PUBLIC WORKS AND PROPERTY VACATION COMMITTEE
Chairperson David Varner, called the Public Works and Property Vacation Committee
meeting to order at 3:50 p.m.

Agenda: Bill No. 07-10 -Vacate Allen's alley
Bill No. 17-10 -Vacate Portion of Laurel Street
Bill NO. 12-10 -Vacate Alley at Dunbar Corner
Bill No. 07-10 -Vacate Allen's alley
This bill would vacate a five foot wide strip of Allen's Alley from Michigan Street west
for 165 feet to Woodward Court. This action was deemed necessary to facilitate the
completion of the multi-million dollar American Place project Phase I. Prior
consideration had been continued to allow for an amicable resolution of access, parking,
and outdoor dining issues raised by an adjacent property owner. With these agreements
agreed upon as described by Brad Toothaker, the petitioner, he asked for favorable
disposition. Council questions revealed while agreements had been arrived at, the final
wording had not been signed by all parties. Council Attorney Kathleen Cekanski-Farrand
suggested any Council action be subject to these verbal agreements. Gary Gilot, Director
of Public Works, added that a new 10 foot wide sidewalk along the pedestrian scale
lighting would be part of the project. The cost would be covered from the Downtown
TIF.
Understandings reached, Councilmember LaFountain moved to send this bill to the
Council with a favorable recommendation. Councilmember Rouse seconded and all
affirmed.
Bill No. 17-10 -Vacate Portion of Laurel Street
Chairperson Varner allowed Terry Lang of Lang-Feeney and Associates to make the
presentation. Mr. Lang advised that they were working with the Troyer Group who were
representing the Salvation Army in developing plans for the Kroc Center. Mr. Lang said
the vacation allowed for additional Kroc Center parking.
Councilmember White asked if the South Bend Housing Authority (SBHA) staff or
nearby SBHA residents were party to the vacation discussions. Mr. Lang and Gary Gilot,
Director of Public Works said while no special meeting had been scheduled all were
aware of the proposal and no remonstrance had been heard. Hearing this
Councilmember's Rouse and LaFountain moved and seconded a favorable
recommendation. All supported.
Bill No. 12-10 -Vacate alley at Dunbar Corner
Chairperson Varner informed the Council a request to continue indefinitely had been
field by the petitioner South Bend Heritage. Councilmember Rouse moved and
Councilmember LaFountain seconded. All supported the request.
There being no further business to come before the committee at this time, Chairperson
Varner adjourned the meeting at 4:14 p.m.
