Board met in regular session at 9:30 A. U, All members present. Miss
Hazel A Turner, Clerk, absent.
Minutes of meetings held August 9th and loth read and approved.
Bids were received, opened and read for the construction of grade, curb and
walk on the south side of Dommoyer Avenue from Michigan Street to Fellows Street,
under Improvement Resolution No. 1930:
concrete walk concrete curb grading to'sub -grade
H. L, Davis & Son .16 sq ft ..40 lin. ft .40 cu yd
Bids having been received for the grade, curb and walknon Doxmoyer Avenue
from Michigan Street.to Fellows Street, the Board hereby awards the contract to
H. L. Davis & Son on their low bid submitted.
No petitions having been filed for a change of the type of pavement other than
that specified in the preliminary order for the pavement on Amer Street from Freder-
ickson Street to Dincoln way Nest, under Improvement Resolution No. 1882, the Board
this 16th day.of august, 1927 hereby makes a final order for Sheet�Asphalt Heavy
Traffic as the type of pavement with which said street shall be improved and awards
the contract to the Williston Construction Company at their low bid of $9,917.60,
this being the lowest and best bid presented. ./
No petitions having been filed for a change of type of pavement other than
that specified in the preliminary order for the poadwaytw&dening and pavement on
Main Street from South curb line of Mayne Street to North curb line of Division Street,
under improvement Resolution No. 1867, the Board thts,^t6th day of August, 1927, hereby
makes a final order for Heavy Traffic Sheet Asphalt as tge type of pavement with which
said street shall be widened and resurfaced and awards the contract to the Albert Con-
strucyion Company at their bid of 6,696,56, this being the lowest and best bid pre-
sented.

Street to Bendix Drive, under Improvement Resolution No. 1898, the Board this 16th day,

of pavement with which said street shall be paved and awards the contract to the .filbert
Construction Company at their low bid -of $17,312.20, this being the lowest and best bid.

16th day of August, 1927 hereby makes a final order for Light.Traffic Sheet Asphalt as

the Rieth-Riley Construction Company at their low bid of $2,661.20, this being the
lowest and best bid submitted.
City Engineer, Mr. H. G. Wray, filed following partial estimates:
Partial Estimate No. 1 for the pavement on McKinley Avenue from the East line of
itSunnyside Avenue to the East line of Greenalwn Avenue in accordance with the terms of
the contract between the City and the Williston Construction Co., under Improvement
Resolution No. 1863. Board signed same in amount of $15,182.28
Partial Estimate No. 1 for sewer on Kinyon Street fron Sherman Avenue to a point
twenty feet (20t) West of the East line of Lot 186 Northwest Addition, innaccordance
i with -the terms of the contract between the City and John F. Hipskind, under Improvement
if Resolution No. 1851.

In all of the above -named assessment rolls, the Board lereby 9rders that on th
31st day of August, 1927,.'this Board will meet In their office in the City Hall at 7:15
P. M..to hear and receive remonstrances from all persons whose property has been assess
for said improvement and will decide whether the several lots and parcels of land have
been or will be benefited innthe amounts shown on said rolls. Board further orders
that notices of said hearings shall be published ft the South Bend Tribune and News
Times on the 26th and 27th days of August, 1927.
Board signed the contact with Harry N. Barnes for the construction of eon-
Crete pavement on Miner Street from Eddy Street to East line of Madison Park Add., and
Improvement Resolution No. 1865. Board also approved construction bon4 for same in the
amount of $13,422.05 signed by .the United Mates Pidelity & 0maranty empany.
Board signed contract with Hoban & Roach for the construction of concrete
pavement on Turnock.Street from South Bend Avenue to Corby Street under Improvement
Resolution No. 1862. Board signed bond for same in the amount of 6 3,600.00 signed by
the Southern Surety Company,
City Engineer, Mr..H. G. Wray, filed plans and specifications and Board
adopted a resolution for the construction of a local sewer on Orange Street betw een
Olive Street and Meade Street, under Improvement Resolution No. 1932.
In the above improvement resolution , the Board hereby orders that on the
7th day.of September, 1927, this Board will meet in their office in the City Hall at
7:15 P.M. to hear and receive remonstrances from all persons whose property is liable
to be assessed for said improvement and will decide whether the benefits to the several
lots and parcels of land liable to be assessed for said improvement will be equal to
the estimated cost of same as reported by the lity Engineer. The Board further orders
that notices of said hearing shall be published on the 18th day of August and on the
25th day of August, 1927, in the South Bend Tribune and News Times.
Board approved the plan for a driveway on Dut Lot 91 of the 2nd Addition of
Out Lots by the State Board of Indiana.
Board approved petition of.Indiana & Michigan Electric Company to place
poles on Prairie Avenue between Leon Court and Nubail Avenue.
Board approved the Plat of Lindberg Park Addition to the City of South
Bend, with the following dedication:
"The attached plat known as Lindberg Park Assition to the City of South
Bend is composed of eighteen (18) lots numbered from one to wighteen inclusive and is
bounded by a line running as follows:
Beginning at a poi bt in the North line of iiekman Street, one hundred
twenty-seven (1271) feet west of the west line of Miami.Street; thence North seventeen
.feet (171); thence west fourteen feet (141); thence north one hundred one feet (101=);
thence west four hundred eighty-four feet (4841); thence south four hundred twenty8eight,
feet (4281) to the north line of Oakside Street; thence east one hundred wighty feet
(1801) to the west line of dale Avenie; thence north three hundred ten feet (3101) to t
the north line of Eckman Street.1 thence East three hundred twenty-eight feet (3281) to
the place of beginning.
All streets and alleys shown on the plat, not heretofore dedicated or
6therwise opened for public .use are hereby dedicated to the public for public use.

The Board signed the contract with the Chicago, South Shore and South Bend
Railroad Company for the construction of spur tracks acorss Olive Street. Contract as
follows:
C O N T R A C T.
"This agreement made and entered into by and between the City of South Bend
an incorporated City of the State of Indiana, by and through its Department of Public
Works and Chicagom South Shore and South Bend Railroad, an Indiana Blorporation,
Witnesseth:
That the Department of Public Works of the City o f South, Bend,, Indiana, doe

by this agreement, grant to the Chicago, South Shore and South Bend Railroad authority
to construct, maintain and operate two industrial spur railroad tracks wihhin the City
of South Bend, overrp upon and across Olive Street as follows:
The first of said spur tracks shall begin at a point on the west line of Olive
Street seventy seven feet north of the northwest corker of Olive Street and Orange Stree
in said City; thence across Olive Street in a southeasterly direction, all according
to the blue print attached to this contract and to the petition for said grant as
indicated thereon.
The second of said spur tracks shall begin at a point on the west line of Olive
Street and ni#ety five feet north of the northwest corner of Olive Street and Orange
Street in said City; thence across Olive Street in a southeasterly direction, all
according to the blue print attahhed to this contract and to the petition for said
grant and as indicated thereon.
This grant is made upon the express condition that t':.e spur track now existin6
on Olive Street to the north of the right of way of said railroad shallbe removed
contemporaneously with the construction of said two spur tracks, and upkn the further
express condition that the said two sput tracks across Olive Street shall be constructer
so as to conform with the established grade of said street and upon the further express
condition that said Chica gom South Shore and South Bend Railroad s#eii plank the street
between the rails of .said tracks and for two feet. on the outside of said rails with
planks not less than two inches in thickness, which shall at all times be kept securely
in place and to the grade of said street and shall in the maintenance of said tracks in
all things comply with the laws of the State of Indiana and ordinances of the City of
South Bend.
IN r7ITNESS 10MEREOF the Department of Public Works, acting for and on behalf
of the City of South Bend, has caused this agreement to be executed by its duly
authorized officers on the I6th., day of August, 1927, and the said Chicago South
Shore and South Bend Railroad has hereunto caused its named to be subscribed.

The Board signed the contract between the City and the Chicago, South 'shore an.
South Bend Railroad Co., for the construction of spur tracks on and across the alley
running north and south bb6tween Olive and Carlisle, immediately north of Orange Stree
in the City of South Bend, Indinana. Contract as follows:
C 0 N T R A C T.
"This Agreement made and entered into by and between the City of South Bend,
an incorportated city of the State of Indiana by and through its Department of Public
Works and the Chicago, South Shore and South tend Railroad, an Indiana Corporation,
Witnesseth:
That the Department of Public Works of the City of South Bend, Indiana, does
by this agreement grant to the Chicago, South shore and �outh.Bend Railroad authority ti
epnstruc3t, maintain and operate,two industrial spur railroad tracks within the City of
South Bend over, upon and across the alley running north and south between Olive and
Carlisle street, immediately north of Orange iDtreet in the City of "wouth Bend as shown
upon the blue print attached hereto, made a part hereof and marked Exhibit A.
This grant is made upon the express condition that the spur track or tracks
now existing at the present time shall be removed contemporaneously with the construct-
ion of said two spur tracks, and upon the further express condition that said spur
tracks across said alley shall be constructed so as to conform with the established
rade of said alley and upon the further express condition that said Chicago, South
hone and South Bend Railroad shall plank the street between the rails of said tracks
and for two feet on the outside of said rails with planks not less that two inches in
thickness, wh_eh shall at all times be kept securely in place and to the grade of said
alley and shall in the maintenance of said tracks in all things comply with the laws
of the State of Indiana and ordinances of the CW; of South Bend.
Nothing in this contract, shall be construed, however, to mean that there steal:
be any change in the present right bf way of said railroad.
In witness whereof the Department of Public Works, acting for 'anal on behalf of
the City of South Bend, has caused this agreement to be executed by Its -duly authorized
officers on the I6th., day of Autist, 1927, and the said Chicago, South Shore and South
Bend Railroad has hereunto caused its named to be subscribed.

The Board approved the plat and notes of survey in Section 25 Township;j
37 North Rang3 2 East in 2nd. ,' Tlat of Qhipewa heights.
The Board accepted and approved the deed for a fifty foot street in
Chipewa Heights, second plat ae_follows:
"A strip of land 50 feet in width off of and from.the entire length of
the north sides of Lots 57 and 58 in the second plat of Chippewa Heights, as -sub -divis-
ion in Section 25, Township 37 North, Range 2 East, as shown in Plat Book No.9 in the
office of the Recorder of said County.
The above grant is made for the lzurpose of dedicating land above
described for use by the public as a highway, and for no other purpose.
In witness whereof, the said John J. O'Brien and Virginia S. O'Brien,
�I husband and wife, have hereunto set their hands and seals this 27th., day of July, I927.
