Sine the designing of said sevrer system and the letting of the contract a substantial facto -y building has been constructbd on the southerly side of Sample Street at the 'i heaao�, <Cenmore Street and this effectively blocks -Kenmore Street south of vam_:ple Street as Well as the extension of the se% er. I� This petitioner now shows that in view of these changed conditions which c'©uld not have been anticipated at the time of the designing of said sewer system and the. J letting of the contract, an emergency has arisen *'or a slight change in the southerly portion of said sewer system. it shoos that because of this changed condition a 42 inch serer pipe in Kenmore Street between Ford and Sample &'treet is a useless expense. I� It also respectfully shows that because of said change in conditions the size of the pipe should be increased from that contemplated in the said system from Kenmore Street west to Gladstone Avenue on ford Street. i This Corporation further represents that it owns all of the real estate along .Kenmore Street between Ford and Sample Street and along the south side i of Ford. Street between-'enmore Street and Gladstone Avenue. Colpaert" li ! j The following resolution was introduced and upon Being duly put was carried by the unanimous vote of the Board. , ftFi°.;R�.S, the Colpaert Realty Corporation has petitioned for a changei� in the construction of the Northwest Sewer along Kenmore Street from Ford Street to sample street and of Ford Street from Kenmore Avenue to Gladstone Avenue; and i 'MERM&S, the Dunnegan Construction Company, contractors for the construction of the Northwest serer, have filed their written consent to said change;aad�) 7,7`ER7AS1 this Board believes that because of the construction of a ii factory building along the line of Kenmore Street ;_projected south an emergency has arise which requires a change in the plans for the construction of said sewer; and I iH _R SAS, this Board is of the opinion that the change will injure j� no one, and will affect no real estate save that : hich is owned by the Colpaert Realty j! Corporation and will be to the advantage of all the property in the Northwest Sewer District because it will mean a reduction in the cost of the said sewer of about Twelve �I Thousand Nine Hundred and Twenty-eight Dollars (12,928.00). iI NOV7, TH BEFORE, BE IT RESOLVED that the Dunnegan Construction Company 11 be hereby ordered not to construct the sewer on Kenmore Street from Ford Street to I 1 Sample Street and that it increase the size of the se-ier pipe on Ford Street between Kenmore Street and Sheridan Avenue from 30 inches to 42 inches, and between Sheridan. Ave' enue to Gladstone Avenue from 27 inches to 30 inches, the cost of said 42 inch pipe and 36 inch pipe to be in accordance with it's contract and that no allowance whatever be made said Construction Company because of the elimination of the sewer on -Kenmore !I Avenue south of Ford Street or because of the fact that the 27 inch size pipe is not j used on Ford Street."
