May 23:1924 0 TO TR HONORABLE BOARD` OF P LIC WORKS r„ OF THE CITY OF SOUTH BEND; The Pittsburrho , Cincinnati, Chicago & St. Louis Railroad Coin sky respectfully petitions andews to your Honorable body that it and the New York Central Railroad Company, New Jersey, Indiana and Illinois Railroad Companyt the Michigan Central Railro Company, and the Indiana -Northern Railway Company, own and operatea,racks, cross-overs and switch tracks, and Bonne ctions, that .are 1-ocsted- between- -the-.groueids of the Studebaker: Corporation and the first alley west of Catalpa St,reetp as shown on the:blue print map hereto attached, marked Exhibit A. and made a part hereof; that it:is desired',to make changes in the cross -oven and connecting tracks for the better operation -of -the yards of said railways and for the purpose of increasing the faeilities-of the Studebaker Corporation, all as shown and indicated on said blue print, map marked Exhibit A;. that a part of said changes will take place as shown on said Exhibit A, where said track crosses Kendall Street, Chapin Street and Catalpa Street; that the changes which it is desired to make in said tracks are shown on -,said blue print, as well as the additions that will be necessary in order to carry out said proposed improvement in facilities. -WHEREFORE this petitioner asks that permission be granted to make said alterations and necessary additions as indicated and shown on said blue print.map marked Exhibit A. Be It Resolved, By the Board of Public Works of the City of South Bend, Indiana, that the petition of the Grand Trunk Western Railway Company for permission to construct an industrial sidetrack acro s Francis Street in said City, immediately north of its present west bound main track, be granted subject to.the following terms and conditions:.. (1). That said industrial sidetrack shall be constructed;.whoply upon the. land of the petitioner, Grand Trunk Western Railway Company. (2). That said industrial sidetrack shall be constructed an main- tainod according to the terms and subject to all the conditions of they';fra c-bise granted to the Penninsular RailRoad Company of Indiana, prsdeaessors of said rand Trunk Western Railway Company, embodied in Ordinance No. 62 of the Common Council of the City of South Bend, passed March 2nd.9 1868, and all ordinances supplementary to and amendatory thereof. (3) That said industrial sidetrack shall be so construpted.;as to cause the least obstruction possible to the passage of persons and vehicles, and shall be always maintained in a condition on which shall be safe and convenient for such passage; said railway Company shah construct ell necessary drains'and culverts to permit free passage of water; shall plank between the rails and for a distance of six feet on each side thereof to the full width of the xtreet-, and if, and when, required, will plank between the rails on the line of the sidewalk. Upon the neglect or refusal of said Grand Trunk Western Railway Company to comply with any or all of the foregoing requirements whencalledupon to do so, the Common Council of said City of South Bend, or the Board of Public Works,may order the sane to be done by the Street Commissioner of said City, and the cost thereof, with 20t penalty added thereto, shall be }paid to the City by saud Railway Company. 417 - - A - __ . .- __ - �.A 1- 1k -%^ # f%__ -6 J - A �_ , � I ; : , (4). Said Industrial sidetracks shall* at all times , be maintained subject to all ordIiances bf the City of South Bend as "to the speed of trains, and the s®curity of citizens and others from the operation of 'rains, and to all reasonable.rules and regulations concerning the operatin of said railroad in said City. (5).0 The rights and privilege ,to egnstruol� and ;maintain said industrial sidetracks shall include such turnouts, ,crossovers, and connections as shallbe indidental thereto. ' (6)• To each of the foregoing terms, conditions and stiputaltions, the City of South Bend; -by its Board of Public Works, and the Grand Trunk Western Railway Company, do fully agree and bind themselves$ their successors and assigns, (7). The permission confirmed in this resolution shall be subject to the approval and cosndieration of the Common Council of the City of, South Bend, BE IT FURTHER RESOLVED, by the Board of Public Works, that the 18th. day of June, 1924, at 10:00 O'clock. The following notice sent to the Postal' Telegraph Company by Wm. Qualls. You will please remove poles from,City Hall Court where same is preventing .Contractor from paving.
