Continu It { MADISON PARK The annexed plat is a plat of Madison Park, an addition to the City of South Bend, St. Joseph County, Indiana, which covers the following described tract of land situated in the Southwest quarter of Section 6, Town- ship 37 North, Range 3 East, to -wit: Commencing at the South line of said section at a point seven hundred and thirty and five tenths (730.5) feet West of the Southeast cor- ner of said quarter section; thence North thirteen hundred and nine and fifty-nine hun- dreths (1309.59) feet; thence South seventy-six degrees and twelve minutes West (76 ° 121)seventy- five and two tenths (75.2) feet, thence North Twenty and five tenths (20.5) feet; thence South seventy-six degrees twelve minutes (766 121) West three hundred and fifty-three (353) feet along the. Southerly line of Sorin Street to an angle in said street; thence West two hundred and one and eight - tenths (201.8) feet along the South line of said street; thence South twelve hundred andtwenty-seven and sixty-five hundreths (1227.65) feet to the South line of said section thence East six hundred and . seventeen and five '-tenths(617.5) feet to the Place of beginning. The streets and alleys are hereby dedicated to the public .for the use of the public as thorough- fares. -BUILDING RESTRICTIONS Be it known that all persons, natruall or artificial, who shall hereafter acquire any interest in any lot in said addition, shall be taken and held to agree with the grantors, and with the owners of any and all of the other lots in said addition, to conform to and observe the following covenants and,restrictions and stipulations at least until January 1, 1950 at which timeaall or any of such restrictions may be revoked or repealed only by the written consent, duly recorded, of the owners of a majority of the frontage on that part of any particu- lar street affected that lies within the limits of this plat. Each and all of the restrictions herein set forth shall run with the land and bind the present owners, their successors, assigns, heirs; executors, and administrators, and all persons claiming by, through or under them, shall be taken to hold, agree and covenant with the owners or owner of said lots, their successors, assigns, heirs, executors, administrators, and each of them to comply with and observe said restrictions as to the use of said ots and the consrtucion of the improvements hereon, but n estrictions herein set forth shall be personally binding ��n any person except in respect to breaches committed during j his ownership of such lot or lots. No building shall be built nearer than twenty- five feet to the front property " line except that a porch not exceeding 10 feet in width may be built on the front of any house, and that bay, bow, oriel, or other pvojections at window and stairway landings may project beyond the front building line not more than 5 feet. No building, or parts thereof, shall be built nearer than 4 feet to the side lines of any lot or parcel of land with the exception that the eaves of any building may project over said 4 foot restriction line not to exceed 18 inches; provided, however, that if the grantee shall purchase more than one lot, and said property so purchased shall be adjoining lots or parts thereof, he may construct a duelling house on said tract so purchased, in such place that it shall not be nearer than four feet to either side of said tract, but, if purchasing more than one lot, and so constructing a house over the restricted lot lines as platted, he may not thereafter sell off such part of the property so purchased as shall permit said side lines to be closer than 4 feet to the building so constructed. No garage or putbuilding shall be constructed with its entire foundation forward more than 10 feet from the rear line of the owners lot or tract, unless the same shall be constructed in connection with and as a part of the house. No lot in said addition shall be improved, used or occupied for other than residential purposes, and no flat or apartment, though intended for residential purposes, may be erected theron. No more than one building for residential pur- poses shall be erected on any lot, and each residenace so erected shall be designed for occupancy by a single family, and shall front on the street on which the lot fronts. For the purpose of these restrictions Lot 1 shall be considered as fronting on both i:.,icKinley Avenue and the Boulevard, but not on Sunnyside Avenue and Lot 2 shall be considered as fronting on both McK nley Avenue and the Boulevard. Houses erected on Lots 1 and 2 shall be situated as near as practicable upon the central portions notof said lots separated and shall have garages, if any, from such houses. JOSEPH COUNTY, STATE OF INDIANA, that it is desired and deemed necessary to iMVPOW Marquette Avenue from Michigan Street to La Fayette Street as follows, to -wit' -- The roadway of said Avenue shall be resurfaced: also the rRadway of certain portions.of the streets and alleys which enter or intersect said avenue shall be resurfaced. Upon said hearing a remonstrator appeared but no written remonstrance was filed. The Board being fully advised in the premises, decides that the benefits to property liable to be assessed for said improvement are equal to the estimated cost Of the some, as reported by the City Civil Engineer, and there -upon takes. final action on said resolution as.originally adopted and the same is hereby in all things'rat- ified, confirmed and approved. Resolved further, that notiees be published on the l0th'day of May, 1924 and on the 17th day of May, 1924 in the South Bend News Times and South Bend Tribune. in said City, stating that this Board will receive bids for the eonstruetion.of said improvement up to 10:00 A.M. on the 27th day of May, 1924. Upon said hearing property owners appeared, same in favor of and others against said improvement. Among those who appeared were John Y. Slick, Robert Dunmoyer, Ed Doran and Mr. Moore. No rrittenremonstrance was filed. The Board being fully -advised in the premises, decries that the benefits to property liable to be assessed for said improvement are equal to the estimated cost of the same, as reported by the City Civil Engineer, and thereupon takes'final action on said re,Solution as modified by adding five feet to curb side of roadway to be paved between Columbia Street and Jefferson Boulevard in addition to than shown on plan, an Lincoln Way East, and the.same is hereby in all things ratified, confirmed and approved.
