TO THE BOARD OF PUBLIC WORKS OF THE - CITY OF SOUTH BEND, INDIANA. ` The undersigned hereby y proposes to furnish electric service for lighting that portion of Michigan Street in said City lying betwe Ohio Street&net Broaway, in accordance with the plans and specifioa- tions therefor heretofore adopted by Board of Public Works, at the prices per annum for each lamp lighted as follows: For furnishing, lighting and maintaining each of said 6000 Lumen Incandescent Lamps, Iron post, Grp-gan Senior Opalescent unit, or equivalent unit. Per 'unit per annum. 1 4 V.00 The undersigned agrees hereby to execute the contraot.in the fora heretofore adopted by said Board of Public works within ten days from the date of the awarding `of the contract to it. Contraot, Plans and Specifications. for Lighting that portion of South Michigan Street of said City ofSouth "Bendy lying between Ohio Street and Broaway. This agreement, made and entered into thls 22nd, day of July 19259 between the City of South Bend, a municipal corporation of hhe State of Indiana, by and through its Board of Public 'Works, party of the first part hereinafter referred to as the city, and Indiana & Michigan,. Elep,r.ie Compeer,_ party of the second part hereinafter refers to as the Contractor, pursuant to a resolution of the Board of Public Works, passed at a meeting held on the 22yid day of July 1925. That the parties hereto, each in consideration # the agreements on the party of the other, herein contained, have mutually agreed and hereby mutually agree as follows:.. 1. Tie Contractor shall provide and maintain a street lighting syl tem in the City of South Bend, Indiana, sonsist,ing of fifteen street le lamps supplied from the underground distribution system of the Contractor. Such underground lamps shall be as follows:- 15- 6000 Lumen Incandescent Lamps, Iron Post, Egyptian Senior Opalescent unit 4r equivalent unit. All property used in the performance of this contract shalt %W and remain the property of the Contractor. The Contractor shall at its cost furnish all tamp renewals and light all lamps herein provided for by electricity .for a period of nine years and four months from and after the lst day of September, 1925 at noun. All of the lamps which shah, be provided nand maintained by this Contractor shall be operated so that they=-will"gl" 'the maximum amount of illumination obtainabld under wommeraid conditions. 2. All Lamps hereln prori�ted for shall be burned from one-half hour after sunset until one-half hour before sunrise every night and all night burning, approximately four thousand (49000) o hours per annum .. The number of Lamps furnished and lighted under this contract shall be the number provided for in paragraph 1 hereof. and shall be located as shown on h the blur print attached hereto and indentified icy the signatures of the Consta ote► and members of the Board of Public Works. ` 4. All outages shall be reported Ally in writing by the proper officers of the City -to the ContractoR and the propof `bffieers of the City may deduct from th total monthly amount which would have been 'paid for any lamp so reported had no outage ocaured,,the_sum bearing the ratio to snag total as the period of outage bears to the total time the lamp would have been lighted in any month. 5. Street lighting units herein contracted for shall be staved by the Contractr to such now location as the City may by writing direot, subject to.-- the following conditions:- ` Such moving of lamps shall be completed within thirty (30) days after receipt by Contraotor.of written notice from the City, Sunday's, legal holidays and stormy days not to be counted., provided that the number of such removals shell not exceed one per day, and provided further that subh removals may not be required on Sunday's legaL holidays and stormy days, Notice that the work of such removal of lamps has been anpleted shall We given by the contractor to the City within ( ten (10.)_.days after the completion of the work. The actual cost, to the Contractor of making sung relocations shall be paid by the City to the ConAractor within thirty (30) days after said notice had been given. 6. The City shall.aecept such lamps and the services herein specified durig the life of this contract and pay as full compensation therefor at the rate and p price set out in the accepted bit, to -wit: For underground stree T lighting units. 6000 Lumen Incandescent Lamps, Iron Post Egyptian Senior Opalescent unit or equivalent unit. per unit per annum. 70.OD is Payment for all lighting services to be made in equal monthly instollmen ts, each installment; to be due and payable on or before the 20th., of each math .succeeding that in which the service is rendered. 7• The Contractor shall have the right with the consent of the Board of Public Works of the City, at aby time during the life of this contract to install, operate and maintain in the place of the lamps herein provided for, and under the same terms and conditions, otheras and more improved lamps in keeping with 'such advancement as may be made in the art of lighting, which lamps shall be of equivalent or greater illuminating power. S. In authorizing or granting a permit to any person, firm or corporation to repair or out into any ztreet, alley, or sidewalk in which said street light ing units and lines and eabhes supplying current thereto are located, the City shall require, as a aciidition to the granting of such permit, an agreement on the part of the dpplicent that sueLa lines and cables and street lighting units will not be interfered with in any manner without notice to the Contractor. 9. All the covenants, expressins, terms, conditions, provisions and agree- ments herein shall extend to and be binding upon, or inure to the benefit of is the case may be, each and every -one of the successors or assigns of each of the parties hereto as if in every case so expressed, 10. This contract shall be inforee and effect from and after itss approval by ordinance for a period of nine (9) gears and four N) months from and after th the 126tday of September, 1925, at noon. The following Assessment Rolls confirmed. Hearing had on assessment roll and final estimate for the pavement on Thity-First street From Mishawaka Ave, to the Grand Trunk R. R-. under Improvement Resolution -No. 1464 in the City of South Bend, Indiana. In -the -above matter no remonstrators appeared and no written remon-strance The Board,:therefore find that the property assessed in said roll filed is benefited in the amount as shown on said roll, and the Board further find, that the assessment roll filedJuly 15th., 1()25 and the final estimate allowed July 22nd 1925 should be and the same are hereby in all things ratified and confirmed and approved. -gearing had - on -assessment► roll and f1knal estimate for . the Pavement on Thirtieth Street from Mishawaka Ave. to the Grand Trunk R. R. Co, under Improvement Resolution No. 1463 in the City of South Bend, Indiana. In the above matter no remonstr&ieors appeared and no written remonstrance filed. The Board therefore find that the property assessed in said roll filed july 15th.9 1925 is benefited in the amount on said roll, and the Bard further find, that the assessment roll filed July 15th., 1925 and the final estimate allowed July 22nd., 1925 should be and the same are hereby in all things ratified, confirmed and approved.
