Assessment roll for the grade, curb and walk improvement on

Assessment. roll for the grade, curb and walk improvement on
Brookfield Street from Hamilton wtreet to `ffilson Street under .Improvement Resolution

Assessment roll for the local sewer on 2Ist., Street from Jefferson
Blvd., to Colfax Avenue under Improvement Resolution No.I920.
Assessment .roll for the local sewer on Twentieth Street from
Jefferson Blvd., to McKinley Avenue under Improvement Resolution No.I92I.
Assessment roll for the local sewer on McKinley Avenue from
Greenlawn Avenue to Twenty-second Street under Improvement Resolution No.I9I9.
Assessment roll for the pipe sewer on 1�unham street from kaley
Street to a point IO feet east of west line of Lot 964 Summit Plade Third Plat under
Improvement Resolution No.I933.
In all of the above named assessment rolls, no remonstrators
appeared and no written remonstrance was filed and the Board, being fully advised in
the premises, finds that the several lots and parcels of land primarily assessed for
said improvements have been benefited in the amounts named on said assessment rolls.
The Board, therefore, takes final action on said assessment rolls and declares same in
all things ratified, confirmed and approved without modification and the proceedings
closed. The Board now.orders said assessment rolls delivered to the Department of
Finance.
This being the date set, continued 'nearing was had on the assess-
ment roll for the pavement of the first alley south of Napier Street from Walnut Street
to Laurel Street under Improvement Resolution No.I873.
In the above named assessment roll no remonstrators appeared and
no written remonstrance was filed and the Board being fully advised in the premises
finds that the several lots and parcels of land primarily assessed for said improvement
have been benefited in the amounts named on said roll. The Board, therefore, takes
final action on same, declaring said assessment roll in all things ratified, confirmed
and approved and the proceedings closed.

This being the date set, continued hearing was had on the assess-
ment roll for the grade; curb and walk improvement on ','hi c.go 'Itreet from Division kre t
to Jefferson Blvd.j under "Improvement Resolution hlo.I829. In the above named assessmen
roll, the Board decides to continue hearing on same until rebruary 8th., I928.
The Board signed the contract with the Indiana and ?Michigan
Electric Company for lighting streets, alleys, boulevards and public places in Coquillall-d
Iffoods Addition to the City of South Bend, Indiana. Contract as follows;

This agreement, made and entered into this I8th. , day of January
I928, bet the City of South Bend, .a municipal corporation of the State of Indiana,
by and through its Board of Public Works, part3x of the first part, hereinafter referred
to as the City, and Indiana and Michigan Electric Co., party of the second part, herei.

WI TNESSETH.
That the parties hereto, each in consideration of the agreements
on the part of the other, herein contained, have mutually agreed and hereby mutually
agree as follows:

I. The "ontractor shall provide and maintain a street lighting j
system in Coquillard Idoods Addition to the City of South Bend, Indiana, consisting of I
fifty (50) street lamps supplied from an underground distribution system of the
Contractor, such underground lamps shall be as follows:

50 - IO ft., Sheridan Hollow Spun, Concrete Lighting Statftros
�I with Octagonal Junior Lighting Units and Medium FiuMple Sockets
and equipped with I- I000 Lumen light (75 'Watt) Street lighting
lamp or equivalent lamp.

All property used in the performance of this contract shall be and
remain the property of the Contractor, The Contractor shall at its cost furnish all
lamp renewals and light all lamps herein provided for by electricity for a period
terminating with the termination of the general contract for street lighting.
Ali of the lamps which shall be provided and maintained by this
Contractor shall be so operated so that they Will give the maximum amount of illumina-
tion obtainable under commercial conditions
2• All lamps herein provided for shall be burned from one half
hour after sunset until one halff hour before sunrise every night and all night,'burn ng
approximately four thousand (4000) hours per annum.
3. The number of lamps furnished and lighted under this contract
shall be the number provided for in Paragraph I hereof and shall be located as shown
on the blue print attached hereto and identified by the signatures of the Contractor
and Members of the Board of Public Works.
4. All outages shall be reported daily in writing by the proper
officers of the City to th e Contractor and the proper officers of the City may deduct
from the total monthly amount which would have been paid for any lamp so reported had
no outages occured, the sum beafthg the ratio to such total as the period of outages
bears td the total time the lamp would have been lighted in any month.
5. Street lighting units herein contracted for shall be moved by
the Contractor to aueh new locations as the City may by writing direct, subject to
the following conditions:
Such moving of lamps shall be completed within thirty (30) days after
receipt by Contractor of written notice from the City, Sundays, legalrhblidays and
stormy days not to be counted, provided that the number of such removals shall not
exceed one per day and provided further that such removals shall not be required on
Zundays, legal holidays and stormy days. Notice of the work of such removal of lamps
has been completed shall be given the Contractor to the City within tbn days after
the completion of the work.
The actual cost to the Contractor of making such relocations shall
be paid by the City to the Contractor within thirty days after said notice has been
given.
6. The L'ity shall accept such lamps and the services herein specifi-
ed during the life of this contract and pay as full compensation hhereof, at the rate
and price set out in the acdeptedr°bid to -wit:
For underground street lighting units.
50 - IO.ft., Sheridan Hollow spun Concrete Lighting Standards with
Octagonal Junior Lighting Units and Medium Multiple Sockets and
equipped with I-1000(-Lumen (7517att) Street Lighting Lamp or equiva
lent. $30.00 per unit per annum.
Payment for all lighting services to be made in equal monthly install
meats, each installment to be due and payable on-Urabefore the 20th. , day' if each
month sucoedding that in which the service is rendered.
7.The Contractor shall have the right with the consent of the Board
of Public Works of the City of South Bed, at any time during the life of this contract
to install, operate and maintain in the place of the lamps herein provided for, and
under the same terms and conditions, other and more improved lamps in keeping with
such advancement as may be made in the art of lighting, which lamps shall be equivalent
or greater illuminating power.
8.In authorizing or granting a permit to any person, firm or copporatio
to repair or cut into any street, alley or sidewalk in which said street lighting
units and lines and cables supplying current thereto are located, the City shall
require, as a condi ion to the granting of such permit, an agreement on the --part of
the applicant that such lines and cables and street lighting units will not be inter-
ferred with in any manner without notice to the Contractor.
99 All covenants, expressions, terms, conditions provisions and
agreements herein shall extend to and be bbmding. ypon and inure to the benefit of, as
the case may be, each and every oage of the successors or assigns of each of the parties
hereto as if in every case so expressed.
I0. This contract shall be in force and effect from and after it's
approval by ordinance for a period terminating at the termination of the general street
lighting contract.
IN IffITNESS 01HEREOP, the City of 6guth Bend, Indiana, has caused its
corporate seal to hereunto affixed and this contract -to be signed by the Board of
Public Works of said City and said .Indiana and Michigan Electric Company has caused
this contract to be duly executed, in duplicate, this day and year first written

a resolution for the Vacation of Washington Avenue' from Niles Avenue to the east race
under Vacation Resolution No.I984.4 (See files for Copy of resolution.)
In the above named Vacation Resolution, the Board hereby orders
that on the l4th,,,day of February,, 1928, this Board will meet in their office in the
City Hall at 10.-00 A. lv%. to hear and receive remonstrancesfrom all persons interested
in or, affected by said vacation. The Board further orders that notices of said hearing
shall be published in the South Bend News Times and Tribune on the 21st.,, day of January:l�

U on the approval of City Attorney, I. S. Romig, the Board signed
a claim amounting to 12,250.00 filed by Lorenz Lederelt in payment of the balance of
the judgement in Superior Count No.j in regard to the William Street Opening. This
amount to be paid out of the Appropriation No-H-23 for Refunds, awards -and Uderinities
appropriated to t tment of Public Works.
