C ZONING AND ANNEXATION COMMITTEE MAY 10, 2010
Al "Buddy" Kirsits, Chairperson, Zoning and Annexation Committee called the meeting
to order at 4:00 p.m.

Bill No. 15-10 Rezoning 521 Eclipse
This bill rezones 6.19 acres of the western end of Kennedy Park to allow the construction
of the City's proposed animal shelter.
Called upon by Chairperson Kirsits, Derek Spier explained the rezoning request noting
the Area Plan Commission forwarded the bill with a favorable recommendation. There
was no remonstrance at the Area Plan Commission hearing.
Mike Danch then gave the formal presentation. He used a site plan as a reference point.
The plan is attached.
Two citizens spoke in favor of the rezoning Valerie Schey and Tony Trinca both spoke of
the desperate need for a new facility. No one spoke opposed.
Councilmember Puzzello motioned to send favorably to Council. Derek Dieter seconded
and all affirmed.
Bill No. 16-10 Rezoning the NE corner of Mayflower and Cleveland
The site is 43.33 acres going from agricultural use to mixed retail and senior residential.
Chairperson Kirsits allowed Christa Nayder of the Area Plan Commission to describe the
Planned Unit Development. She noted the bill was sent to the Council without
recommendation for failure to receive a majority vote either way of APC members
present at the hearing.
Mike Danch representing the developer outlined the proposal using both an aerial and site
plan (see attachment)
Bill Schalliol from the City's Economic Development Department spoke in favor.
John Schalliol, Director of the Airport Authority spoke against. His opposition centered
on possible future complaints of take off and landing noise from the proposed senior
residential facility to be located near a flight path albeit one used for only 5% of the air
traffic.
Councilmember Varner motioned for a favorable recommendation. Councilmember
LaFountain followed with a second and all approved.
Bill No. 10-20 Special Exception 6879 Enterprise Drive
This bill would allow a gymnastics studio in an existing light industrial area.
Mark Lyons of the Building Department reported the unanimous favorable
recommendation of the Board of Zoning Appeals.
Paul °Phair representing Holladay Corp., the developer made a brief presentation noting
the proposal complemented the Hurwich Farms master development plan.
Councilmember Varner motioned favorably. Oliver Davis seconded. All approved.
Bill No. 10-21 Special exception for 1019-1021 N. St. Peter
Chairperson Kirsits stated a letter from the petitioner was received requesting the
petitioner was received requesting the petition be withdrawn from consideration. Full
Council would take such action at the regular meeting.
There being no other business Chairperson Kirsits adjourned the meeting at 4:42 p.m.
