Upon said hearing no remonstrators Appeared and no written remonstrance was
filed. The Board being fully advised in the premises, decides that the benefits to property
liable to be assessed for said improvement are equal to the estimted cast of the same, as
reputed by the City Civil Engineer,. and thereupon takes final action an said resolution
�ls originally adopted and the same is hereby in all things ratified, confirmed and approved,

Board met in regular session at 9:00 A.M. All members present. Clerk of
the Baird absent on account of sickness.
Mr*. Hurwiah appeared at 9:30 and reported to the Board that property on
South Lafayette Street was all cleared up.
This being the date set fvr bids on River Park Trunk Sewer District No 3,
bids were received as follows:

by the City Plan Commission under elate of April 4, 1924, was approved by this
Board this 8th day of Apri1,' .1924, with the following dedication.:

The annexed plat of John L. Taylor's Addition to the City of South Bend,
Indiana is a subdivision of the following property,,
Lots 1-2-3-4-$-6 and part of lots 10-11 & 12 in Samual Smith Et Al pAr

City of South Bend, St Joseph County, Indiana.
The plat consists of 17 lots numbered from 1 to 17 inclusive.

April 4, 1924, was approved by this Board this 8th day of April, 1924, with the

a subdivision of Lots 269-270 and,.the East One-half of lot 271 in Third Plat of
Northwest Addition to the City of South Bend, St. Joseph County, Indiana.

so that bids can be advertised for for painting fence at City Cemetery; also to prepare
s_pecifications • for painting City Hall exterior.
Street Commissioner given permission to purchase a Ford Roadster for Garbage
Department.
A letter from the HeAlth Board asking that the petition for trade, Curb and
WALK ON buskin Street from Oakland Street to Emerson Street be granted was received, read
and placed on file, and a resoiutian for Grade only was_ordered.

SOUTH BEND, INDIANA.
WHEREAS, the Board of Public Works of the City of South Bend, Indiana, did on
the day of April 192 4 adopt a-prelimnary resolution for the
construction of sewers on Ostemo Ave. from Marquette Ave.. to Iroquois St.,.and Marquette
Ave from ar ovas ve. o n e a orC ie., #nbhore Drive from ar ovas •n e a Ave.
on.Angella Ave. from Iroquois St. to North Shore Drive and the St. Joseph Rivera
Under Improvement Resolution No. in the City of South Bend, Indiana by construction of a sewer, also the
construction of the necessary manholes and inlets, storm water inlets, conduits and re:ettirg all manholes ar.d inlets
to the proper grade, all as shown on the plans and in accordance with the p p g p profiles, detail draH ings and specifications
on file in the office of the Department of Public Works.
AND WHEREAS, we, the undersigned are the only persons owing prcperty,on the said
street to be improved, and that we are alone affected in anyway by said proposed improvements. That we are the
sole oNaers od?the separate parcels of land bordering upon said street proposed to be improved.
THEREFORE, in consideration that said Board of Public Works proceed to improve said
streets known as
-Ostemo Ave. and Angella Ave. and Marquette eve, and North Shore Drive.
as proposed:,in said resolution, and for the further purpose of saving time and expense, we the undersigned, do hereby
waive all objections on and in defense to any defect in said proceedings, and to any violation in -procedure for the con-

struction of sewers as fixed by Section 8722 of .Burn's Revised Statutes of 1914. We further waive any right to
object ; to the form of said resolution. We further waive any and all objections to the fact that no advertisement for
hearing wps'published as required by law, and that no notices were mailed tc the cwners of property and that no f,er-
ring was held by said Board; --
We also. consent that said Board shall proceed to let the contract for doing said work in the
following manners
That they shall notify by mail responsible contractors in the City of South 'Berd, Indianaof
said:work to be done under:said resolution, and that they shall receive bids from said contractors for doing of said work

and they shalllet the contract for the ding of the said work to the lowest responsible bidder. And we waive any
otjection to the action of said Board in letting said contract in a form and manner"other than provided by law.
And we further consent that the cost of doing said work shall be assessed against the different
parcels of real estate owned by us as provided by Sections 8722, 8724, 8725, 8726, 8727, 8728, and all acts -and
laws amendatory thereof or supplemental thereto.

A. report was received from i.he Street Xommissioner about the condition
of South Lafayette Street because of oonduot of Hurwich Iron Company. Mr. Hur-
wick appeared and said it mould be cleared up by today, April 8, 1924.
:Request was received from Piatz & Gild, *w close an alley between. Main
Street and Michigan.Street from -Wayne Street to 1st alley north of Wayne Street.
Building Commissioner Davis reported that 30. days would e sufficient time and
rhe6mmended that said Platz & Gill be permitted to close said alley the width of
the building; only at reak of 225-227 South Michigan Street for a period of thirty
days. Request granted in accordance with Building Commissioners recommendation..
A petition was received and placed on file for Pavement on Fairview Ave
nue from Michigan Street to Fellows Street,.
A petition was received, read and referred to Pale and Wire' Inspector,.
for Lights on Fairview Avenue from Michigan.Street to Fellows Street.
A petition was received and resilutian ordered for Grading alley west of
Miami Street from Pennsylvania AVENUE TO Broadway.
Partial Estimate No. 4 for St. Peter Street Sub -Trunk Sewer was approved.
Board directed that Indiana & Michigan Electric Company be notified to
repair pole in front of 312 North Lafayette Street.
.Pole and Wire Inspector Qualls reported that Indiana & Michigan Electric
Company should be instructed to remove lights and poles and wires from the corner
of Main and Bronson Streets; so ordered.
The Western Union Telegraph Company was granted permission to place a
pole at the corner of Main and Bronsnn Streets in 9rder to shorten the cable
span that extends across Main Street o the Vandalic Railroad Station, pole to
be used jointly by said company and Indians & Michigan ELECTric Company.
9 C#mmunieation was received from C. W. Copp, Commander Major Wm..MdKinley
Camp No 58 Sons of Veterans, regarding condition of speaker's stand at' the City
Cemetery; same referred to sexton at gity Cemetery to make repairs,
A request was received from Chas. W. Slick regarding an extension of time
to Indiana & Michigan Electric.Company for -Aires across Lincoln Way East into
Slick's Laundry building; same granted and approved by the Board.
Petition received and -:read and resolution ordered for Asphalt Pavement on
alley between and parallel to Washington Avenue and Jefferson Street from Lafaay-
e tte Street to Williams Street. -
Building Department and Electrical Department each filed monthly.report;
same approved.
Contract for Grade, Curb and Walla on Roberts Street from Mishawaka
Avenue to Ruskin Street transferred from. Highways_ Material Company to Harry N.
BARNES: Same approved by the Board
Pole and -Wire Inspector Qualls recommended that two street lights with
,poles' -and wires be removed from Tutt Street; same approved by Board.
