and South Arnold St., North of Prairie Ave. (Preliminary Review)
Dear Ms. Baugher:
The Board of Public Works, at its March 27, 2018 meeting, reviewed comments by the
Engineering Division, Area Plan Commission, Community Investment, Fire Department, and the
Solid Waste Division. Community Investment stated per IC 36-7-3-13 criteria, the vacation would
make access to the lands of the aggrieved person by means of public way difficult or inconvenient
due to a garage located on the alley at 1622 Webster St.
Therefore, the Board of Public Works submitted an unfavorable recommendation for the vacation
of this alley.
Please contact Donna Hanson at (574) 235-,9254 prior to picking up your radius map., You
will need a radius map showing properties within 150' of the proposed vacation for your petition
to the Common Council. Once you pick up the radius map, proceed to the City Clerk's office for
your alley vacation packet.

Location: I" NIS alley between Webster & Arnold, south of I'€ E/W alley south of Indiana.
Dear Board Members:
The staff has reviewed this petition relative to IC 36-7-3-13, It is the staff's opinion that:
(1) The vacation would not hinder the growth or orderly development of the unit or neighborhood in which it is
located or to which it is contiguous.
The block serviced by this alley is fully developed. All properties within the block have direct access to
neighboring public streets and alleys. Further development /redevelopment of the block would have direct access
to the adjacent public ways.
(2) The vacation would not stake access to the lands of the aggrieved person by means of public way difficult or
inconvenient.
Each property adjacent to the proposed vacation has direct access to a dedicated public right-of-way. Vacation
of the full length of the alley will restrict alley access for Lot 10 and the adjacent lot to the west,
(3) The vacation would not hinder the public's access to a church, school, or other public building or place.
No church, school or other public building or place is accessed by either the alley.
(4) The vacation would not hinder the use of a public way by the neighborhood in which it is located or to which it
is contiguous,
The vacation will not hinder access to other adjacent public ways,
This request is an identical request from an application submitted in October of 2017.Our recommendation remains
the same -- that the vacation only be from the E/W alley to the north right-of-way line, extended, of the E/W alley that
extends from Arnold St., approximately 183.7'. This would provide full access to the F/W alley for Lot 10 and the
adjacent parcel to the west.

Given that this item was on the board agenda and a few months removed from the recommendation. I took a second
look for DCI just to refamiliarize myself and found that the existence of a garage at 1622 Webster would give cause to
change our earlier recommendation. It's for this reason that I's want to resubmit our: mewcornmennation as unfavorable
based on die followirig:
