Contract for pavement on Thirty Fourth Street awarded as follows:.
Concerning the improvement of the roadway of Thirty Fourth Street from
Mishawaka Avenue toG. T. W. Ry. Company right of way with asphalt, asphaltic. concrete
bituluthic, concrete or briek,"in pursuance *,o Resolution No. 1448 this Board finds
that no petition has been filed with said Board by a majority in nu ber of the freehold
residing on said street tote improved, requesting that Jdm it be improved with a differ-
entkind of pavement than'the kind heretofore adopted by the Board in its preliminary
order; amd the City Engineer reports that H, W. Reed & Sons Constr. Co, is the lowest
and best bidder for the kind of pavement heretofore adopted by the Board, and the board
find that the H. W. Reed & Sons Constr. Co. is the lowest and best, bidder and hereby
lets the contract for said.improvement to them and orders that said improvement be
n ` a with concrete and all proceedings heretofore had in this matter are hereby confirmd

and Meade Street all in Lincoln Manor Addition as provided in improvement, Resolution
No. 1491 adopted May 5th., 1925 signed and construction bond attaehed.thereto in the
sum of $11,562.00 with the Fidelity and Deposit Company 8f Maryland as sureties,

The following easement was approved by the Board.

The Wells Mfg. Company give' , grahts, bargains, sells and conveys
to, the City of South Bend, Indiana, its successors and -assigns, forever, as
easement for public utilities designated by the City to maintain electric wires
on poles above the ground, or in conduiV through the ground in, over, under,
through and above the following described real estate in Creed's 2nd. Addition
to the City of South Bend, St, Joseph County, State of Inndianta, which real estate
was f'o serly part of the alley west of Main Street from a point seven (7') feet
south of the 'south dine of lot.I1 Creed's 2nd. Addition, to the north line of lot
8 Creed's 2nd. Addition, said real estate being more particularly described as
follows: -
Beginning at a point seven (7') south of the southwest corner of
lot 11 in Creed's 2nd. Addition, thence north to the northwest corner of lot 8
in-Creed's 2nd. Addition,., thence west a distanee'of fourteen (14) feet, to the
west dine of the alley west of Main Street; thence south a distance of one hundred
and forty four (144) feet to the south line of the 2nd. alley south of Indiana
Avenue, thence east to the place of beginning.
It is further agreed t,hatzhhould the City of South Bend itself
at any time desire to avail itself of the right to lay conduits or erect aline t6
of poles as hereinbefore provided, on the land aforesaid or should it grant to
any public utility the righ.V to do so, the Wells Mfg. Company, its successors -or
assigns may,in lieu thereof designate a right of way therefore four (.(4') feet
wide on and along the east half of said alley if such use of the said west half
thereof would seriously interfere with the use of any tracks or other structures
which may upon said west half, ptovided further, that if and when any such change
is directed by said Wells Mfg. Company, its successors, or assigns, its involves
the movement or re -location of any conduits, poles, or wires or other such pro-
perty -placed on -the west four feet of said alley.under this easement then this
change shall be at the sole expense of the Wells Mfg. Company.
This easement is granted in consideration of the vacation of the
City. of South Bend, Indiana, of the'whole of the 2nd. alley'south of Indiana.
Avenue from Main Street to the west line of the alley west of Main Street ;
also the alley west of Main Street from the -south line of lot, 11 Creed's 2nd.
Addition, to the north line of lot 8 Creed's 2nd. Addition, in the City of
South Bend, Indiana.

IN WITNESS WHEREOF, the Wells Mfg. Company has caused this indentue
to be subscribed by Its President, and the Secretary, and the seal of the Cor-
poration to be hereunto affixed by the Secretary this ninth day of May 1925.

said Company., and that they signed their respective names thereto, the said
Elmer E. Wells as President and E. Glenmore Wells Secretary, by the like order;
and they severally acknowledged the exeou�ion thereof to be their Free act and de
deed, and the free act of said Wells Mfg. Company, for the purpose therein ex-
