This beinu date set for deferred hearing or, Resolution No. 4 for Grade Separation (f? New York Central Railroad; no parties interested being present, hearing was condinued until Wednesday, May 21st, 1924, at 9:00 A.M. ' Bids submitted TuesdAy, May'6, 1924 at 10A.M. aNd deferred until Wednes- day May 1, 1924, at 9:00 A. M: were opened and read as follows! Hearing had on Improvement Resolution No: 1334 for Pavement on Taylor Street from Indiana Avenue to Calvert Street in the City of South Bend, Indiana. Upon said hearing no remonstrators appeared and no written resmonstranoe eras filed. The Board being fully •advised in the premises, deeideat that the ben- efits to property liable to be.assessed for said improvement are equal to the estimated cost of the same, a-s reported by the City Civil Engineer, and there- upon shakes final action on said resolution as originally adopted and the same is hereby in all things ratified, confirmed and approved. Resolved further, that notices be published on the loth day of May, 19241 and on the 17th'day of May, 1924 in the South Bend News Times and South Bend Tribune in said 'City, stating that this Board will 'receive bids for the con- s traction of said improvement up to 10:00 A.M. on the 27th day of May, 1924. The Board reserves the right to reject any and all bids. Hearing had on Improvement Resolution .No. 1332 for PiPe Sewer .on Olive Street from Ewing Avenue to Prairie Avenue in the City of South Bend, Indiana. Upon •sa .hearing no remonstrators appeared and nowritten remonstrance was filed. The Boaro being fully advised in the premises, decides that the benefits to property liable to be assessed for said improvement are equal to the estimated cost of the same., as reported by the City Civil Engineer, and thereupon takes final action on said resolution as originally adopted and the same is hereby in all things ratified, confirmed and approved. Resolved further, that, notices be published on the loth day of May, 19249 and on the 17th day of May, 1924 in the Suuth Bend News Times and South Bend Tribune in said ity, stating that this Board will receive bids for the construct- ion of said improvement up to 10:00 A.M. on the 276h day of May, 1924. A remonstrAee ,was presented, read and placed on file, by property owners against pavement on Jackson Street from Sample Street to Dunham Street,. Wednesday May nth, 1924. Continued. City Engineer Anderson reported as follows: in the matter of improvement of Lincoln Way East from Washington Avenue to Sample Street, there are 98 Resident Freeholders on the street,. There are 64 good signatures onthe remonstrance. Said report filed and resolution referred to Common Council f&r confirm - a tion. Communication received from Indiana & Adhigan Electric Company requesting permission to place transformer pit in front of now" Knights of Columbus Building on Test Jeffersnn Street. Permission granted for.pit to be placed inside of curb and in front of said building. Same approved. Graeae approved on alley North. of Calvert Street from east line of Taylor Street to alley east of William Street. Construction bond of Leonard F. Fry approved. South Bend, Indiana. did, on the 7th. d'ay .of Mai 1924 adopt a preliminary resolution for the improvment of Bonds Avenue from,Olive St'reef to: Meade. under Improvement Resolution No. in the City of South Bend, Indiana, by construction. on pavement as shown on the plans, and in accordance with the profiles, detail drawings and specificatior•s on file* in the office of the Department of Public Works. AND WHEREAS, we the undersigned, are the only persons owning pro_ - perty on- said street to be improved, and that v+e alone are affected in arty. Hay by said proposed improvement. That we are the sole owners of the separate parcels of land bordering upon said street roposed to be improved. THEREFORE, in consideration that said Board of Publle Works proceed to; improve said Bonds Ave. from Olive Street to Meade Street. Hartzer St. from -Meade St. ,to Antho_ ;street Prast Blvd. from Olive St. to Anthony St. ��rederickson St. from Olive Sty -to Metade treet, keede Street from Lincoln Highwat to Frederickson St. As p--posed in said resolution, and for the further purpose of saving time and expense,- we the un_�� } derstgttecf, .hereby waive all objections on and to defense to any defect in said . proceed' ,` - and i to:,,any vication in procedure for the construction of pavements as fixed by Section 8710 of Burn's Re�i' tatutes of 1914. Lafayette Blvd. ... Siumm. Taylo t _ Street, by paving the roadway the same, and t. WHEREAS, the City Civil Engineer has prepared and filed in the office of this Board a report showing the number and location of the service pipes, mains, conduits, laterah, and connections which are, or will be necessary to accoarFce0e the abutting property and the owners thereof with gas, water, sewer; and other conveniences and neccssiries: and also said City Givil Engineer has prepared and filed in said office specifications showing the mater'al to be used . and P the maner of laying said service pipes es mains, conduits, laterals and connections from the mains to the points in- side the curb lines. r THEREFORE, be it resolved by the Board of Public Werkes of the City of South Bend, Indiana, that -the report of the City Civil Engineer is adopted, and sa'd report aed the specifications prepared and Hed by him are made a part of this resolution as fully and effectually as if copied herein at full length; and it is fur. - I' r ordered that all of such private connections with the sewer, gas, and water mains be made in said street by bringing them inside the curb lines thereof. And the City Engineer reports that Harry N. Barnes is the lowest and best 'bidder #or the kind of pavement heretofore adopted by the Board, and the Board so finds, and lets the contre;ct for said improvement to him, and orders that said improvement be made with brick pavement with bituminous filler, on gravel foundation and all pro- ceedings heretofore had in this matter are hereby confirmed and ratified. And the City Engineer reports that the Plummer Construction Cois the lowest, and best bidder for the kind of pavement heretofore adopted by the Board, and the Board so finds, and lets' the contract for said improvement to him, and orders that said improvement be made with concrete and all proceedings heretofore had in this matter are hereby confirmed and ratified.
