Street Commissioner ordered to •round off corners of intersection of Ford and Walnut Streets under plans toabe made by the City Engineer. New Hyzdrant ordered at the. corner of Fassnacht Avenue and Brookfield Street. Mayor Seebirt, Philip Bondurant, Ed Neddo and Frank J, Anderson met with the Board and discussed the assessment Of benefits and awards of damages on the Opening of William Street. Meeting adjourned fvvm office'of the Board to the Gemon Council Chambers in the City Hall at 7:30 P.M. This being the date set for deferred hearing on roll of awards of damages and assessments of benefits for the opening of a street from Colfax Avenue to Lincoln Way Pest and from Marion Street to Navarre Street, ( known as William Street) under Condemnation Resolution No, 83. In the above matter a number of property owners appeared,who had signed written remonstrances and a written remonstrance was filed by R. Isenberg*r of 515 Sharron Ct.Atty. John Hibberd signed agreement for a thirty per cent reduction in benefits. Atty Bertsch representing Mrs. Mary Meyers agreed to tkke this matter tp,with Mrs. Meyers and report later. Atty. Frank Gilmer representing Mrs. Dora J. Staples took up and discussed written remonstrance but no agreement signed. Atty. A. E. Martin representing Messrs. Mentaras and Csalle disonased written remon- stranoe but ho agreement signed. Trustees of St. Pauls Evang. Church on Le Salle Avenue appeared and remonstrated verbally against a.$600.00 benefits but no written remonstrance was filed. Appraisers Ed Neddo Philip Bondurant and Frank J. Anderson present. After hearing all interested parties present.hearing deferred until Wednesday May 27th., 1925 at 7:15 P.M., Clerk instructed to notify different parties who had written remonstrances on.file to appear at various time set on Friday May 22nd.11925. at meeting to be held in the office of the Board. • Hearing had on roll of awards of •damages and assessments of bene- fits in the matter of the Opening of Colfax Avenue from Eddy Street to Sunnyside Avenue under Condemnation Resolution No. 88. -In the above smatter no remons, trators appeared and 'no written remonstrance was filed..,_ The Board find tYiat after hewing all interested parties separately anal severally confirm and sustain each assessment of benefit and each award of damages as heretofore made in said procee4ings; The Board further oonfirm and sustain each and every award of dame ges and every assessment of benefits heretof made and said proceedings akC all action under Condemnation Resolution No. 88 is here concluded. Before the Board of public Works of the City of South Bend, Indiana. In the matter of Condemnation Resolution No. 83 for the opening of a street between Colfax Avenue and La Salle Avenue and Lincoln Way West from Marion.St. to Navarre Street, known and W611iam Street. ° The undersigned having heretofore filed remonstrance agafns� assessments of benefits against the prope ty as shown by said assessment roll hereby agrees that if there is a reduction of 30 per -cent made in said assessmet by the Board of Public Works, that they will withdraw their remonstrance against .said assessments and will pay said reducee assessment. The following report made by the City Engineer. Board of Public Works South Bend, Indiana. Gentlemen: -y We have checked the attached petitions relative to the type of pavement to be used in paving South Michigan Street from a point 230' south of Bronson Street to Broadway, and find that a majority of the resident free- holders have petitioned for sheet asphalt. Respatfully sul5mitted; ° FREDERICK �� ANDERSON City Engineer. Concerning the improvement of the roadway of Michigan Street from a point 280 feet south of Bronson Street; to north curb line of Broadway in pursuance to Resolution No. 1451 the petition of freeholders residiAg on said street is monsidered, and the report of -the City Engineer is receivo' and all evidence is heard, and the Board of Public Works finds that said petitioners constitute a majority in number of the freeholders residing upon said street:to to improved, and that.said petition is,sufficent and it is therefore cronsiderad and adjwMed that said improvement be made with Sheet, asphal"L the kind of pave- ment requested In -said petition; and the City Engineer reports that Rieth-Riley Company is -the lowest afidbest bidders for said pavement, and the Board -, *so, finds, and letsthe consiraot for said improvement to him, and orders said im- prvvement ko be made with Sheet asphalt using Mexican asphalt and all proceeding heretofore had in this matter are hereby confirmed and ratffied. Concerning the improvement of the roadway of Altgeldt Ave. from Mibmi,Street to Marine .Street with asphalt, asphaltic oonorete, bitlithic aonorete,or,briek, in pursuance to Resolution No: this being -the date set for the making of the preliminary ardor designating the kind of pavement the Boards - at 1000 A.M. Tuesday May 19th.0 1925 publicly ordered read and considered all bids and then Continured thiir meeting to Wednesday May 2Oth., 1925 at 7:15 P.M. Now on last named date.the Board designated Sheet asphalt as the kind of.pavement with which said street is to be improved with and fiexes the 2nd.,day of June 1925 at 10:00 A.M. as the time when the petitions for changing the kind of pavement,muss, be filed, and the Board hereby continues trhis, mutternt1 ,the 3rd. day of June 1925 at 17O:O0 A.M. on the day above named the Board will either pass on petitions let said contract or reject all bids c 661 Wednesday May 2Oth.., 1915. Hardy Abseht. i This being the date set for hearing various remonstrances filed against the amount of benefits and damages on OPening of Street known as William St. Atty-6 Sotntmers appeared with Lorenz Lederer and amount of damages on property owned by LedereT discussed but no agreement signed. AUye. A. E. Marlin and Avty Bibberd appeared with client a property owner on proposed William Street and discussed remonstrance but no agreement signed. J. S. McCowan and Mrs. McCowan appeared and discussed remonstrance but no agreement signed . Atty. G. A. Elliott with Mrs. Helene Lamport, Iden S. Romig., representing Mrs. Florence Miller, Atty Bertsch representing Mrs. Merry Meyer, signed the following form of agreement. Before the Board of Public Works of the City of South Bend, Ind. In the matter of Condemnation Resolutioh No. 83 for the Opening of a street from Colfax Avenue send La Salle Avenue and Lincoln Way West and from Marion Street to Navarre Street known_.as William Street. The undersigned, having heretofore filed remonstrance against assessments 6 benefits against the property as shown by said assessment roll hereby agrees that if there is a reduction of 30 per cent made in said assessment by -the Board of Public Works, that they will withdraw their remonstrance against said assessments and will pay said reduced assessment. That if said reduction is not made by said Board, said remonstrance will not be affected in any way by this agreement. ( See files for copies of agreements filed by above mentioned parties. Bondurant and. Frank J. Anderson present. Attys. Woodson Carlisle, Samuel Parker A. G. Graham appeared in regard to remonstseances filed for clients and Woodson Carlisle signed a -30per cent reduction in maria Studebaker8s assessment of benefits. Richard Elbel signed a 30 per cent reduction and the terror in calnulation to be corrected, and the benefits assessed to be $550.00 instead of $650.00 A. G. Graham and Samuel Parker and Woodsan Carlisle agreed to discuss this 30 per cent reduction in assessments of benefits with Clients and return agreements if signed.
