This was due to the fact that the National Football Foundation had recently announced its termination of the agreement between South Bend and the Hall of Fame expiring on December 31, 2010. The City Engineering Department has recently determined that certain expenditures and repairs of a capital nature are necessary to maintain the facility's mechanical parts in good working order, which costs are the responsibility of South Bend as set forth in the Second Interim Agreement between the City of South Bend and the National Football Foundation dated July 21, 2006. NO~'V, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA as follows: SECTION I. The sum of $71,000.00 is hereby appropriated from and set aside within College Football Hall of Fame Capital Fund (#677) for purposes of repairs and other expenditures of a capital nature necessary to maintain the Hall of Fame Building and its mechanical components in good working order. SECTION II. ZIENTARA CONTROLLER April 5, 2010 Mr. Derek Dieter President, South Bend Common Council 41'' Floor, County-City Building South Bend, IN 46601 Re: Ordinance Appropriating $71,000.00 from College Football Hall of Fame Capital Fund (#677) for Capital Expenditures Dear President Dieter: As you know, when the South Bend Common Council approved and adopted the 2010 budget for City operations, no funding was included for repairs, maintenance or capital replacement of City assets in the College Football Hall of Fame building. This was the result of a joint recommendation between the Council and City due to the fact that the National Football Foundation had recently announced its termination of the agreement between South Bend and the Hall of Fame with an expiration date of December 31, 2010. Recently, the City Engineering Department has determined that repairs and expenditures of a capital nature are necessary to maintain certain mechanical components of the Hall of Fame facility in good working order. A detailed description of the recommended repairs and replacements in the College Football Hall of Fame building is attached to this letter for the Council's information. South Bend is responsible for these costs per the definitions within the Second Interim Agreement between the City of South Bend and the National Football Foundation dated July 21, 2006. Both Public Works Director Gary Gilot and I will be available to present this ordinance to the Common Council at its Committee meeting and at the public hearing.
