stressed the importance of
Council involvement in the crafting process. They suggested a special meeting with all
affected parties at the table to craft provisions which would not discourage developers;
yet would require them to be respectful and responsible.
Along those same lines Chairperson Kirsits cautioned that if increased flexibility is
allowed developers will have an increased responsibility to the city. Chairperson Kirsits
used the Mihalache proposed multi-family development on Northside which he now says
looks awful. Chairperson Kirsits said he felt betrayed by Mr. Mihalache. This outcome
emphasizes the importance of the Council maintaining oversight of projects. While rules
and restrictions placed on developers have to allow flexibility; the developers needs to
make a commitment not to abandon a project resulting in an eyesore. This is what has
happened in the Mihalache case according to Kirsits and represents a breach of trust.
There being no further business to come before the Committee at this time. Chairperson
Kirsits adjourned the meeting at 4:30 p.m.
