STATEMENT OF PURPOSE AND INTENT The intent is to rezone the proposed land from several districts to a Planned Unit Development for construction and operation of a community center and assembly space for religious use, with required vehicle parking. Several variances and special exceptions would be required for the development to be located in the current multiple districts, or in any other single district. Community Center uses includes gymnasium, performance auditorium for religious gatherings, swimming pool, and classrooms. Outdoor uses include on and off-site parking and potential playground.. Land Uses and Zoning: On site: Parcel A (Phase I) is Oliver Park. Parcel B (Phase II) is vacant. North: To the north across Western Avenue is vacant land zoned CB Community Business District. East: To the east, across Chapin Street, is multi-family housing zoned MF2 High- Density Multifamily District. To the northeast is a multi-tenant commercial center, zoned CB Community Business District. South: To the south are railroad tracks (unzoned} with an industrial park zoned GI General Industrial District south of the tracks. West To the west, across Laurel Street, are apartments zoned MF 1 Urban Corridor Multifamily District. To the northwest is a billboard, the Elks Club and a church zoned MU Mixed Use District. District uses and development standards: The Planned Unit Development (PUD) District is designed and intended to: encourage creativity and innovation in the design of developments; provide for more efficient use of land; permit special consideration of property with outstanding natural or topographical features; facilitate use of the most appropriate construction techniques in the development of land; and, provide for any individual land use not otherwise specified elsewhere in this Ordinance. The PUD District encourages imaginative uses of open space, promotes high standards in design and construction, and furthers the purposes of the Comprehensive Plan. Site plan description: The site plan shows a 72,310 square foot community center building covering 16% of the site. Open space, which include athletic fields and a playground comprises 205,083 square feet or 46% of the site. There are 254 parking spaces on-site, and an additional 51 parking spaces across Western Avenue. These paved areas cover 39% of the site. The perimeter, foundation, and interior off-street area landscaping as presented is similar to the City of South Bend landscaping requirements. Zouing and land use history & trends: In 1966, both sides of Chapin were rezoned multifamily for housing (APC# 36-66). City of South Bend Board of Public Works, et al #2544-10 Page 1 of I Traffic and transportation considerations: There is a traffic signal at the intersection of Western and Chapin. Westem and Chapin have four lanes with right and left turn lanes. Laurel has two lanes. The cul-de-sac at the south end of Laurel will need to be vacated. There will be access from Laurel Street and Chapin Street. The Chapin Street access will be a right-in, right-out only. Additional information: (Agency comments) ' The Engineering Division has coordinated with the developer`s engineer to create the drainage and access plan. There is no objection to this preliminary site plan. The Staff recommends that the size and height of the entry sign on Laurei be reduced. As shown, the sign is 6 feet tall and has an area of 8 square feet. The Staff recommends the sign conform to the standards of the higher intensity commercial and industrial districts, where the maximum height is 4 feet and the maximum square footage is 6 feet. 5 Criteria (per IC 36-7-4603): 1. Comprehensive Plan: Policy Plan: City Plan South Bend Comprehensive Plan November 2006 LU 2: Encourage a compatible mix of land uses in the community. LU3.2 Encourage pedestrian-oriented, mixed-use development in the CBD. Land Use Plan: The Future Land Use Plan designates this area as parks and open space. Plan Implementation/Other Plans: Western Avenue Commercial Corridor Revitalization Action Plan, June 1999 The intersection of Western and Chapin already has some shopping and should be further developed as a gateway. However, the azea between Walnut Street and Chapin Street contains many vacant or underutilized commercial buildings, vacant lots, and various small businesses. A Vision Plan for the Commercial Corridor of: The Western Avenue of South Bend, Indiana. Februa The Community Feedback Report noted that organized activities/sports for young people would add quality of life to Western Avenue. - 2. Current conditions and character: This area has residential in the two multi-family developments bordering the project area, plus the single family neighborhood to the north of Western. Also in the neighborhood is a retail center and a church. The proposed use will replace anunder-utilized pazk. 3. Most desirable use: The most desirable use would benefit the surrounding neighborhoods by replacing an under- utilized pazk with organized recreational activities. 4. Conservation of property values: It is the staffs opinion that nearby property values should not be adversely affected. 5. Responsible development and growth: The site is currently developed as a park. This community center has the potential to increase the attraction of the area as a commercial and recreational destination. City of South Bend Board of Public Works, et al #2544-10 Page2of2 Recommendation: Based on information available prior to the public hearing, the staff recommends that the petition be sent to the Common Council with a favorable recommendation subject to the entry sign on Laurel Street being reduced to a height of 4 feet and 6 square feet in area. Analysis: The development will not only be an asset to the immediate neighborhood, but to the City of South Bend by increasing the attraction of the area as a recreational and commercial destination.
