Wednesday May 14 th, 1924 . 7:15 P.M.
Board met in regular session at 71-15 P-M. All members present.
Communication received, read and filed from Indiana & Michigan Electric,,
Company in regard to removing pole in front of 115 & 116 Peashway Avenue.
Partial estimate allowed on grade, curb and walk on Vassar Avenue from
Johnson Street to O'Brien Street to E. T. Tranberg, $512.83
This being the day set for deferred hearing on Resolution and Contract
providing for the granting of the right to the New Jersey, Indiana & Illinois Railroad
Company to construct, maintain and operate additional sw teh or yard tracks across Rurnn
Street, City of 13outh Bend, as spread on record urieer cute df April 23, 19240 prods' of
publication having been filed and proofs of posting having been filed on original hearing,
no objectors appearing and no objection being made, the Board iiow in all things approves
said resolutiozr'and contract. And the Board also approves the,following alaeement!
A G R E E M E N T
THIS AGREEMENT, Made and entered into at South Bend, Indiana, this 14 day
of May, 1924, by and between the New Jersey, Indiana-& Illinois Railroad Company, herein-
after designated the Company, and the Board of Public Works of the City of South Bend
aeting'for and on behalf of the said City, hereinafter designated the Board,
WITNESSETH: That Whereas, there is now pending before the said Board a
r e'solution and contract providing for the grainting of the right to the Company to con-
struct two additional railroad tracks across Huron Street in the City of South Bend,
which resolution and contract was executed April 23rd, L924, and the hearing on said
resolution and contract was fixed for May 12th, 19249 and
WHEREAS the said Board is willing to confirm said resolution and contract,
but desires that the Company shall at some future date remove two of its tracks now lying
across Huron Street, and
WHEREAS, the said Company is desirous of secui,ing the confirmation of said
resolutions
NOW THEREFORE The parties mutually promise and agree that for and in con-
sideration of the confirmation of said resolution and contract dated April 23rd, 1924
and the adoption by the Common Council of the City of South Bend of an Ordinance rati-
fying and confirming said contract and resolution, the Company will within two years
from the passage of an Ordinance ratifying and confirming said contract and resolution
remove from Huron Streeli two of its tracks now situated thereon.
IN WITNE6S WHEREOF the parties have hereunto set their hadds and seals this
14 day of May, 1924.
