This being the date set, hearings were had on the'following improvement resolutions: Improvement Resolution No.I938 for the construction of curb and walk where necessary on VbATle Street from 1,11alnut Street to Chapin Street. Improvement.Resolution No.I936 for the construction of curb and walk where necessary on High Street Between Dubail Avenue and Bowman Street. Improvement Resolution No.I939 for the construction of a local sewer on Wilber Street.ftom Lincoln Way West to Elwood Avenue. In all of the above named improvement resolutions, no remonstrators appeared and no'written remonstrance was.filed, and the Board, being duly advised in the premises, finds that the benefits to the several lots and parcels of land., liable to be assessed for said improvements, will be equal to the estimated cost of same as reported by the City Engineer and that the improvements are necessary. The Board, therefore, takes final action on all of the above improvement resolutions, declaring same in all things ratified, confirmed and approved, without modification. The Board now orders that on the 4th., day of October, 1927, this Board will receive, open and read sealed proposals up to 10:00 A. M., for the construction Ii of the above named improvements. Board futther orders that notices of said proposals shall be published on the 23rd., day of September and on the 30th., day of September, 1927, in the South Bend News Times and Tribune. This Beingthe date set, hearing was had on Improvement Resolution No. 1937 for the pavement of Jackson Street from Washington Avenue to Linden Avenue. In the above named improvement resolution, tbmohstritors appeared and a -written remonstrance was filed. After careful consideration, the Board hereby decides to rescind all former action taken on said improvement resolution No.I937, and declares ,to null and void and the proceedings closed. The Board approved the following Guarantee Bonds: Guarantee Bond of John F. Hipskind for the sewer on Sherman Avenue from Kin Street to the River under Improvement ResolutioiA No.177I. Amount of bond being 664.68 signed by Inland Bonding Co. I Guarantee Bond of John F. Hipskind for the sewer on Miner Street from west line of North Sunnyside Addition to Harriett Street under Improvement Resolution No.I926. Amount of bond being 205.68 signed by Inland Bonding Co. Guarantee Bond of The Northern Indiana Construction Co., for the sewer. on Rideg Road, Garland Road and Trelane Road in Ridgedale Fourth Addition under Improve went Resolution No.I87I. Amount of bond being 391.05 signed by the New York indemnity - I Co. The Board signed the following contracts: Contract with A. E. Anderson for the construction of grade, curb and walk i� on College Street from Hamilton to Bergan Street under Improvement Resolution No.I9I7. i !I Amount of contract is 3,49I.00. Board also approved the construction bond of same for i 50j of the amount of the contract signed by Eagle Indemnity Co., of New York, N. Y. i Contract with John F. Hipskind for the construction of a sewer on 2lst., Street from Jefferson Blvd., to Center line of McKinley Avenue under Improvement Resolution No.1920. Amount of contract is 5,62.6.60. Board also approved the construct- ion bond of same for 50% of the contract price signed by Inland Bonding Co.' This being the date, hearings were had on the following assessment rolls: Assessment roll for -the pavement on Corby Street from Eddy Street to the East line of Park Place Addition under Improvement Resolution No.1832. Assessment roll for the sewer on Miner Street from west line of North Sunnyside Addition to Harriett under Improvement Resolution No.I926. v i Assessment. roll for the sewers in Rodge Road, Garland Road and Trelane Road in Ridgedale Fourth Addition under Improvement Resolution No.I87I i Assessment roll for local sewer on Ridegdale and Avondale Road in Ridge - dale Fourth Addition under Improvement Resolution No.I848. In all of the above named assessment rolls, no remonstrators appeared and no written remonstrance was filed, and the Board being fully advised in the !. premises, finds that the several lots and parcels of land primarily assessed for said improvements have been benefited in the amounts named on said rolls. The Board, there- fore, takes final action on said assessment.rolls and declares said assessment rolls, filed September I3th., and I4th., 1927, in all things ratified confirmed and approved. The Board now orders said assessment rolls delivered to the Department of Finance.;' City Engineer, Mr. H. G. Wray, submitted the tabulation of bids for the 462 Wednesday, September 21st., 1927. construction of a: sewer on Orange Street from Olive Street to Meade Street under Improvement Resolution No.I9.32.. Rocco Simeri 10965.30 John Lugaresi 2,340.20 Bids having been received for the construction of a sewer on Orange Street from Olive Street to Meade Street under Improvement Resolution No.I932 the Board, this 2lst. day of September, 1927, hereby awards the contract for said improvement to Rocco bimeri at his low bid of I,965g34. City Angineer, Mr. H. G. Wray, filed plans, specifications and estimates and the Board adopted the following improvement resolutions: Improvement Resolution No.I955 for the pavement of Bertrand Street from Johnson Street to Ben.dix.Drive. Improvement Resolation No.I956 for the pavement of High Street from Fairview Avenue to Donmoyer Avenue. In both of the above named improvement resolutions, the Board hereby orders that on -the 2nd., day of November, 1927, this Board will meet in their office in the City Hall, at 7-15 P. M., to hear and receive remonstrances from all persons whose property is liable to be assessed for said improvements and will decide whether the benefits to the several lots and parcels of land, liable to be assessed f said improvements, will be equal to the estimated cost of as same as reported by the City Engineer. The Board further orders that nntthes of said hearings shall be published on the I2th., day of October and on the I9th., day of October, 1927, in the South Bend News Times and Tribune. City Engineer, Mr. H. G. gray, filed plans and the Board adopted a resolution for the vacation of the i*st., alley north of Sunnymede Avenue from the east.line of the Ist., alley west of Harriett Street to the east line of Lot 224 in Sunnymede Addition produced north, under Vacation Resolution No.I957.,� In the above named vacation resolution, the Board hereby orde: that on the 12t4 day of 'tFatojje , 1927, this Board will meet in their office at 7-I5 P M., to hear and receive remonstrances from all persons whose property may be affec by said vacation. Board further orders that notices of said hearing -shall be publish ed in the South Bend News Times and Tribune on the '24th. , day of (_eptembewcj on the Irdt., day of October, I927. The Board approved Flary's Subdivision of Lot I09 Jacksons proposed Addition to the City of South Bend, Indiana, with the following Dedication: "The attached plat known as Flary's Subdivision of Lot 109 Jackson's Proposed Addition to the City of South Bend, Indiana, is bounded by a line runntcng as follows: Beginning at a point in the north and south center line of Section 34, Township 38 north, Range 2 East, three hundred ninety seven and fourty- five hundredths (397.45) feet south of the northwest corner of the northeast cluarter ( ) of said Section 34„ thence south one hundred twenty-five and six tenths (125.6) feet; thence east three hundred thirty and five tenths (330.5) feet; thence north c hundred twenty five and six t enths - (I25.6 ) feet; theme west three hundred thirty and five tenths (330.5) feet to the place of beginning.. All parts of streets not here -to -fore dedicated to the public are hereby dedicated to the public for public use. signed Peter Flary Frances G. Flary State of Indiana Bounty of St. Joseph. The Board approved the Plat of Dixie View with the following Dedication: "The Annexed plat of Dixie View is a subdivision located in t Vilest part of Section Twelve (I2) and North part of Section eleven (II) Tranship Thir eight (38), Range Two (2) East, more particularly described as follows: Beginning at the Northwest corner of Section delve (I2) Tmwnship Thirty-eight (38) North, Range Two (2) East; thence South along the west line of Section.Twelve (I2) to the Southwest corner of said section;. thence East along 'the South line of ,said Section to the west lineof the Right of May of the Michigan Central Railway Company; thence North along the westRight of flay of said Michigan Central Railroad Company to .a point eight hundred and seventy-one and two .tenths (87I.2) feet South.of the,North line of said Section Twelve "(I2); thence West, parallel with the north line of said Section Twelve (12) One hundred (100) fee 0 e- • Wednesday September 2lst•, 1927. thence North, parallel with the west line of the Right of Way of the Michigan Central Railroad, eight hundred and'Seventy one and two tenths (87I.2) feet to the North line of said Section Twelve (I2) ; thence west to the place of beginning. Also Beginning at the Northeast corner of Section Eleven (II) Township Thirty eight (38) North, Range Two (2) east, thence west four hundred and six and eighty five (406.85) feet, thence South eight hundred and thirty one and fort two hundredths (831*42) feet; thence East to the east line of Section Eleven (IIT; thencoe North eight hundred and thirty and eight tenths (83-.8) feet to the place of 'beginning. The sizes of the lots and the widths of the streets and alleys are indicated on the plat in feet. The Streets and alleys are hereby dedicated to the public for public use. Romig, the Board approved and accepted a deed for a strip of land from Koehler, Bernard and Louise, which is a description of the property necessary for the widening of McKinley Avenue from Sunnysi e East. On account of certain admissions made in the presence of and to the Board of Public Works by Mr. L. H. Webster on Tuesday morning, September 20th., I927* in regard to sewer work performed by him that was deficient and otherwise contrary to plans and specifications, the Board, hereby, rescinds it's action in the matter of the award of McKinley Avenue local sewer from 22nd., Street to Greedlawn Avenue under Improvement Resolution No.I9I9 and upon the advise of City Attorney, Mr. I. S. Romig, authorizes the advertising of new bids and accordingly rejects all bids received for this particular improvement. . The Board"now orders that on the Ilth., day of October, I927, this Board will receive, open and consider sealed proposals for the construction of the local sewer on McKinley Avenue from 22nd., Street to Greenlanw Avenue under Improvement Resolution No.I9I9, up to I0:00 A M. The Board further orders that notices of said proposals shall Abe published 29th., day of Septmber and on the 6th., day of October, 1927, in the South Bend Nears Times and Tribune. j The Board signed the following agreement with the Chicago, South Shore j and South Bend Railroad "Agreement" I This agreement made and entered into by and between the City of South Bend, an incorporated City of the State of Indiana, by and through its Department of Public Works, and Chicago, South Shore ahs South Bend Railroad, an Indiana Corporation,. I� Witnesseth: That the Department of Public forks of the City of South Bend does by li this agreement grant to the Chicago, south Bend and South Shore Railroad, authority to maintain, construct and operate three sput railroad tracks within the City of South Bend, otrer, upon and across Sycamore Street north of the intersection of said Street with LaSalle Avenue in said City, as shown upon the blue print attached hereto, make_ a part hereof and marked Exhibit "A". This grant is made upon the express condition that the said three spur tracks across said street shall be constructed so as to conform with the established grade of said street, and upon the further express condition that said Chicago,,South Shore and South Bend Railroad shall plank the street between the rails of said"tracks, and for two feet on the outside of said rails, with planks not less than two inches -in thickness, which shall, at all times, be kept securely in place and to the grade of said street, and shall, in the maintenance of said tracks comply with the laws of the State of Indiana and the ordinances of the City of south Bend.
