Atty A. G. Graham appeared before the Board and presentees written
petition for the Vacation of St. Peter Street from North line of North Side Blvd. to the
South Line of an alley running East and West between Division Street and Wayne Street
also alley extending from the north side of North Side'Blvd. to the south ztft.line of
Division Street. Resolution ordered on following petitions.

four years old. It has been in.eonstant service durimg'this time and because of
this faet.and also because it will need more or less attention from now ens I would
recommend that it now be replaced with a new machine.
The -local Royal Typewriter salesman has made the fallowing proposition
the price of a new machine to the City of $92.25 with an allewnwe to,$30.00 for the
old machine making a net cost of $62. 25. I would recommend that,this proposition
be given your careful consideration.

Gentlemen:-
The sketch below will illustrate the situation in the district covered
by attached petition. The petitioners claim that the light from the Aro lights at
Maple Street and Walnut Street is obstructed by trees and that the light on the corner
of Spruce Street and alley is also obstructed by trees. In the o inion of the
writer the only relief that can be given is to locate another incrldescent light

RESOLUTION ON N0, 4 , +
A R�SOLYTION OF THE BOARD OF PUBLIC �ORKS PROVIDING FOR GRADE SEPARATION.
WHEREAS, it is deeined necessary for the public good that the grades of
certain streets, of the City of South Bend, Indiana where the same intets of the tracks
of the railroad Companites herein after named, be changed and altered, and that the grades
of the tracks of said railroad companies be altered and changed;
NOW, ZNMFORE, be it resolved by the Board of Public Works of the City of
South Bend, Indiana:
That the grade ero sings of the tracks of the New York Central RailRoad
Company, a steam railroad, at the intersection of its tracks with CHAPIN STREET,,FCOTT
STREET, PRAIRIE AtVENVE, LAFAyette S tet, MAIN -STREET BRONSON STREET, MICHIGAN SRREETq
FELLOWS STREET, SAMPLE STTEET,RUSH STREET, OHIO STREET, MABIETTA STREET, HIGH STREET, all

in the City of South Bend, Indiana, be altered by the ee�ai,i �n of ,said t aeks or by t
depression of said streets, or by a combined'elevation of said tracks with a dopression.of
such streets at such intersections; and also, by reason of the aforesaid elevation or de-
pression that the grade of certain other streets and -alloys anO of certain railroads and
railways be changed; and that the -change in grade of said several streets, railroads and
railways intersecting said railroad, and of certain streets and alleys intersecting said
streets and other railway and railroad tracks and the amount in feet of{the clearaace of the
superstructure ever the above named streets, shall be.as-follows:-
(1) The grade of Cherry Street, where the same intersects the tracks of
the New York Central Railroad Company, shall -be raised six -Tenths (0.6) of a foot above
the tap of the highest rail of said tracks as now maintained; and the tracks of said eospany
as snow maintained shall be made to' -conform to the grade of said street when changed as
provided herein. The grades -of said street on each side of said tracks shall be descending
grades at the rate of five (5) feet to each one hundred feet from the northerly and southerly~
rails.
(2) The grade of Division Street, where the same intersects the tracks of
the New York Central`:Railroad Company, shall be raised two and seventy four hundreths
(2 74/100) feet above the top of the highest rail of said tracks as now maintained; and the
tracks of said company' across said streets shall be raised to confers tothe grade,.Of Said
street *Lhen changed as provided herein. The grades of said street from the easterly and
westerly rails of said tracks shall respectively be descending grades of five (5)'"feet t.0
each one hundred (100) feet, until=they intersect the presant-street grades. The grade of
Walnut Street, which intersects Division � shall, on each side of said Division Street be
made to confmn to the grade of Division Street, as fixed above and shall. descend at the
rate of five feet to each one hundred (100) feet until said grades interpept the present
grades of Walnut Street.
(3) The grade of Arnold Street where the same intersects thel tracks
of the New York Central Railread-Company shall be raised, five and eight tenth(508) feet
above the'top'of the highest rail of said tracks as now mainained; and the grade of Arnold
Street where the same intersects the tracks of the Grand Trunk Western Railway Company shall
be raised six and one tenth (6.l) feet above the top of the highest rail of said tracks as
now maintained; and the grade of Arnold Street where the same intersects the tracks of the
New York Central Railroad Company formerly the Chicago„ Indiana and Southern Railroad
Company shall be raised not to exceed six (6) feet above the top of.'the highest rail of said
tracks as now maintained; end the grade of said street, where it intersects tAe switch'
track of the New York Central Railroad Company leading into the Oliver Chilled, Flow Works,
shall be raised not to exceed six (6) feet above the top of the.highest ra 1 of said swt�ch
track as now maintained, and the tracks of said companies across said strut at said points
when changed as provided herein. The grade of said street north From the northerly rail of
the tracks of the New York Central Railrpaid Compqny shall be a descending grade of five (5)
feet to each one hundred (100) feet urt.fi it intersects the present street grade; and the
grade of said street south shall be a descending grade from the southerlyrail of the last
above mentioned railroad, to a point midway beween said rail and the nor4herl7. rail Of
the Railroad of the Grand Tru nk Western Railway Company which point shall be two and eight
tenths (2,e) feet higher than the present high Tail of the New York Central'Railremd Company;:
and the Grade from said last, mentioned paint shall be an ascending grade the southerly rail

lime to. the northerly rail of the tracks of the New York Central Railroad company,formerly

above mentioned point shall be a straight line to the. northerly rail of the switch tfick
of the New York Central Rail.=W road Company leading to the Oliver Chilled Plew Works; and
and the grade of said street from the southerly rail of the last above mentioned
track shall be a descending grade of five (5) feet to. each one hundred (100) feet
uz:til it intersects the present,grade. The grade of Hancock Street, which inter-
sects Arnold. Street on the east siege, shall be •raisod so' as to conform to the grade
of Arnold.Street as fixed above and theme descend at the rate of five (5)-feet to
each one .hundred (100) feet until it intersects the present street grade of Hancock
Street. The grade of Huron Street, which Intersects Arnold Street on the west side,
shall be changed sous to conform to the grade of Arnold Street as fixed above,
and then descend at the rate of five (5) feet to each one hundred (100) feet until
It intersects the present street grade of Huron Street.
(�+) Chapin Street.at the interse etion of Chaplin Street and the
tracks of said railroad the surface of 'said street shall be depressed seven feet
below the top of the highest rail of the tracks at said intersection as now maintain
ed; clearance shall be fifteen (15) feet between the surface of the street as fixed
above and the superstructure over said street; the grade of said street under the
'superstructure -shall be level. The grade of the approach of said, street north shall
be a level grade from the north line of the superstructure to a point sixty (60)
feet north of the north line of Donn Street. The grade of the approach on the
south shall be level to a point twenty five feet south of the south line of the
superstructure and shall then be an ascending grade two and one half (21) feet to
each one hundred (100) feet until It intersects the present -grade of the street,
(5) The grade of Dunn Street, which intersects Chapin Street at a
point immediately north of the tracks of said'railroad, shall be changed and the
grade east Itrom the east line of Chapin Street as fixed at No. 4 above, shall be
an ascending grade three (3) feet in each one hundred (100) feet until.it intersects
the present grade of Dunn Street.
(6) Scott Street. At the intersection of Scott Street and the
tracks of said "railroad the surface of said street shall be depressed three (3) .
feet below the top: of the h*ghost rail of the tracks of said interseot�oh as noli
maintained; clearance shall be twelve and one-half (1*) feet betwee n the surface
of the street as fixes Above and the superstructure over said street; the grade
of the approach of said street north from the north'line of the superstructure
shall be a straight line until it intersects the present grade of Scott Street, at
the south line of Dunn Street, and the grade of the albproaeh from the south line of
the superstructure shall be a straight line until it intersects the present grade
of Scott Street at the north line of Ford Street.
(7) The grade of -the first alley north of Ford Street, which alley.
intersects Chapin Street and Scott Street, shall be changed and the grade of said
alley east from the east line of Chapin Street as established in No. 4 above sha
be an ascening grade of three (3) feet to each one hundred (100) feet until It
intersects the present grade of,said alley; and the grade of said alley west of the
west line of Scott Street,as established in No. 6 above, shall be an ascending
grade of three (3) feet to each one hundred (100) feet until it intersects the
present grade ofsaid alley.
(8) PRAIRIE AVENUE, At the intersection of Prairie Avenue and the
tracks of said railroad the surface of said street shall be depressed six (6) feel._
and nine (9) inches below. the top of the highest rail of the.traok le d4.ng to the
Stuebaker Plant, where the same intersects the center line of said P irie Avenue,
at .the elevation now maintained; clearance shall be twelve and one half (1 �) feet
between the surface of the street as Fixed above and the superstructure of he_traoks
leading to the team yard and Stidebaker.Plant; the grade pf,the approach of said
street north from the north line of the superstructure carrying" the tracks to the -
team yard and Studebaker Plant shall be an ascending grade of three (3) feet each
one hundred (100) feet; then grade of the appDeaeh .south from the south line of the
southerlysu ertructure shall be an a.seending grade of three (3) feet to each one
hundred 100) LLf&et until it intersects the present grade df Prairie Avenue.
(�) The grade of South Street which intersects Scott Street and
Prairie Ave., shall be changed and the grade of said South Street east from the
east line of Scott Street, as established at no. 6 above shall be an ascending
grade of three (3) feel, to each one hundred (100) feet until it%intersects the
present street grade of South Street, and the grades of said South Street east and
west of Prairie Avenue, as established at No. 8 above, shall be ascending grades of
three (3) feet toeach one hundred (100) feet Bash way east and w4est, until they in-
tersect the present grades of South Street.
(10) The grade'of„Taylor Street, which intersects Prairie Avenue,
shall be changed* beginning at the grade of said Prairie Avenue'as established at No,
e above,, there shall be an ascending grade north of three (3) feet to each one
hundred (100) until it intersects the present grade of said street.

(11) LAFAYETTE STREET. At the intersection of LaFayette Street and the
tracks of said railroad, the sur,faee of said street shall be depressed t7O and one tenth
(2.1) feet below the top of the highest rail of the tracks of said intersections as now
maintained; clearance shall be twelve and one half (12�) feet between the surface of the
street as fixed above.and.the: superstructure over said street; the grade{ at, the approach
of said street north fromthe north line of the superstructure shall be a straight line
until it intersects the present street grade at, the south line of South Street, and tho-

to conform with the grade of the north line o Sample Street as fixed at No. 180above
and the grade of the approach of said street north shall be a level grade from the
north line of Sample Street to the northerly line of the.right of way (of 'said
railroad and the grade of Rush Street where the same intersects the south line of
Sample Street shall be depressed to conform with the grade of the south line of
Sample Street as fixed at No. 18 above, and the grade of the approach of said
street south shall be a straight line from the south line ag Sample Street to the
north line of Ohio Street. Clearance shall be not less than twelve and one half
(12�) feet between the surface "of the street. as fixed above and the bottom of the
superstructure over said street.
(20);"The grade of Angle Street which intersects both Sample Street
and Rush Street shall -be changed so that it.shall ooAform to the trade of Sample

19 above, and.the grade -of said street between the points as fixed above shall be
a straight line. The grade of the first alley south of Sample Street, -which inter-
sects Rush Street on the Rest side be changed so as to conform to the grade of Rush
Street as established at No. 19 above, and then ascend to the west, at the rate of.
five,(5) feet to,each one hundred (100).feet.until it intersects the present grade
of the alley. The grade of the first alley east of Fellows Street which inter-,.

(21) OHIO STREET.* At the intersection of Ohio Street and the tracks
of said railway the surface of said street shall be depressed three (3) feet below
the top of the highest rail of the tracks at. said intersection as now maint�lned;
clearance shall .be twelve and one half (12-) feet between the surface of th6 street
as fixed above and the bottom of the superstructure over said street; the grade of
the approaches to the east and the west of the superstructure shall be a level grade
until i1,,intersects the present grade of Ohio Street.

the tracks of said railroad, the surface of said street shall be depressed three
(3) feet below the top of the highest r-4ii of the tracks at said intersection as now

23) HIGH STREET.., At the intersection of High. Stree-t and the

feet below the top of the highest rail of the tracks at said intersection as now
maintained; clearance shall be fourteen (14) feet between the surface of, -the street
as fixed above and the bottom of the superstructure over adid street, the grade of
the'approaoh of said street'north from the north line of the superstruoture shall be
a level grade to the center of the first alley south of Ohio Street and theta a
descending grade of two and one half (21) feet to'eaeh one hundred (100)'feet to

(24) -The Grade of Keasey Street where the same intersects the west
line of High Street shall be changed so as to conform to thegradeof High Street
as fixed in No. 23 above, and the grade of said street west from the west line of
High Street hhall be an ascending grade of three (3) feet to each one hundred 0100).

company across said street shall braised to conform to, the grade of said street
when changed as provided herein. The Arades of said street from the northerly and

and southerly rails of said tracks shall respectively be descending grades of six (6)
feet to each one hundred (100) feet until they intersect the present street grades of Miami
Street. The grade of Brook Street which intersects Miami Street on the west side shall be
changed so as to conform to the grade of Miami Street and then descend at the rate of eight
(8) feet to each one hundred (100) feet until'it intersects the present grade of Brook
Street. .
(26) The.grade of Marine Street,where the same intersects the tracks
of said railroad shall be raised three and three i,enth (3-_ 10) Feet glove the top of the
highest rail of said tracks as now maintained, and the trakks of said Company across said
street shall be raised to conform to the grade of said street when changed as provided
herein. 4
(27) The tracks of.the GRAND' TRUNK WESTERN RAILWAY COMPANY and the -NEW YORK
CENTRAL RAILROAD COMPANY at Vhepoint where they cross just east of Arnold Street shall be
raised six and one ahlf,(6 ) feet above the top of the rails of the orpssing frogs as now
maintained at said crossing; and the tracks of said railways shall be raised to conform to
the grade of said crossing point when changed as provided herein.*
(28) The grade of DIVISION STREET shall be changed, beginning at a point one
hundred (100) feet east of the east line of Pine Street and then ascending seven tenths
(0.7) of a foot in each one hundred (100) feet to the west line of Laurel Street, at.which
point the raise in the grade of Laurel Street shall not exceed three and four tenths (34)
feet above the present grade of the tracks of the Grand Trunk Western Railway 0ompany,
The gRade of Division Street; from the lAst above mentioned point, shall be a descending
grade 6 five (5) feet in each one hundred (100) feet, until it intersects the present
grade of Division Street west of Laurel Street; and the grade of Laurel Street shall be change
so as to Sonform to the grade of Division Street, and on each side of Division Street shall
be descending grades of five (5) feet to each one hundred (100) feet, until they intersect
the present street grades of Laurel Street. The grade of Pine Street which intersects
Division Street and the tracks of the Grand Trunk Western Railway'Companys shail_.be changed so
as to conform to the grade of Division Street as hereon established and shall descend from
each side thereof at the rate of five (5) feet in egoh one.bundrtd 1100) feet, until it inter-
sects the present grade of Pine Street.
(29$ That the tracks of the different railroads herein referred to shall be
raised so as to conform to the different street grades as herein fixed.
t(30) That all streets over which the tracks of the New York Central Railroad
Company are Required Uy this resolution to be raised or elevat*dt shall have the full
amount of the elearnace as provided for in -this resolution for each of said streets forthe
full width beneath the superstructure, an4---that at all points where there is a change in
the direction of street 'grades as fixed above suitable allowances shall be made for vertical
curves.
(31) And.the tracks of the Terre Haute and Logansport Railroad Company
now Pennsylvania Railroad Company), Indiana Northern Railway CompAnys Oliver Chilled Plow
Company and Studebaker Corporations whose trasekw interseot.or connect with the tracks of the
New York Central Railroad Company, if said companies of any them, shall desire to keep and
maintain said eonnneetions, shall be raised so as to conform to the grades of said New York
Central Railroad Company as herein established and mage proper connections with saute.
(32) That the said improvement shall be made and paid for sccording to the
method and manner provided for in an Act of the General.Assembly of Indiana of 1923, Page
110, or any other law applicable thereto.
TYat the Chicago, South Bend and Northern Indiana Railway Company, which
maintains street car tracks at Chapin.Street and Michigan Street, where the same intersect
the tracks of said Railroad.Company be and is hereby'ordered to reconstruct its tracks accord-
Igg to the grades herein provided fors and shall pay five (5) per cent -Of the cost of the
alteration of such grade crossings at such intersections.
All other resolutions heretofore adopted by the Board of PUblie Works
for the separation of tracks from the grades of any streets be and are hereby rescinded.
BE IT FURTMERESOLV'ED, That notice of the time and place for public
consideration of this resolution be given in the manner provided by law. Notice of this
resolution shall be published on the 2nd. day of February 1924 and on the 9th. day of
February 1924 in the South Bend Daily Tribune and the South Bend News Times.

CENTRAL RAILROAD.
Notice is hereby given that on the 29th. day of January 1924
the Board of Public Works of -the city of'South Bend,:Indiana adopted a resolution
as authroized by Chapter,,36q of the Acts of the General Assembly of the State of
Indians of the year 1923`, for;t�e separation of the grade crossings if the New
York central Railroad Company and the following named streets in said City.
Chapin Street, Scott Street, Prairie Avenue, Lafayette Street,
Marvin Street, Bronson Street, Michigan Street, Fellows Streets Sample Street,
Rush Street, Ohio Street, Marietta Street and High Street.
Notice is further &Piven that the said Board has fixed February
27th. ,1924 at 7:i0 P. M. at their office in the City Hall of said City as a time
and place at which said Board will receive and hear remonstrances from all persons
interested in and affected by -such improvement, and when it trill determine the
public necessity sad convenience thereof. A copy ,of such resolution -is now on
file in the office of said Board Otr Public inspection.
