Board met in regular session at 9 A. M. All members present.
This being the date set, hearings were had on the following
Assessment roll for the construction of a sewer on Sherman
Avenue from Kinyon. Street to the River under Improvement Resolution No.I77I.
Assessment roll for the construction of s sewer on Kinyon
Street from Sherman Avenue to a point 20 feet west of the east line of Lot I86 Northwest
Addition under Improvement Resolution No.I85I.
In both of the above named assessment rolls, no remonstrators
appeared and no written remonstrance was filed, and the Board, being fully advised in
the premises, finds that the ' several lots and parcels of land primarily assessed for
said improvements have been benefited in the amounts shown onsaid assessment rolls.
The Board, therefore, takes final action on said assessment rolls, and declares same
in all things ratified, confirmed. and approved and the proceedings closed. The Board
now orders that said assessment roils be delivered to the Department of Finance.
This being the date set, continued hearings were had on the
following assessment rolls:
Assessment roll for the Pipe sewer Improvement on Altgeld Street.
from Marine Street to the Southeast Trunk Sewer under Improvement Resolution No.1788.
Assessment roll- for the Pipe sewer improtrement on Victoria St. ,
from Miami Street to the Southeast Trunk Sewer under Improvement Resolution No.I789.
In both of the above named assessment rolls, no remonstrators
appeared and no written remonstrance was filed, and the Board, being fully advised in
the premises, finds that the several lots and parcels of land primarily assessed for
said improvements have been benefited in the amounts shown on said rolls. The Board,
therefore, takes final action on said assessment rolls, and declares same in all things
ratifked, confirmed and approved and the proceedings closed. The Board now orders that
said assessment rolls be delivered to the Department of finance.
The Board signed the following contracts and approved the
construction bo3ads of same:
Contract with the Williston Construction Co., for the sheet
asphalt pavement on Main Street from Erring Avenue to Routh line of Fairview Avenue
under Improvement Resolution No.I909. Amount of contract being 17,867,52 and the
construction bond for 50% of the contract price was signed by Inland Bonding Co.
Contract with the Williston Construction Co., for the sheet
asphalt pavement on Liston Street from Birdsell Street to Adams Street under Improvement
Resolution No.I925. Amount of contract being5,335.40 and t e construction bond for
50% of the contract price was signed by the Inland Bonding o.
Contract with the Williston Construction Co., for the sheet
asphalt pavement on Division Street from Perry Street to Eddy Street under Improvement
Resolution No.I9I3. Amount of contract being I,06905 nd the construction bond for
50% of the eontract.price was signed by Inland Bonding o.
Contract with Albert Construction Go., for the sheet asphalt
pavement on Kaley Street from south line of Division Street to the north line of
Sample Street under Improvement Resolution No.1922. Amount of contract being
35, 232.80 and the conttruction bond for 50% of the contract price was signed by Inland
Bonding Co.
Contract with Albert Construction Co., for the sheet asphalt
pavement on Newcome Street from west line of Meade street to the east line of Kaley
Street under Improvement Resolution No.I9I2. Amount of contract being 3,97I.80 and
the construction bond for 50% of the contract price was signed by Inland Bonding Co.
Contract with Albert Construction Co., for the sheet aspahlt
pavement on Kendall 6treet from Indiana to T. H. & L. R. R. under Improvement Resoluti
No.I908. Amount of contract being 3,729,60 and the construction bond for 50% of the
contract price was signed by Inland Bonding Co.

between the City and Rieth Riley Construction Co., under Improvement Resolution No.I888.
Board signed and approved same in the amount of 1,065.60.
Partial estimate No. 2, for .the pavement, grade, curb, walk on
Sherman Avenue, Bryan Street, Rose Street, Roosevelt Street and .Beale Street, in accord
ante with the terms of the contract between the City and J. W. Nees Company under
Improvement Resolution No.I79I. Board signed and approved some in the amount of
2I,080.00.
Partial estimate No. I for the pavement improvement on Twentyeighth

Street from Mishawaka Avenue to Grand Trunk & Western Railroad Co., in accordance with
the terms of the contract between the City and Rieth Riley Construction Co., under
Improvement Resolution No.I837. Board signed acid approved same in the amount of

Street from Mishawaka Avenue to Hildreth Street in accordance with the terms of the

in accordance with the terms of the contract between the City and Rieth Riley Construct
ion Co., under Improvement Res luti.on No.I8I4. Board signed and approved same in the
amount of $48,633.8I.
Partial estimate No.I for the pavement improvement on VanBuren Street
from C. I. &. S. R. R. to S ncome Avenue Andiaccordance with the terms of the emntract
between the City and Rieth Riley Construction Co., under Improvement Resolution No.I884.
Board signed and approved same in the .amount of 2,262,02,
Bids having been received for the construction of a local sewer on
Dunham Street from Kaley Street to a point IO feet east of the west line of Lot 964
Summit Place Addition under Improvement Resolution No.I933, the Board this 28th., day
of September 1927, hereby awards the contract for same to John Lugarise at his bid of
568.60.
Bids having been received for the construction of grade and walk on
Olive Street from Bergan Street to Nilson Street under Improvement Resolution No.I935
the Board this 28th. , day of September, I927, hereby awards the contract for said
improvement to E. T. Tranberg at his low bid of 2,288.54.

This being the date set, hearin was had onthe gissessment roll for t
pavement on Altgeld Street from west line of High kreet to Miami treet under Improve-
ment Resolution No.I843.
` In the above matter, the Board decides to continue hearing on same
until October I2th., I927, at 7-I5 P. M.
+1 City Engineer, Mr. H., G. Wray, filed plans and specifications and
it estimate and the Board adopted a resolution for the construction of a local sewer on
College Street from Elwood Avenue to Keller street under Improvement Resolution No.1954.
In the above named 4�provf�ext-resolution, the Board hereby orders
that on the I9th., day of October, I927, this Board will meet in their office in the
II City Hall at 7-I5 P. PST." to hear and receive remonstrances from all persons 'whose
• I property is liable to be assessed for said improvement and will decide whether the lots
and parcels of land liable to be assessed for said improvement will be benefited in
propertion to the estimated cost of same or in a greater or less amount. Board further
I orders that notices of said hearing shall be published on the 30th., day of September
II and on the 7th. , day of October, 1927, in the South Bend News Tames and Tribune.

The following petition was filed by Samuel Pett ngill, attorney
for 'the J. J. Dannegan Construction Co., in the matte of changing the line of. the
Northwest Trunk Sewer and upon the recommendation of ity Engineer, Mr. H. G. Wray,
the Board approved same. Petition is as follows:

Comes now J. J. Dunnegan Construction Co-., the contractor
under a certain contract dated March 23rd., I9270 by and between it as Contractor, and
the City of South Bend., Indiana, as City, through its Board of Public Works, and
respectfully shows to said Board the following. -
That Contractor is constructing said sewer under said cpntra
that according to said contract and the plans, specifications and profiles made a part
thereof, the line of said sewer as therein des gibed, at a certain point *hereof, runs
south along the center of Huey Street in said �ity to the intersection of Huey Street
with Frederickson Street; thence west at right angles along the center of Frederickson
Street to the intersection of said street with Olive Street; thence south at right angI
along the center of Olive Street to the intersection of said street with Westmore Stree
thence west at right angles along the center of Westmore Street.

That Olive Street along the line where said sewer will be
laid in accordance with said contract is 'paired and in constant daily use of traffic;
that there are houses on the north and south side of Frederickson Street along the
proposed line of said sewer and houses on the east side of Olive Street along the
proposed line of said sewer; that the digging of said sewer as proposed under said
contract, on account of its size and depth of excavation would greatly inconvenience
persons luring in the houses along the porposed line of said sewer; that to safeguard
said dwellings, steel sheeting, under good practice, might be necessary to be left to
support the foundations of said dwellings during and after the construction of said sewer;
that proceeding down Olive Street as proposed would involve the tearing up of the
pavement for a distance of two or three hu#dred feet and would make impossible traffic.!
on Olive Street while said works -was going on;- that the proposed line of sewer involves]
three right angles which to some extent are objedtionable in that they impede the flow
of sewage.
Your petitioner shows further that it woul be more advante4g-,!
eous to the public generally, to the persons owning property within said sewer district
and to those dgling in the residences along Frederickson street and Olive Street,
to change the course of said sewer as follows:
Instead of turning west at the intersection of Huey Street
with Frederickson Street, to proceedi directly south on Huey Street to a point a little,
south of the alley running east and west next south of Frederickson Street; thence pro-r
eeed, due west to the center of Olive Street and thence by a gentle angle to the center
og Westmore Street at that point nonneet with the line of said sewer as now under contract:
Thais by changing the line of said sewer the following advan- :'
tages will be had:
One right angle turn in place of three; crosking Olive
Street at nearly right angles rather than doing down the center of it lengthwise, thus
eliminating the tearing up of considerable pave*emt and making it possible to be on
Olive Street in the course of construction a mucheshorter period of time, thus cutting
off tr affic for a shorter period of time and entirely avoiding the inconvenience,
danger and expense involved with respect to the houses facing north and south on Fred-
erickson street and many of the houses facing west on Olive Street; that the lineal
feet of said sewer by reason of said change will be substantially the same; that the
cost of said sewer to the property owners in said sewer district will be no greater
and probably somewhat less that if said sewer were constructed along the line as set f
forth in said contract; and contractor, if this petition.be granted, agrees that the
cost of constructio# of said sewer by reason of said change will not be greater than
if it had been laid along the line as first contracted; that from ,Frederickson Street
to the alley next south along Huey Street, said sewer would not come in proximity
to any houses and along the alley between Huey Street and Olive street would not come
in close proximity to any dwelling except one.
That the property south of said alley neat south of Freder-
ickson Street is owned by Whitcomb and Feller, a corporation, and that the same is
undeveloped; that Whitcomb and Keller have consented to the change in the course of
said sewer as above described by their written consent attached hereto permitting said
sewer to be laid as now proposed, without any change in so far as their property may
be affected by reason of such change.
I Wherefore petitioner
p prays that said contract of March
23rd., 1927, be modified by permitting said sewer to be construction as above outlined
rather than along the course described in said contract, and agrees that by the a.pprova
of this petition by suitable resolution of said Board, said contract shall be modified
accordingly, to,take effect at once, but confirmed in all other things not inconsistent
with the change in the course of the said sewer.

on the alley next south from Frederickson street between Huey and Olive street, hereby
consent that a Public Improvement ContraZt, btining date of March 23rd. , I927, by
and between J. J. Dunnegan Construction o., omtractorm and the City of South Bend
Indiana, be modified in pursuance to the foregoing peitions of J. J. Dunnegan Const.,
Company; and agree that the course of said sewer be changed in accordance with said
petition and that the undersigned will make no change on account thereof in so far
as its land may be affected thereby.

Upon the approval of City Attorney, Mr. I. S. Romig the Board
approved the order for the change in the course of the Northwest Trunk Lewer as out
lined in the above petition. Order is as follows:

Public -Improvement contract bearing date March 23rd., I92 % by and between it as
Contractor and the City of South Bend, Indiana, as City, through its Board of Public
'I Works, and files its Petition No. One, -for a modification of said contract with respect
to the course of said sewer from Huey street to ffestmore Street in sale City; and
the Board having )teard said petition and being -fully advised, in the premises, and
having heard the recommendation of its engineer that said petition be granted, now
finds that the public interest will be served by the modification of said contract in
• j pursuance to said petition.

It is therefore ordered that said contract be modified by changing
the course of naid sewer as set forth in said petition to take effect at once, all as
per the terms and agreements set forth in said petition.
