Home My WebLink About03/09/05 Board of Public Safety Minutes~C,F~ :Re PUBLIC AGENDA SESSION MARCH 9, 2005 The Board of Public Safety met in the Public Agenda Session at 8:05 a.m. on Wednesday, February 16, 2005 with President Jesusa Rodriguez with Board Members Wesley Taylor and Donald Alford present. Board Member Elmer: Carr was not present. Also present were Police Chief Thomas H. Fautz, Fire Chief Luther Tailor and Board Attorney Thomas Bodnar. The meeting was held in the Board of Public Works Meeting Room, 13`" Floor, County City Chief Fautz invited the Board to attend a Safety Committee Training Session scheduled for March 16, 2005, at 3:30 p.m. at the Police Department. This training schedule was set for the Common Council, in order for them to better understand what the Police Department does. - Charge OS-02 -Fire Department , Mr. Bodnar stated the Board should accept and file the Charges as submitted, and the Board will need to set a meeting to set the hearing date. - Retirements -Fire Department Chief Taylor stated there are two (2) retirements in good standing. - Monthly Statistics -Fire Department Chief Taylor stated the statistics are for the month of January 2005. The original statistics submitted were incorrect. Building, South Bend, Indiana. - Minutes Mr. Bodnar stated the minutes had been reviewed and there were no changes. - Retirements -Police Department Mr. Bodnar stated there was nothing unusual about the retirement; the Board should acknowledge and approve them. - F.O.P. Grievance Mr. Bodnar stated he left a message on March 8, 2005 for the F.O.P. President regarding the Grievance. Chief Fautz mentioned that the F.O.P. President was not working on that date. The Grievance concerns the matter of whether an injury to a Police Office was considered on duty or not. The Grievance was submitted on March 3, 2005. Chief Fautz stated that the Officer did not realize his attendance at the Board meeting was needed. More discussions will follow after the Board has ample time to review the Grievance. Mr. Bodnar suggested the Board accept and file the Grievance, and continue it to the next meeting. - Demotion -Police Department Mr. Bodnar stated there a certain circumstances regarding the Officer's request for a demotion. Chief Fautz stated there were no positions within his position for working hours during the day, and the Officer wished to be demoted in order to work daytime hours. In addition, several officers throughout the past year have done this. ' -Monthly Statistics -Police Department Chief Fautz stated there were no homicides during February 2005, and the crime rate has gone down. Alford, Me er i ~ i ~4:y REGULAR MEETING MARCH 9.2005 APPROVE MINUTES OF PREVIOUS MEETINGS President Rodriguez advised that if there were no objections by members of the Board, the minutes of the Public Agenda Session, Executive Session, and Regular meetings of the Board held on February 16, 2005 would be accepted. There were no objections by members and the minutes were accepted. POLICE DEPARTMENT APPROVAL OF REQUEST FOR RETIREMENT -JIM HASSIG In a letter to the Board, Police Chief Thomas Fautz submitted the Application for Retirement for Division Chief James Hassig, and recommended approval. Chief Hassig is retiring in good standing from the Police Department, effective March 18, 2005. He was with the Department for twenty (20 years, five (5) months and nine (9) days. The Board wished him well in his new endeavor, and thanked him for his many years of service with the South Bend Police Department. Upon a motion made by Mr. Alford, seconded by Mr. Taylor and seconded, the Request for Retirement was approved. APPROVAL OF REQUEST FOR RETIREMENT -JOSEPH MARKOVICH In a letter to the Board, Police Chief Thomas Fautz submitted the Application for Retirement for Captain Joseph Markovich, and recommended approval. Captain Markovich is retiring in good standing from the Police Department, effective February 21, 2005. He was with the Department for thirty-nine (39) years, ten (10) months and sixteen (16) days. The Board wished him well in his new endeavor, and thanked him for his many years of service with the South Bend Police Department. Upon a motion made by Mr. Alford, seconded by Mr. Taylor and seconded, the Request for Retirement was approved. ACCEPT AND FILE F.O.P. GRIEVANCE - CORPORALMICHAEL INGLE A Grievance was submitted by F.O.P. President Scot Ruszkowski on behalf of Corporal Michael Ingle. The Board set a special meeting for March 16, 2005 at 2:30 p.m. to set the hearing in this matter. Upon a motion made by Mr. Alford, seconded by Mr. Taylor and carried, the Grievance was accepted and filed. ACCEPT AND APPROVE REQUEST FOR DEMOTION -SERGEANT JOHN CIESIOLKA In a letter to the Board, Police Chief Thomas Fautz requested the Board to honor a request for demotion to Corporal, for Sergeant John Ciesiolka. He has requested this demotion to Corporal for personal reasons. Upon a motion made by Mr. Alford, seconded by Mr. Taylor and carried, the request for demotion was approved. FILING OF MONTHLY STATISTICAL ANALYSIS REPORT -FEBRUARY 2005 President Rodriguez indicated that unless there were questions or objections by members of the Board, the statistical report for the month of February 2005, as submitted by the Police Department, would be accepted for filing. FACTUAL ALLEGATIONS ' Engineer Gale Evans was a member of the South Bend Fire Department during 2004. On the 3rd day of December, 2004, at the Osco Pharmacy at 4401 West Western Avenue, South Bend, Indiana, Engineer Evans acquired possession of a controlled substance, Vicodin, by presenting a prescription slip which was not authorized by the doctor listed on the prescription. On March 2, 2005, the St. Joseph Superior Courtin Cause No. 71 D02-0412-FD-01228, State of Indiana v. Gale Evans, found Gale Evans guilty of acquiring possession of a controlled substance by fraud, deception, or forgery, a Class D felony, a case which arose out of the December 3, 2004 incident. On or about June 29, 2004 at the CVS Pharmacy at 50660 U.S. 31 North, Engineer Evans acquired possession of a controlled substance, Delaudio, a legend drug without a valid prescription. On March 2, 2005, the St. Joseph Superior Court in Cause No. 71D03-0501-FD-00043, State ofIndiana vs. Gale Evans, found Gale Evans guilty of possession of a legend drug, a Class D felony, which arose out of the June 29, 2004 incident. COUNT I. The conviction of Engineer Gale Evans in Cause No. 71D02-0412-FD-01228 is a violation of I.C. 36-8-3-4(b)(1). COUNT II. The conviction of Engineer Gale Evans in Cause No. 71D03-0501-FD-00043, St. Joseph Superior Court, is a violation of I.C. 36-8-3-4(b)(1). , Chief Taylor recommends that Engineer Gale Evans be discharged from the South Bend Fire department in accordance with I.C. 36-8-3-4. Upon a motion made by Mr. Taylor, seconded by Mr. Alford and carried, Charge OS-02 was accepted and filed, and the Board Clerk was asked to forward the appropriate paperwork to Engineering Gale Evans. Mr. Bodnar presented the paperwork to Mr. Evans, who was present at the meeting. ACCEPT AND APPROVE RETIREMENT -CHIEF ROBERT X. OUINN President Rodriguez advised that Chief Luther Taylor has submitted to the Board the Application and Declaration for Retirement for Chief Robert X. Quinn, effective March 2, 2005. Chief Taylor noted that Mr. Quinn has served the Department with loyalty and distinction during the last thirty-four (34) years and nine (9) months. Chief Taylor joined the Board in thanking him for his commitment, dedication and years of distinguished service to the South Bend and the citizens of South Bend. Members also wished him a long and happy retirement. Upon a motion made by Mr. Taylor, seconded by Mr. Alford and carried, the retirement was accepted and approved. ACCEPT AND APPROVE RETIREMENT -ENGINEER RONALD WISNIEWSKI President Rodriguez advised that Chief Luther Taylor has submitted to the Board the Application and Declaration for Retirement for Engineer Ronald Wisniewski, effective March 3, 2005. Chief Taylor ' noted that Mr. Quinn has served the Department with loyalty and distinction during the last thirty- five (35) years. Chief Taylor joined the Board in thanking him for his commitment, dedication and years of distinguished service to the South Bend and the citizens of South Bend. Members also wished him a long and happy retirement. Upon a motion made by Mr. Taylor, seconded by Mr. Alford and carried, the retirement was accepted and approved.
