Board met in regular session at 7-15 P. Y, All members present.
Due to the large number of persons present the meeting adjourned to
the Council Chambers.
This being the date set, hearin-_s were had on the following improve-
ment resolutions:
Improvement Resolution No.I962 for the construction of a local sewer
on Anderson Avenue between Elwood Avenue knd King Street. (See files for copy of
resolution.)
Improvement Resolution No.I955 for the pavement on Bertrand Street
from Johnson Street to Bendix Drive. (See files for copy of resolution.)
Improvement Resolution No.I956. for the grade, curb and walk improve-
ment on High Street from Fairview Avenue to Donmoyer Avenue. (See files for copy of
resolution.)
In all of the above named improvement resolutions, no remonstrators
appeared and no written remonstrances were filed, and the Board, being fully advised
In the premises, finds that the benefits to the several lots and parcels of land
liable to be assessed for said improvement will be equal to the estimated coats of
same as reported by the City Engineer. The Board, therefore, takes final action on
said Improvement Resolutions No.I962, No.I955 and No.I956, and declares same in all
things ratified, confirmed and approved without modification.
This being the date set, hearing was had on Improvement Resolution
No.I964 for the pavement of Kinyon Street from Portage Avenue to first alley west of
Medora Street.
In the above named improvement -`resolution, remonstrators appeared
and the Board being fully advised in the premises, decides to rescind all former actic
taken on said improvement resolution and declares same null and void and the proceeding
closed.
This being the date set, h6e ring was had on Improvement Resolution
No.I963 for the pavement of Queen Street from Portage Avenue to Blaine Avenue.
In the above named improvement resolution, the Board decides to
dontinue hearing on same for two weeks and sets November I6th., 1927, as the time
when -final action will be taken on said improvement resolution.
This being the date set, hearing was had on Improvement Resolution
No.I959 for the pavement of the alley west of Maple Street from Napier Street to alley
north of Jefferson Blvd.
In the above named improvement resolution, remonstrators appeared an
a written remonstrance was filed and the Board being fully advised in the premises,
finds that the several lots and parcels of land liable to be assessed for said impro-
vement, will be benefited in accordance with the estimated cost of same as reported by
the City Engineer. The Board therefore, decides to over rule said remonstrance and
declares said improvement resolution in all things ratified, confirmed and approved.
The Board orders written ..emons-trancedfiled with Cit-.,- Engineer for final check.
This being the date set, hearing was had on Improvement Resolution
No.2960 for the grading of the alley west of Wilber street from Humbolt Street to Elwo
Avenue.
In the above named improvement resolution, remonstrators appeared

and the Board being fully advised in the premises, decides to modify said resolution
to read "from Humbolt Street to the first alley north of Humbolt". The Board, therefore,
takes final action on said modified resolution, declaring same in all things ratified,
confirmed and approved as modified.
The Board signed the contract with .Hoban and Roach for the pavement
of the first alley north of Marion Street from Main street to the first alley east of
Main Street under Improvement Resolution No.I958. The amount of the contract being
572.70 and the construction bond for 100% f the eontrac t price signed by the Southe.
Surety Co., was also approved and signed by the Board.
City Engineer, Mr. H. G. gray, filed partial estimate No.I for the
pavement improvement on Parry Street from Division Street to the fifth alley south of
Division Street, in accordance with the contrast between the City and Williston Construct-
ion Co., under Improvement Resolution No.I897. Board signed and approved same in the
amount of I0,187.50.
City Engineer, Mr. H. G. Wray, filed partial estimate No.I for the
pavement improvement on Ewing Avenue from Michigan Street to the west line of Franklin
Street, in accordance with the terms of the contract between the City and Williston
Construction Co., under Improvement Resolution No.I899. Board signed and approved
same in the amount of I7,28I.01.

Bids having been received fDr the construction of pavement on McKinley Avenue
from Greenlawn to Twenty-second Street under Improvement. Resolution No.I923, the
Board, this 2nd. , day of November, I927 , hereby makes a preliminary order for sheet
asphalt pavement as the type of pavement with which said street shall be improved .and
sets the I5th., day of November I927, as the time .when said Board shall either pass
on petitions for a change of type of pavement other than that specified in the prelim-
inary order, award the contract or reject all bids.
The Board approved the following Guarantee Bonds:
Guarantee Bond for the constructionof pavement on Bertrand Street from Bendix
Drive to Nangy Street under Improvement Resolution No.I902. Bond for 10% of the
construction cost signed by Hoban and Roach and executed by Southern Surety Company.
Guarantee Bond of Albert Construction Company for the pavement on Frances Street
from Sorin Street to South Bend Avenue under Improvement Resolution No.I864. Bond for I
10% of the construction cost signed by Inland Bonding Company.
City Engineer, Mr. H. G. Wray, submitted a report on the remonstrance filed against
the pavement of 35th., street frim Mishawaka Avenue to North Side Boulevard. Report
as follows:
"There are 29 residnnt property o�rrners on this street, I9 of whom have signed
the remonstrance. This constitutes a majority and I would therefore recommend that
no further action be taken in the matter.

i; Mr. H. G. Wray, presented a petition forthe improvement of Kinyon Street, Anderso

Street and Medora street with the following recommendation:

"Attached hereto you will please find a peition for the improvement of Kinyon St.

Anderson Street and Medora Street, representing all of the streets in the plat of Morri
Park Addition.
This petition has been preperly signed by 55% of the lot owners in the above
addition and I would respectfuly recommend that the engineer, Mr. C. W. Cole, be advise
that this petition bLas been accepted and that it is agreeable with the Boardoof Works
for him to prepare the necessary resolution, plan and estimate for the improvement
as above mentioned.

The Board approved this recommendation of City Engineer, Mr. H. G. Wray, and
the clerk is instructed to advise Chas. W. Cole that it is agreeable with the Board

written remonstrances were filed and the Board being fully advised in the premises,
finds that the several lots and parcels of land primarily assessed for said improve-
ments have been benefited in. the amounts shown on said rolls., The Board, therefore,

This being the date set hearin was had on the assessment roll for the
pavement of the alleys in Summit Place Fifth �ddition under Improvement Resolution
No. I88I.
In the above named assessment roll, one remonstrator appeared but no
written remonstrance was filed and the Board being fully advised in the premises, finds
that the severalllots and parcels of land primarily assessed for said improvement have
been benefited in the amounts named on said roll. The Board, therefore, over rules
the remonstrance and takes final action on said assessment,roll and declares same in
all things ratified, confirmed and approved and the proceedings closed. The Board
now orders said -assessment roll delivered to the Department of Finance.
City Engineer, 12r. H. G. Wray, filed the following primary assessment ;I
rolls:
Assessment roll for the pavement of Washington Avenue from Yldade Street
Street to Daley 6treet under Improvement Resolution No.I892.
Assessment roll for the pavement of Rolland Street from Meade 6treet to j S
Kaley Street under Improvement Resolution No.I895.
Assessment roll for the pavement of Main Street from Ewing Avenue to
Fairview Avenue under Improvement Resolution No.I909.
Assessment roll for the pavement of Newcome Street from Meade Street to
Raley Street under Improvement Resolution No.I9I2.
In all of the above named assessment rolls, the Board hereby orders that
on the 9th., day of November, 1927, this Board will meet in their office in the City
Hall at 7-I5 P. IA., to hear and receive remonstrances from all persons whose property
has been assessed for said improvements and will decide whether the several lots and
parcels of land primarily assessed for said improvements have been or will be benefited"
in the amounts shot),rn on said assessment rolls or in a greater or less amount. The Boara
further order:°s that notices of said hearings on assessment rolls shall be published on
the 6th., day of November and on the 5th., day of November, 1927 in the South Bend
News Times and Tribune according to law.
City Engineer, Mr. H. G. Wray, filed primary assessment roll for the
construction of grade, curb, walk and pavement on &>herman, Rose, Roosevelt and Beale
Street under Improvement Resolution No.I79I.
In the above named assessment roll, the Board hereby orders that on the
9th., day of November, I927, this Board will meet in their office in the City. Hall at
7-I5 P. M., to hear and receive remonstrances from all persons whose property has
been assessed for said improvement and will decide whether the several lots and parcels;!
of land have been or will be benefited in the amounts shown on said assessment roll or
in a greater or less amount.
This being the date set, hearing was had..on the assessment roll for the
pavement on Frances Street from Lorin Street to South Bend Avenue under Improvement
Resolution No.I864.
In the above named assessment roll several remonstrators appeared but
no remonstrance was filed. Margaret Tavernier ovrner of the following described propertl •
was among the remonstrators:
"Beginning at S ff corner of Lot 5 Sorins Ist., a(Mition, thence north 40
feet, thence east I29.7 feet thence south 40 feet thence crest I29.7 feet to beginning."
After hearing all persons interested in said assessment roll, the Board
decides to reduce the assessment of Margaret Tavernier from 477,96 to 377.96 and the
pay the reduction out of the Appropriation for Refunds, awards and Damages, Appropriati
No. H23. With this modification, the Board finds that the other lots and parcels of
land primarily assessed for said improvement have been benefited in the amounts shown
on said assessment roll and therefore, the Board takes final action on said assessment
roll and declares same in all things ratified, confirmed and approved, as modified, and
the proceedings closed. The Board now orders said assessment roll delivered to the
Department of Finance.
City Engineer, Mr. H. G. `gray, filed the following assessment rolls:
Assessment roll for the pavement of Woodside Street from Fellows Street to
a point 120 feet west of the west line of Dale Street under Improvement Aesolution
No.I8I6.
Assessment roll for the pavement of Oakside Street from the west l-ine of
Fellows Street to Miami Street under Improvement Resolution No.I836.
In both of the above named assessment rolls, the Board hereby orders that
on ,the 8th. , day of November, 1927, this Board will meet in their office at 10:00 A,M, ,�
Vrednesday, November 2nd., 1927.
to hear and receive -remonstrances from all persons whose property has been assessed
for said improvement and will decide whether the several lots and parcels of land
primarily assessed for said improvements have been or will be benefited in the
amounts shown on said rolls or in a greater or less sum than that shown on said
primary assessment roll. The Board further orders that notices of said hearings shall
be pzblished on the 4th. , day of November and on the. 5th. , day of November, I927,
in the South Bend Tribune and News Times, according to law.

ment of the alley between Maple Street and Walnut Street from Division Street to

cost amounting to I3I.55 signed by the United States Filelity & Guaraitty Co., approved
ii and signed.
The Board approved the Contractors Bond of I,000.00 in favor of
Fred Corporan signed by the Employers Liability Assurance Co.

This being the date set, hearing was had on the assessment roll for.
the pavement improvement on Oa,kside Street from the west line of Fellows Street to
Miami street under Improvement Resolution No.I836.
In the above named assessment roll, Martha Iwan, property owner
was present and remonstrated against the assessment on her property but no written
remonstrance was filed. After hearing all persons interested in said assessment roll
and being fully advised in the premises, the Board finds that the several lots and
parcels of land primarily assessed for said improvement, have been benefited in the
amounts named on said assessment. The Board, therefore, takes final action or, said
assessment roll and declares same in all things ratified, confirmed and approved and
