water connections an Lincoln Way East Deem. Washington Avenue to $ample Street,
under Improvement Resolution No. 1417.

In the above matter remonstrators appeared but no written
remonstrance was filed, The Board therefore find that the property assessed in
said roll filed January 6th., 1925 is benefitted in the amounts as shown on said
roll, and the Board further find, that the assessment roil filed January 6th,
1925 and the final estimate allowed January 6th., 1925 should be and the same are
hereby in all things ratified, confirmed and approved and controller requested
to with -hold 0100.00 from contractor until it has been shown that the number of
taps on Loss 1,293, & 4 Louis Nichols Addition (Herman J. Greening) and Lot 3
in Frantz's Add. in name of Alex H.,Hildebrand as shown on assessment roll were
actually put in.
Policy on Cemetery Office ordered renewed and allowed to
Alexis Coquillard with corrections as shown on policy and with asphalt roof.
Petition filed for are lamp,on Division Street from Chapin
Street to Scott,Street referred to pcltn and wire inspector for report.
The City Engineer submitted the list of property owners in the
matter of the appropriation of certain property under Condemnation Resolution
No. 90 for the Widening of Webster Street from Indiana Avenue to First alley Norh
North of Indiana Avenue, in the City of South Bend, Indiana,, as per resolution
adopted October 29th., 1924. Which list includes the names of the owners and
holders of property and its interest therein sought to be taken or beneficially
or injuriously affected, and the description of the several pieces of property
which is affected by the said appropriation proceedings.
Thereupon the Board proceeded to award the damages sustained
and to assess the benefits accruing to each piece of property upon said list,
It was thereupon, Upon motion duly made an4 seconded and un-
animously adopted, resolved that said list, together with the amounts of benefits
and damages and net benefits and det damages therein set; forth as to the several
parcels of land be adopted and that the respective amount of benefits contained
in said list be and are hereby assessed against the several tracts of land as
ed.-
specifically set forth in said list, and that the respective amounts of damages
contained in the said list be and are hereby awarded to the several tracts of lend as
specifically sat forth in said list, and that net benefits or net damages, as the
case may be as to, -the respective tracts of land, contained in said list are hereby
awarded or assessed, as the case may be as to the said several tracts of land.
T The Board hereby further sets off the benefits and damages each against
the other where both benefits and damages are assessedm against the same piece
property, tract of land or interests, and hereby fixes the said respective net bene-
fits as the amount that shall be paid by the respective owners as benefits, and further
hereby fixes the respective net damages as to the several tracts as the amount that
shall be paid to the owners of the respective tracts as damages.
Thereupon, upon motiondm4eand seconded and unanimously adopted the
11th. day of February 1925 at 7:15 P.M. was fixed as the day on which this Board will
receive or hear remonstrances from persons with regard to the amount of their re-
spective awards of a,ssessmentav, and the Clerk of this Board Was instructed to prepare
and cause to be duly and legally given, notices to the owners of each parcel of property,
showing the amount of the assessments or awards, with a description of the property
affected, and the date of said hearing.

RESOLUTION REQUIRING THE FILING OF PLANS, SPECIFICATIONS AND
:ESTIMATES UNDER MODIFIED GRADE SEPARATION RESOLUTION
No. 4.
WHEREAS on the 9th. day of January 1925 modified Resolution No. 4
providing for the separation of grades of the New York Central Rai3Road Company by
the elevation of the same over.certain streets in said resolution named, was duly and
legally adopted and confirmed by the Board of Public Works of the City of South Bend,
Indiana, and
WHEREAS, said resolution as so adopted and confirmed was submitted
to the Common Council.of the City of South Bend, Indiana for its action thereon and was
by Ordinance No. 2452 duly confirmed and approved by said Common Council of the
26th. day of January 1925, THEREFORE,
BE IT RESOLVED, by the Board of Public Works of said City that In
pursuance to Section 2 of an Act of the General Assembly of the State of Indiana,
approved March ist., 1923, being Chapter 36 of the Aols of 1923, the New York Central
Railroad Company be and they are hereby ordered to prepare or caused to be prepared
and filed within sixty (60) days after notice as provided by`saud act, complete plans
and specifications, the same to be in particular covering all work required by scud
resolution to be done except pavement,, sidewalks, drainage and approaches.
All other Steam Railroad Companies having tracks connecting with or
intersecting the tracks of the New York Central Railroad Company and which said
tracks will have to.be changed on, ever or under certain streets if such companies
shall desire to maintain such onnection or intersecting tracks shall likewise file plans
and specifications in the office of such Board of any changes necessary in. their
tracks resulting dfrom said improvement.;
Be it further resolved, that the Board of Public Works does hereby
order plans and specifications to be prepared by the City Engineer for the Board of
Public Works and filed in the office of said' Board for any and all work required to be
done in connection with such improvement for pavement, sidewalk, drainage and approaches
and such work as shall be required on that part of the streets the grade of which is
changed by such improvement. In all -cases where the street or highway is to be
carried over the railroad track or tracks, the plans and speeific6tion for approaches
shall inloude the work required to be done up to the abutments supporting the super-
structure, but shall not include the abutments, and in ail.cases where the street or
highway is to be carried under the railroad track or tracks, the plans and specification
for approaches. shall only inleude the work required to be done outside of the right of
way of the railroads affected.

At the same time that such plans and specifications .are filed
by any of such railroad companies or by the Board of Public Works, such
companies and such board shall also file with the said Board, an itemized
estimate of the complete cost of the work specified in the plans and speci-
fications so filed by it of them.
Be it Further resolved, that the Chicago, South Bend & Northern
IndianctRailway Company be and the same is hereby notified to file such plans
and specifications in partioularig as are necessary to comply with the
requirements of the above mentioned aet.
All of 6ki.d plans and speficiations and all estimates shall be
plated on file in the office of the Board of Public Works within Sixty (60)
days after notice of the adoption, of this resolution.
Notice of the adoption of this resolution is hereby ordered
to be served personally on all Railroad Companies and all interurban and
Street Railway Companies affected by said prIeposed improvement under modified
track separation Resolution No, 4.

Notice is hereby given that
Whereas, an the 9th. day of January, 1925, the 'Board 'of
Public Works of the City of South Bend, Indiana duly and legally adopted
modified Grade Separation Resolution No. 4 , for the separation of grades
of certain streets in said City and the grade of the New York Central Ra'ilrod
Company, and
Whereas, the Common Council of said City on the 26th. day o
of January, 1925 by Ordinance No. 2452 duly aonfirmed and approved said
Resolution,
THEREFORE, the Board 6f Public Works of said City diet on
the 28th. day of January, 1925, pass and adopt a resolution reading as follow
to -wit:

At the same time that such Plans and specifications are filed by any
of,such railroad companies or by the Board of Public Works, such companies and'such

of the work specified in the pans and specifications so filed by it 033 them.
Be it further resolved, that the Chicago, South Bend & Northern
Indiana Railway Cmpany be and the same is hereby notified. to file such plans and
specifications in particular a`s are necessary to comply with the requirements of the
abovementioned act.
All of said plans and specifications and all estimates shall be
placed on file in the office of the Board of PUblic Works within Sixty (60) days after
notice of the adoption of this resolution.
Notice of the adoption of this resolution is hereby ordered to be
served personally on all Railroad Companies and all interurban and Street Railway
Companies affected by said proposed improvement under Modified Track Separation
Resolution No. 4.

Notice is further g1ven 'that in the event that any of `the Railroad
Companies or� Sheet Railway Companies affected shall fail, ne'aieet or refuse to file
such plans, -specifications and itemized estimates as required in 'said resolution , the
said City will cause the same to be prepared and filed as provided by Section 2 of
Chapter 36 of the Acts of the General Assembly of the State of Indiana, approved
March 1,1923.
