parties attending adjourned to Common Council room, City Hall, South Send,
this. being; the date set for hearing on Resolution No. 4 for-othe. separation Fff

Attorney Buezkowski appeared representing properly owners in the
west part of the city, and objected to form of said Resdlutio that it did not
p ro'ide for, elevating tracks over Arnold street and a 11 giros ings up to -Olive
street,, and objected to track_ elevation funiess these were included.
Among the ppropperty owners present were Stanley P Demski, Wm.
Gammon and Chas. Niedbalski. Attorney Harry G. Wair appeared for the Chicaago$
SOUTH Bend « Northern Indiana Railway Com any. attorney John'G. Yeagley
appeared For the New York Central Railroad Company.

approximately 200 citizens and residents of the Sixth Ward representing
approximately 1300 citizens and voters of the catty of South Bend, held on
February 26, 1924, at St. Hedwig's Hall to the authenticity and eniuness of
which the undersigned, citizens and residents of South Bend, cer ify to.as a
committee appointed for said and other purposes:

Whereas, the Board o F Public Works of the city of South Bend, ST.
Joseph County, State of Indiana, by resolution known as Board of Public Works
Resolution No, 49 Providing for Grade Seperation, proposes to adopt a certain

The undersigned,
Chicago, South Bend & Northern Indiana Railway Company,, hereby shows that this Board has
heretofore, in these proceedings and under resolution number four herein, determined
that the undersigned, which maintains street car tracks at Qhapin STREET and Michigan
Street in said city of South Bend, where the same intersect the tracks of the New York
CENTRAL Railway Comppany, shall reconstruct its teaeks accordin to the grades provided
for in said resolution and shall pay ffve per cent. of the cos of the alteration of
such grade crossings at such intersections, and which said percentage of such cost, has
been set up -in said resolution.

That.a sewer has been placed on Humbolt S treat in said city immediately to
the South of the above described real estate and that they were previously assessed
by -your Honorable Body in the amouat of $132.81 which sum petitioners believe to be
unjust andexcessive, in as much as they have already been assessed for the sewer on
Blain Avenue which runs to the front of the above described real estate and they are now
paying the same.
They further show the Board that there is arestriction in their dadd which
prevents them from building any additional house on the above described real estate
until the year 1945 and that it is impossible for them to get any service or use out of
this sewer on said Humbolt street.
WHEREFORE, they pray yur Honorable Board that they be reimbursed in the
amount of $75.00 for over -assessment and unjust assessment on the above named Humbolt

The following resolution was adopted at a mass meeting of appprox-
mately 205 citizens and residents of the Fifth ward representing approximately
1500 citizens and voters of the city of south Bend, held on February 24, at St. 4
Adalbert's Hall, to the authenticity and geniuness of which the undersigned,
citizens and residents of South Bend, certify to as a committee appointed for said
and other purposes:

WHEREAS, by the said proposed plan no consideration is give -n to the

THEREFORE, be it resolved that it is the sense of this meeting
that we, citizens and residents of the West Side, of the City of South Bends ar-e

proximately 1500 citizens and voters of the city of South Bedd, held on February
249 at St. Stanislaw Hallo to the authenticity and geniuness of which the
undersigned, citizens and residents of south Bend, certify to -as .a committee
appointed for said and other purposes:
RESOLUTION:
WHEREAS, the Board of Public Works dof the city of South Bend, St.
Joseph County, State of Indiana, by resolution known as Board of Public Works
Resolution No 49 Providing for Grade;Separation, proposes to adopt a certain
proposed plan as described in said Resolution for the elevation of�the railroad
racks of the.New York Central Railroad Company, -and of.the Grand Trunk Western
Railroad Company; and
WHEREAS, by the said proposed plan.no consideration, is given to
the elevation of the tracks of the aforesaid railroad companies at the se oral

favor of the track elevation of the several railroads providing such elevation
includes the street crossings between Chapin and Olive Streets inclusive; and.
BE it further resolved that it is the sense of this meeting that
if for any reason and or reasons the elevation of the tracks of the aforesaid
railroad companies cannot include the street crossings over which the tracks of
the aforesaid companies crosses between Chapin and 11live Streets inclusive then
the question of track elevation of the aforesaid railroad companies remain in
abeyance until such time as the said reason and or reasons, -be eliminated; and
BE it further resolved that it is the sense of this meetingthat
the presiding officer name a committee o five persons whose duty it shalbe to
sin this resolution as s committee for and in behalf of the persons present at
this meeting, and for and in behalf of the citizens and residents of the city of
South Bend represented by --Ilhe members present at this meeting, and present same
to the Board of Public Works in a form of a proper petition as a remonstranCe for
and in behalf of the persons present at this meeting as a committee of said per-
sons and for and behalf of the citizens and residents of the West Side -,represented
