Messrs Lantz and Schrock , J. W. Fites and Mayor Seebirt present. Contract signed as follows by the Board and ordered referred to the Common Counoil for ratification. • A•GREEM£NT. This agreement made this 15th, day of January, 1924 by and between the City of South Bend, Indiana by and through its Board of Public Works, herein- after designated as the " City" and Ephraim Lantzs,Alva Lantz and.Christ Sohrooks a ppartnership doing business under the name, style and title of Lantx Brothers and Schrock, hereinafter designated as the " Contractor, " witnesseth: l T�+he City undertakes and agreeT Ileat� all garbage and soak' dead animals within its corporate limits under the oondl4lons and in the manner provid*d in - the detailed specifications attached hereto, and to deliver all garbago_.. so olleated to the contrao o at a central station located in the City of S©u.Lh' Ben, for a period of Five 5 years from the 1st day of May,'1924. 2 The contractor in constdoration of the foregoing agreement on the part of said City agrees.to accept all such rba a so collected at said station f and to remove the same so a point at least one (1) mfles from the City limits in the manner and subject to the oorAltions contained in the General and Detailed specifications hereto a ttsohed, and to remove all of said garbage free from charge to the City of South Bend, In the event that said City shall collect garbage from hotels, restaurants, boarding housesa stoop as provided in paragraph 3-of this contracts and shall deliver the same &t the Central Station separated from household arbage contractor agrees to pay for all,sueh.garbage so collected and delivered to Lhle central Stations the sum of Fifty-five cents per ton of Two Thousand.pounds. An Authorised inspector for the City shall weigh all such garbage and keep an accurate daily account thereof in triplicate one copy of which shall be delivered to the contractor each day, provided if botA parties hereto shall agrees the weight of such garbage may be estimated by said inspector as to each load or tank and reported by number only. 3. It is further agreed that during the term of this contract that l the City shall not enter into a contract with any other person firm or corporation for collecting or removing garbage from the said city or for tie sale of garbage. 4 It is onw of the conditions of this contract that all garbage and shall 4e0 anlmlas collected byy the City eat. said station steal bo removed by the contractor not later than twelve (.12:00) o'clock noon on the day Following its collection and if the contractor shall fail or refuse to comply with this condition he shall pay to the Cityas ascertained and liquidated damages the sum of $100,00 for each such failure or refusal. 5. It is agreed by and between the parties hereto that the terms, conditions and provisions of the General and'Detailed specifioations`are a part of this contract and enfora*able as such to the same extent as if incorporated herein. 6. The ontraetor ma at his option,'extend the term of this contract for an additional period of five (5T years provided that if the said contractor'shall elect to avail himself of said option, he shall give notice thereof .to the Board of Public Works of said City of such election at least six months prior to May 1st.9 1929. IL is stipulated and agreed that the bonds required by Item 6 of the General Specifications Wky be executed by said contractor to the approval of the Board of Public Works for a period of O:ie (1) year at a time but the said contractor shall. be required to execute a like bond at the end of each year and to keep such pond in fore* throughout the term of this contract or any extension thereof. 7. This contract shall not - be valid and bdAAdifig until ratified by a proper ordinance .of the Common Cpuneil of said City, and unti the Bond to be given by the Contractor -it filed and approved by the Board of Public. Henry permission to attend the Convention at Omaha, Rebr. and the expense of said trip to be paid out of the Convention Fond. The Board duly appointed J. W. Fites Street Commissioner of this City said appointment to become effective from Janue&ry lst., 1924. Board increased John Vernon's sik"ry Four.($4.00) per month to take care of the telephone rental effective from January lst., 1924. The Board duly appointed Wm. F. Qualls as Pole and Wire Inspector same to become effective from this 15th. day of January 1924. Board appointed Philip Bondurant, Ed Neddo and A.
