Wednesday April 9th, 1924.
, Board met in special,session at ll 10 A.M. All members present: also
present: Mayor Eli F. Seebirt,-City Civil Engineer Anderson; also Engineer Reinsagen, Genes
Superintendent W. F. Schaff and Attorney John G. Yeagley of the New York Central Railroad.
Attorney Buczkowski appeared and presented a petition for Northern Indiana
Wholesale Grocery Company regarding trick elevation at Arnold -Street and at Walnut and
e
Division Street ros.s"ings of New York Central Lines, asking that prevision ire made in Res-
plution No.. 4 for the separation of ,the grades of at - least two. of mentioned crossings.
Same placed on file.
Conversation was held between the Board, Meyer, City Engineer, Mr. Schaff,
Mr. Reinsagen and Mr. Yeagley regarding Now York Central Railroad assuming the cyst of
opening new street north of Sample Street from Fellows Street to ,Clinton Street; also as-
suming the cost of purchasing property for a new street north of Sample STREET and pur-
e hathing necessary property to rearrange Marietta and Ohio Streets where they cross tracks.
Mr. Schaff requested time to submit above :proposition to New York Officials of Railroad.
Reques't granted by the Board, who asked for a report by May.7th, 1 4. Hearing continued
until May 79 1.924 at 9:00 A.M.

Hearing given on Condemnation Resolution No. 88 for the opening of Colfax
Avenue from EDDY Streetle Sunnyside Avenue in the City of South Bead, Ind.iama.
In the above matter no remonstrators appeared and nowritten remonstrance
was filed. Mr. Witwer, representing Studebaker Estate, Mr. Falter Mclnerny and VitUs Jones
.appeared in favor of improvement. The Board therefore sustain all former action taken,
and declare the above described property in all things condemned and appropriated for
public use and this resolution'in all things, ratified, confirmed and approved.
The Board further ordered that the City Engineer be:instructed t, prepare
a roll of all owners or holders of property and of valuable interests therein tit to
be taken or to be injuriously affected which list or roll shall also describe the property
beneficially affected acid show the awards of damages and' assessments of benefits in the

Street from Hamilton Street to Bergan Street; also Brookfield Street, from Hamilton Street

In' the above a tter'remonstrators appeared and Attorney Ed Doran filed
written remonstrance. The'Board thereupon sustain all former action taken, and declare
the above described property in all things condemned and appropriated for public use and.-
this resolution in all things, ratified, confirmed and approved.
The Board further.ordered that the City Engineer be'instructed to prepare

Hearing given on Condemnation Resolution NO. 87 for the Opening of Elmer
Street from the north line of Marquette Heights Addition to Wilson Street in the City of
South Bend, Indiana.
In the -above mutter Dan Pyle appeared and -filed a remonstrance. No other
remonstrators appeared and no other remonstrance was filed. The Board thereupon sustain
all former action taken, and declare the above described property in all things condemned a
and appropriated -.for public use and this resolution in all things, ratified, confirmed
and approved.
The Board further"ordered that the City Engineer be instructed to prepare
a roll of all owners or holders of property and of valuable interests therein sought to
be taken or to be injuriously affected, which list or roll shall also describe the
property beneficially affected'and show the awards of damages and assessments of benefits
in the above matter.

Hearing had on Improvement Resolution No 1323 for Grade, Curb and Walk
on bothsides and Sidewalk on East side of Gertrude Stre'e't from Prairie Avenue to
Ewing Avenue in the City of South Bend, Indiana.
Upaln said hearing no remonstrators appeared and no written remonstrance
was filed. Mr. Iden S. Romig appeared in fovarof the improvement. -The Board being
-fully ddvised in the premises, decides that the benefits to property liable to be
a s sessed ' for said improvement are equal to the estimated cost of the samE j ws reported
bythe City Civil Engineer, and thereupon takes final action on said resolution as
originally adopted and the same is hereby in all things ratified, confirmed'and
approved..
Resolved further, that notices be published on the 30th day of April, 192e
and -on the 7th day of May, 1924, in the South Bend News Times and South Bend Tribune
in said City, stating that this Neard will receive bids far the eenstruetion of said
improvement up to 10:00 A.M. on the 20th day of May,'1924. The Board reserves the
right to reject any -and all bids.
Hearing had on Condemnation Resolution No. 113 for an Easment fe a Trunk.
SewerG' George Witwer, Walter McInerny, L. G. Palmer, Claude Taylor, William` Moore,
Vitus Jones and F. C. Raff appeared. Hearing continued one week until April 16th,
1924, at 7:15 P.M. A new eAsement t6 be submitted to Board by Studebaker Trustees to
describe the route.
Hearing had on Improvement Resolution No. 1322 for 'Pavement and_ Wicbe:ning
of Lafayette Street from New York Central Railroad to a point 703 feet nth, in the
City of South Bend, Indiana.
Upon saidhearing,ne remonstrators eppeared and no written remonstrance
was filed. Mr. Austin of the Studebaker Corporation, requested that pavement be ex -tended south to Sample Street. Mr. Anderson, City Engineer, said that a new resolu-
tion was to be prepared for this extension. The Beard, being fully advised in.the
promises, decides that the benefits to property liable to be..assessed for said
improvement are equal to the estimated cost 6 the same, as reported by the b ity '
Civil Engineer, and thereupon takes final action on said resolutian as originally
adopted and the same is hereby in all things ratified, confirmed and approved.
Resolved further, that notices be published on the 30th day of April,
1924 and on the 7th day *f ?day, 1924, in the South Bend News Times and South Bend

Street in the City of South Bend, Indiana.
In the above matter no remonstrators appeared and no written remonstrance

above described property in all things, condemned and appropriated for public use and
this resolution in all things, ratified, confirmed and approved.
The Board further ordered that the City Engineer be instrue.ted to prepare

Deferred hearing had on Pipe Sewer on Brea4way from the manhole at the
east end of the Broadway sewer to the first alley west of Maimi Street. The Boand,
after hearing all interested parties, decided -to rescind all former action taken
on this resolution and thereupon, granted permission to attach to adjacent sewer under
supervision of City Engineer.

Hearing had on Vacation Resolution Net 85 for the vacation of an alley in
illis A. Bugbee's 1st.Addition•to the City of South Bend, Indiana.
In the above matter no remonstrators appeared and no written remonstrance
was filed. The Board therefore sustain all former action taken on said resolution
and declare the above described property in all things vacated and this resolution in
411 things ratified, confirmed and approved. There was a deod given to the City of
So%tth Bend of the land in question in this -resolution by Joseph-C. Woodward and Agnes
Woodward, approved by the Beard under date of March 5, 1924,

line of South Bend City Addition under Condemnation Resolution No. 74, in the City of

In the above matter Attorneys Frank GILMER, Ed Doran and Joseph 0. Plante
appeared on behalf of clients who objected to ' their award of damages, but no written
remonstrance was filed. The Board thereupon find that the property assessed in -said roll
filed March 129 1924, are benefitted and damaged respectively as sown in said roll as
hereinafter described, and said roll is. hereby in all things ;.ratified, confirmed and.
approved as oringinally filed, and all action under condemnation Resolution No. 74 is
hereby.cancluded.

will be made at the following intersections for the Automatic Signal which are being
installed.
