Wednosday April 2, 1924. Board met in regular session at 7:15 P.M. All members present. Hearing had on Improvement Resolution No. 1329 for Pavement on McPherson Street from tho north line of Dunham.Streat to the north line of Sample Street in the City of South Bend, Indiana. r Upon said hearing a remonstrator appeated'but no written remonstrance was filed. The Bogard being fully advised in the premises,.decides that the benefits to property liable to be assessed for said improvement are equal to the estimated cost of the some, as reported by the City Civil Engineer, and thereupon takes, final action on said resolution as.originally adopted and the same is hereby in all things'rat•- ified, confirmed and approved. Resolved further, that notices be published on the 1@th'day of May, 1924 and on the 17th day of May, 1924 in the South Bend News Times and South Bend Tribune. in said City, stating that this Board will receive bids for the 'eonstruction.of said improvement up to 10:00 A.M. on the 27th day of May, 1924. The Board reserves the' right to reject any and all bids. Upon said hearing no remonstrators appeared and no written remonstraee was filed. The -Board being fully advised in the premises, decides that' the benefits to property liable to be assessed for said improvement are equal to the estimated. Zest of the same, as reported by the City Civil Engineer, and thereupon takes final action on said resolution as o-riginally adopted and the same is hereby in all things ratified, confirmed and approved. Upon said hearing no remonstrators appeared and no written remonstrance was filed. - The Board being -fully advised in the premises, decides that the bene fits to property liable to be assessed for said improvement are equal to the estimated cost of the same, as reported by the City Civil Engineer, and thereupon taakes final action on said resolution as originally adopted, and the same is hereby in all things ratifiedg confirmed and approved.. Hearing had on Improvement Resolution No..1330 for Pavement snd Widening of Lincoln Way East from the south line of Washington Avenue to the south line of Sample Street in the City of South Bend, Indiana. Upon said hearing property owners appeared, some in favor of and others against said improvement. Among those who appeared were John Y. Slick, Robert Dunmeyer, Ed Doran and Mr. Moore. No rrittenremonstrance was filed. The Board being fully advised in the premises, decides that the benefits to property liable to be assessed for said improvement are equal to the estimated cost of the same, as reported by tke City Civil Engineer, and thereupon takes final action on said resolution as modified by idding five feet to curb side of roadway to be paved between Columbia Street sand Jefferson Boulevard in addition -to that shown on plan, on Lincoln Way East, and the.same is hereby in all things ratified, confirmed and approved. PETITION OF THE NEW JERSEY; INDIANA & ILLINOIS RAILROAD COMPANY FOR CONSENT TO LAY ADDITIONAL TRACKS. To the Honorable Mayor,,Common Council, and Beard of Works of the City of South Bend. Your petitioner, the New Jersey, Indiana & Illinois Railroad Company, ,respectfully shows,by this, its petition: 1. That said petitioner is a corporation duly organized and existing under and by virtue of the.laws of the State of Indiana for the purpose of ,operating a. steam railroad and particularly organized and existing under and by virtue df the general laws of the said state pertaining to the organization and existence of steam railroads. 2. That said petitioner is duly authorized to maintain and operate its p resent steam railroad in the City of South Bend under and by virtue of Ordinance Number 1250 adopted by the Common Council of the City of Sough Bend, February 28th, 1904, and Ordinance Number 2100, adopted by the Cameron Council of the City of South Bend, July 12th, 1920. 3. Your petitioner further respectfully shows that it ownsa operates and C controls a steam railroad in the said State of Indiana, and particularly said a through aki St. Joseph County, in said State, and in and from the station of Pine in sCounty in a northerly dir ction in and to the City of Suouth Bend, and is a common carrier of freigh and passengers for hire; both in state and interstate commerce: and that its liine of railroad connects with and furnishesintercharnge of traffic with other lines of railroad engaged -.in such commerce: that in order to provide accommodations necessary to accomplish the purpose for which said Company was incorporated, and in order tO furnish proper and adequate public_i'acilities in the discharge of its duties as such oommon carrier, and for the purpose of improvement of its read by the construction of additional yard facilities and team tracks,, it has become and is necessary and desirable that the said petitioner construct, operate and maintain across Huron Street, two additional switch or yard tracks in said City; that said petitioner has, for many years owned the fee simple title to the necessary lands therefor. And petitioner says that it desires and intends to use such additional siege or yard tracks, and `the land obtainedtherefor for railroad purposes in the staring, receiving, ]candling.°and deliveyy of freight, and to put the same to such uses a s such yard tracks and facilities are generally put in the operation of a steam railroad as a public earrer. 4, That both of said additional tracks will stand upnn land owned by petitioner; that the exact location of said tracks is more specifically shown by a map attached hereto and made a part of this petition. WHEREFORE this petitioner prays that it be granted permission to con- struct, maintain and operate said additional tracks across Huron Street in the City of South Bend. MATTER OF THE PETITION OF THE NEW JERSEY, INDIANA & ILLINOIS RAILROAD COM- PANY FOR PERMISSION TO CONSTRUCT, MAINTAIN AND OPERATE ADDITIONAL SWITCH OR YARD TRACKS ACROSS HURON STREET IN THE CITY OF SOUTH.BEND. RESOLIITION. P.ESOLVED, by the Board of Public Works in the City of South Bend, Ind- .iana, that the petition of the New Jersey, Indiana & Illinois Railroad V®Mpany heretofo r4 filed, asking for permission to construct, maintain -and operate two additional switch or yard tracks across Huron Street, as hereinafter further set forth, be and the samE is hereby granted, on the following terms and conditions, yard tracks shall be constructed on lands ewn: . 1. -Said-additional switch or Railroad Company and shall cross Hunan Straei owned by the New Jersey, Indiana & Illinois at grade. 2. New Jersey, Indiana &.Illmnois.Ra.lroad Co#*Any, its successors and assigns shall so construct its said tracks as o cause the least obstruction possible to the Massage 0, persons and vehicles and shall always mainatin said crossing so as to make the same safe and convenient for the passage of persons and vehicles, and shall at all times, when required by the Common Council of the City,'and at itsown expense put on flagmen at said street crossings, and said Company, its successors assigns, shall make and maintain.under its said tracks, sufficient culverts and drains to admit the free passage of water along said street and shell when required by said City plank said tracks between rails and within at least six (6) feet, on each side of said rails at such street crossing the entire width of said street and shall when so required also, plank the side- walks where they cross such tracks and shall keep such crossings when so made in good repair and condition; If said -Railroad Company, its successors and assigns, after notice, shall fail or refuse to doany and all of the things required by this contract, then the same shall be done under the orders of the Council by the Streeet Commissioner of this City and the expense of doing same, with a penalty of twenty (20) per cent, be recovered from said Company, its successors and assigns, in any court of competent jurisdiction. The said Railroad Company, its successors and assigns, shall be subject to all ordinances and regulations now. in force, or any that maybe hereafter passed by the Common Council of said City in relation to the speed of trains in or through the City and.the security of citizens and others frmm,the operation of trains in or through said City and to all reasonable regulations and ordinances concerning the running and operation of railroads in said City. The rights and privileges herein granted to construct, maintain, and operate additional switch or yard tracks shall include the right to construct,, maintain and operate such turnouts, crossovers and connections as.may.be necessary. To each of the terms, canditions, provisions, stipulations, and re- quirements of this contract the City.of South Bend, by and through its Board of Public Works, alrty of the first Rart herein and the said New Jersey, Indiana & Illinois Railroad CmmPany, alrty of the second part herein, CIO fully agree and do' bind themselves, their successors and assigns. The permission hereby given shall be subject to the approval and confirm- ation df the Common Council.of the City`of South Bend. AND, BE IT FURTHER -RESOLVED, by said Board of Public Works, that Tuesday, the 13th day if May, 1924., at 9 o'clock A.M. at the office of said Board of Public Works in the City of South Bend, Indiana, be fixed as the time and place when and' where this resolution shall be finally considered and a public hearing th ereon be had, and at which time Portests against any or all the provisions of said reso- lution shall be heard and considered, and that notice of the time and place of such hearing shall be given as required by law. Attorney Elias Strickland, representing Studebaker Corporation, appeared before the Board in regard to lea se 'by Studebaker Bros. Mfg. Co. to City of South Bend, under date of February 27, 1907, of land used by No. 2 Hose House as a park. After discussion the Board authorized cancellation of the lease and Mr. Strickland agreed to have the Studebaker Corporation provide an agreement and forward same to the Board permitting the use of said land for recreation purposes by No. 2 Hose House. Deferred hearing had on Condemnation Resolution No. 73 for Easement for trunk sewer. TKe Board directed that a letter be sent by the Clerk to Attorney Crumpacker showing record of eontinuance.on said res&lution and stating that if easement is not in by April 30, 1924, that resolution will be confirmed as it now stands. Hearing thereupon deferred until April 30, 1924. Appraisers report filed on St. Peter Street Vacation; same held up until Tuesday, April 29, 1924.
