Dorau, *ember 2, The Contractor shall apply for and obtain any and all required permits for the work from local, state, and federal agencies and shall comply with permit requirements, including the St. Joseph County / City of South Bend Building Department. 3. If the Contractor awarded this contract is not a resident of Indiana, within thirty days, the Contractor shall provide the City with proof that the Contractor is duly licensed, qualified and registered with the Secretary of State of Indiana to engage in business within the State of Indiana. 4. The Contractor shall comply with all provisions of Indiana Code 5-116-13, as amended. The City reserves the right to immediately terminate the public work project awarded should the Contractor be found to be in violation of any provision: of Indiana Code 5-16-13 and such violation shall result in the forfeiture of Contractor's performance bond to the City. XIII. SUBMITTALS A. Prevailing Specifications: 2016, INDOT Standard Specifications Section 106 B. Additions: 1. Submit four (4) copies or an electronic version of the submittals for all equipment or materials used in this project to the City for approval. All submittals must be delivered within 7 calendar days from the notice to proceed. a, Digital submission of all submittals shall also be provided to TWG Construction, LLC at time of submission. 2. The Department of Public Works will review and return two (2) copies or an electronic version of the submittals within five (5) working days. 3. The review of the submittal information by the Department of Public Works is to facilitate the satisfactory acceptance of the equipment. This review shall ineither relieve the contractor from the responsibility for deviations from the Specifications, nor from errors and omissions in the shop drawings or literature. Parts found not meeting the requirements of these Specifications shall be removed, repaired or replaced at no cost to the City. 4. Submittals shall include complete manufacturer's descriptive information and shop drawings for all the parts furnished under this contract. 5. Upon completion of project, the Contractor will supply one (1'1) conformed set of all submittals to the City and TWG. XIV. PR ,�ITIQN AND PROGRES&,, TOS,EC _ A. Additions: I The project will have a completion date of May 23rd , 2018 for Building 2, June 91h , 2018 for Building 1, June loth, 2018 for Building 3, and August 14 th for Building 4. The contract time will start when the Notice to Proceed is delivered andl signed, 2. The City, Engineer, Contractor, and Td G Construction, LLC will hold a pre -construction meeting following award of the contract. The date of the Notice to Proceed will be agreed at that meeting. Version 4/17/2015 Special Provisions - 5 (7 SER VI CE, L L C 5005 LincoInway E- 5TE A -Mishawaka, Indiana 46544 Office (574) 329-5191 Fax (574) 329-5471 March 15, 2018 Schedule Adjustment Please accept the following electrical change order with the following scope of work: 106m, F0191ING110MI SCOPE CHANGE: 1, We are requesting a 90 day extension due to delay of framing and roof on buildings scheduled to be ready 12114/17. These buildings are still not ready to date. EXPLANATION: The original milestone schedule sent from TWG on 08/011/2017 was presented in pre -con and agreed to by CBS Service (Jeremy Smith), TWG (John Lowery), and City of South Bend (Toy Villa). MEP rougih start line items 104-112 on the original schedule were to start 12/14/2017. TWG sent a revised schedule on 03/08/2018. The revised schedule pushed MEP rough start to 03/02/2,018 on line item 117. As of today, 03/15/2018, the framing is still not complete, and the roof has not been installed. The new schedule also shortens the durations agreed to in the original schedule along with: overlapping. CBS will not agree to an expedited schedule without compensation. TWG has acknowledged this. Therefore, we are seeking full a 910-day extension on the complete schedule. ADDITIONAL 72 HOUR NOTICE: CBS Service's contract with City of South Bend includes completion dates. These dates have been pushed back by no fault of CBS. These delays have continued to date. On 03/14/2018 a letter was written to TVVG stating that any further delay will cause additional burden as labor, storage, and material prices rise. Additionally, the manpower and finance were secured per schedule. CBS cannot continue to carry the burden of rising costs and shiftingi manpower. We have notified TWG that our start date will be Monday 3/19/2018. If we are told not to start, we will request additional compensation. If any re -work or additional trips to finish work are required due to incomplete predecessor activities, we will request additional compensation. If any re- work is needed due to added framing or weather -damaged product, we will seek compensation. If additional protection is needed due to weather exposure, we will seek compensation. Action Items that are causing delay and/or damages: 1. Framing on building is not complete. Items remaining but not inclusive are knee walls kitchen islands and peninsulas, corrected framing including P-lam beam reframe, punch framing, electrical panel and media panel box outs. Framing to have been completed 12-29- 17 2. The roof has not been installed on Building 2 along with several windows and doors. Any work performed that is damaged by the building not being dried in will be at the cost of others. Any additional protection on the work installed will be at the cost of others. Roofing to be completed 2-26-18 Windows to be completed 1-12-18 This Notice does not waive any right of extension for delay, or compensation from previous dates not being met.
