HomeMy WebLinkAbout04/09/1924 Board of Public Works Special Meeting MinutesWednesday April 9th, 1924-. Board met in special.session at 11:10 A.M. All members present: also present: Mayor Eli F. Seebirt,•City Civil Engineer Anderson; also Engineer Reinsagen, Genei Superintendent W. F. Schaff and Attorney John G. Yeagley of the New York Central Railroad. Attorney Buczkowski appeared and presented a petition for Northern Indiana Wholesale Orocery Company regarding trick elevation at Arnold Street, and at Walnut and Division Street croslings of New York Central Lines, asking that, provision be made in Res- plution No. 4 for the separation of .the grades of at. least, two. of mentioned crossings. Same placed on file. Conversation was held between the Board, Mayor, City Erigineer,.Mr. Schaff, Mr. Reinsagen and Mr. Yeagley regarding Now York Central Railroad assuming the cost of opening now street north of Sample Street from Fellows Street to Clinton Street; also as- suming the cost of purchasing property for a new street north of Sample STREET and pur- c hashing necessary property to rearrange Marietta and Ohio Streets where they cress tracks. Mr. Schaff requested time to submit above -proposition to New York Officials of Railroad. Requds't granted by the Board, wlie asked for a report by May . 7th, 1 4. Hearing continued until May 7, 1924 at 9:00 A.M. Pre sid t Wednesday April 9th 19249 7:15 P.M. Board met in -regular session at 7:15 P.M. Allmembers present: Clerk of Board absent. . Hearing given on Condemnation Resolution No. 88 for the opening of Colfax Avenue from EDDY Streetin Sunnyside Avenue in the City +of South Bend, Indiana. in the above matter no remonstraters appeared and nogwritten remonstrance was filed. Mr. Witwer, representing Studebaker Estate, Mr. Falter MoInerny and VitUs Jones .appeared in favor of improvement. The Board therefore sustain all former action taken, and .declare the above described property in all things condemned and appropriated for public use and this resolution'in all things, ratified, confirmed and approved. The Beard further ordered that the City Engineer be instructed to prepare a roll of all owners or hddders of property and of valuable interests therei:n.- � t to be taken or to be injuriously affected which list or roll shall. also describe the property beneficially affected and show the awards of damages and` assessments of bonefits in the above muter. Hearing given on Condemnation Resolution No. 86 for the opening of College Street from Hamilton Street to Bergan Street; also Brookfield Street from Hamilton Street to south line of Bergan STREET; also Brookfield 'Street from north"line of Bergan Street to south line of Wilson Street 'also Johnson Street from Hamilton Street to Will -in Street, in the City f South Bend, Indiana. In'*the above matter'remenstrators appeared and Attorney Ed Doran filed written remonstrance. The'Board thereupon sustain all former action taken, and declare the above described property in all things condemned and appropriated for public use and-- th's resolution in all things, ratified, confirmed and approved. The Board further,ordered that the City Engineer be instructed to prepare a rill of all owners or holders of property and of valuable interests therein sought to., be taken or to be injuriously affected, which list or roll shall alto describe the property beneficially affected and show the awards of damages and assessments of benefits in the above matter. Hearing given on Condemnation Resolution NO. 87 for the Opening of Elmor Street from the north line of Marquette Heights Addition to Wilson Street in the City of South Bend, Indiana. In the -above matter Dan Pyle appeared and filed a remonstrance. No other remonstrators appeared and no other remonstrance was filed. The Board thereupon sustain all former action taken, and declare the above described property in all things condemned and appropriated for public use and this resolution in all things, ratified, confirmed and approved. The Board further ordered that the City Engineer be instructed to prepare a roll of all owners or holders of property and of valuable interests therein sought to be taken or to be injuriously affected, which list or roll shall also describe the, property beneficially affected and show the awards of damages and assessments of benefits in the above ratter.
