Passed by the Common Council of the City of South Bend, Indiana April 26, 2010 Attest: Attest: City Clerk President of Common Council Presented by me to the Mayor of the Ciry of South Bend, Indiana April 27, 20 10 E Approved and signed by me April 2 7 , JOHN City Clerk 20 10 .~,., ~z ~ ~ ~~ Maynr ORDINANCE NO. ~ Obt Z t ~ AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND TO TRANSFER ALONZO WATSON PARK FROM THE BOARD OF PARK COMMISSIONERS TO THE CIVIL CITY OF SOUTH BEND STATEMENT OF PURPOSE AND INTENT The City of South Bend desires to facilitate the development of a comprehensive community center supported in part by the Iocal community, and where children and families would be exposed to different people, activities and arts that would otherwise be unavailable, and provide certain non- secularprograms and activities which the City believes will be of benefit to the City and its citizens ("Ray and Joan Kroc Corps Community Center"). In order to accomplish this, the property known as Alonzo Watson Park is needed for this project. Upon a motion at its meeting of April 19, 2010, the South Bend Board of Park Commissioners, recommended that Alonzo Watson Park, as described in Exhibit "A" attached hereto and incorporated herein, be transferred to the Civil City of South Bend. The Common Council, under Ind. Code § 36-10-4-18 has the authority to transfer park land. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND as follows: Section 1. Alonzo Watson Park as described in Exhibit "A" attached hereto and incorporated herein, be transferred to the Civil City of South Bend. for its own use including potential conveyance to third parties in accordance with Indiana statutes. Section 2. Pursuant to Ind. Code § 36-10-4-18, the proceeds from the sale of the land described in Exhibit "A", if any, shall be credited pro rata to the Park Department, and the proceeds shall be expended for the improvement of the remaining park land or for purchase of other land for park purposes. Section 3. This Ordinance transfers ownership of Alonzo Watson Park to the Civil City of South Bend in order to facilitate the completion of the Ray and Joan Kroc Corps Community Center. It is anticipated that at its meeting of Apri119, 2010, the South Bend Board of Park Commissioners will recommend that Alonzo Watson Park be transferred to the Civil City of South Bend. Final Council action on this bill approving that measure could then take place at its regularly scheduled meeting on April 26, 2010. I will make the presentation of the Ordinance to the Council.
