Minutes of meetings held July 26th., and July 27th., I927, read and approved. City Engineer, Mr. H. G. -moray, submitted a report on the remonstrance against the pavement of the first alley South of West` Napier Street from Walnut St. to Laurel Street under Improvement Resolution No.I873 Mr. Wr-ays report shows 75 resident property owners, 27 of whom have signed the remonstrance and as this does not constitute a, majority, the Board will advertise for bids and let a contract for said improvement. City Engineer, Mr. H. G. Fray, submitted a report on the the remonstrance against the pavement of Cbjptin Street from WabhIggton Street to Monroe Street under Improvement Resolution No.I887. Mr., Wray's report shows 53 resident property owners, 35 of whom have signed the remonstrance.. The Board therefore can take no further action on said reso- lution as a majority of resident property owners pia ve signed.the remonstrance. This being the date set, bids were received, opened and read for the following improvements: Pavement on Elmer Street from Frederickson Street to Lincoln Way 'West under Improvement Resolution No.I882. Board also approved the construction bond for same in the amount of $132.00 signed by the. New York Indemnity Co. The Board signed the contract Frith Whitcomb and Keller for grading of Ist. , •alley north of Lincoln Way East from Jefferson Blvd., t.o Columbia treet under Improvement Resolution No.I905. Board also approved the construction bond for same in the amount of336.00 signed by the New York Indemnity Co. The Board approved the guarantee bond of Reith Riley constr ion Co*., for_ the pavement of Catalpa Avenue from Calvert Street to Having Avenue under improvement resolution No.I69I signed by Southern Surety Co., for 1.36I.29. The Board approved the guarantee bond of Williston Construct- ion Co., for the grade, curb and walk improvement on South Street from Sunn<yside Avenue to Longfellow Avenue under Improvement Resolution No.I725, signed by Inland Bonding Co. This being the date set, hearing was had on the assessment Poll for the grade, curb and walk and pavement improvement on South street from Sunnysli Avenue to Longfellow Avenue under Improvement Resolution No.I725. In the above named assessment roll, no remonstrators appeared and no remonstrance was filed and -the Board being fully advised in the premises, finds that the several lots and parcels -primarily assessed for said improvements have been benefited in the amounts named on said roll. The Board, therefore, decides to sustain all former taken on said assessment roll, filed July 26th., 1927, and declares same assessment roll in all things ratified, confirmed and approved. The Board now orders said assessment roll delivered to the department of Finance. The Board signed an agreement with the South Shore, Chicago, and South Bend Railway Co., regarding the payment of the cost between the sheet asphalt pavement and the brick pavement between car tracks in in the construction of the pavement on LaSalle Avenue. Contract as follows: "This agreement, made and entere into this 2nd. , day of Aug., I927, by and b tween the City of South Bend, Indiana, by and through its Board of Publie Yorks of the City of South Bend, Indiana and the Chicago, South Shore and South Bend $ailway Company, a corporation duly ©reated, organized and existing under the laws of the State of Indiana. Withesseth j Whereas, under Resolution No.I8I2 of said Board of Public Works, said City is about to pave that portion of LaSalle Avenue lying between the wrest line of Main Street and the intersection of LaSalle Avenue and Lincoln Way West; and Whereas, the plans and specifications for said improvement contemplate the paving by said City of said portion of said street from curb to curb including the space betwen the rails and tracks of a single and double track_ street rai way line of said Railway Company on said portion of said street, an well as the space 63itside thereof; and Whereas, said plans and specifications comtemplate the paving by said City of the said space within and betwen the rails and tracks of said Company and one foor in width adjacent to but outside of said trace or tracks, with brick, and the balance of the space along and within the line of improvement with asphalt. Now therefore, it is agreed between the parties hereto, that in consideration of the construction, (including the furnishing of ma#erials and labor) and the completion 1* said City of that portion of said Street pavement within and beam the rails and tracks of said Company and the space one foot i width adjacent to and ourside of said track or tracks, according to the plabs and specifications now on file • • Tuesday, August 2nd., 1927 with and adopted by said Board of Public.Works, said Railway Company hereby agrees to pay that part of cost of said pavement hereinafter specified. But it. is expressly agreed between the parties that said Railway Company shall be entitled to and shall pay,said part of said cost on the tern year installment piln as provided by law on ! the same basis as the privilege of said installment plan is extended to property , owners abutting upon sthe line of said improvement. And said City hereby agrees to take all such s peps and .to do all such things as may be necessary to be done by it !' to enable said Railway Company to pay said part of said cost in accordance with said installment plan. It is finially agreed between the parties hereto that that part of such east so to be paid by said Railway Company shall be the excess of the cost of the construction of said pavement in the area within and between said rails and tracks and one foot width adjacent to and outside of said track or tracks over the cost of the construction of a pavement within said area would be if such pavement . in said area were constructed of asphalt. No petitions having been filed for a' change of type of pavement other than that specified in the preliminary order for the pavement of Turnock Street the Board this 2nd., day of August 1927, hereby awards the contract for pavement of said Turnock Street from South fiend Avenue to Corby Street under Improvement Res- olution No. I862, to Hoban and Roach Co., at their low bid of 5, 895..25 for light traffic concrete. No petitions having been filed for a change of type of pavement other than that specified in the preliminary order for the pavement of diner Street from Eddy Street to East line of Madison Park Addition under Improvement Resolution No.I865, the Board this 2nd., day of August, 1927, hereby awards the contract for said improvement to Harry N. B rnes at his low bid of 13,422.05 for concrete pavement light traffic. No petitions having been filed for a change of type of pavement 111 other than that specified in the preliminary order for the pavement of Twenty-eighth Street from Mishawaka Avenue to Grand Trunk Railroad under Improvement Resolution No.I837, the Board this 2nd., da of August, 1927, hereby awards the contract for said improvement to Rei th Ri ley construction Co. , at their low bid of 23,430,50 for sheet asphalt heavy traffic pavement. No petitions having been filed for the change of type of pavement other than that specified in the preliminary order for the pavement of Frances Street from Sorin Street to South Bend Avenue under Improvement Reso lut ion No.IB64, the Board this 2nd., day of august, 1927, hereby awards the contract for said improvement to Albert Construction Co., at their low bid of 15,608.80 for light traffic sheet asphalt%. City Engineer, Mir. H. G. dray, fi 1 ed the plans, specifications and estimates and the Board adopted the following improvement resolutions: Improvement Resolution No.I9I6 for the construction of grade, curb and walk on Brookfield Street from Hamilton Street to Wilson Street. Improvement Resolution No.I9I7 for the construction of grade, curb and walk on College Street from Hamilton Street to Bergen Street. In both of the above named resolutions, the Board hereby orders that on the 3Ist., day of August, I927, this Board will meet in their office in the City Hall at 7-I5 P, If., to hear and receive remonstrances from all persons whose property is liable to be assessed for said improvements and {rill decide whether the benefits ' to the several lots and parcels of land which are liable to be assessed for said j; ,improvements will be equal the estimated cost of same as reported by the City 4agineer., The Board further orders that notices of said hearings shall be published on the Ilth day of August and on the I8th., day of August, 1927, in the South Bend News Times and j Tribune and that notices be mailed to property owners according to law. ,; City Engineer, ?sir. Wray, gave the following report on 11 . remonstrances filed against improvements: On the remonstrance against the pavement of the Ist. , alley south of 'Naps er Street from 6alnut .Street to Chestnut Street under Improvement Resolution j No.i874, there are 4 signatures. There are 6 resident pro perty owners,, therefore, Tuesday, August 2nd., 1927. the Board rescinds all former action taken on said improvement resolution and declares same null and void and the proceedings closed. In the matter of the remonstrance against the pavement of the Ist., alley west of taurei Street from division Street to Napier Street Under Impro- vement Resolution No.IBft, there are 5 resident property owners, three of whom have signed the remonstrance. This number is a majority, therefore, the Board rescinds all former action taken on said resolution and declares same in all things null and Void an" the proceedings closed. !,r City Engineer, Mr. H. In the above named assessment --roll the Board hereby orders that on the I2th., day of October 1927, this Board will meet in their office in the City Hal. at 7-I5 P. FBI., to hear and receive remonstrances from all persons whose property has A been affected by said condemnation and will decide whether the several lots and parcels'] of land have been or will be benefited or damaged in the amounts shown on said primary assessment roll or in a greater or less amount. The Board furhter orders that notices of said hearing on the benefits and damages shall -be served according to law to all pro+ perty owners affected by said condemnation. i City Engineer, submitted the following partial estimates: Partial estimate No.I for the Roadway widening and pavement on Lincoln 'day West from West line of +7ilbert Street to west line of Olive Street in accordance with the terms of the contract between the City and Williston Construction Co., under Improvement•Resolution No.I8I5. Board signed and approved same in the amount of 'VI4,I95.00. Partial estimate No -I for the pavement improvement on the Ist., alley west of Johnson Street from Prast Street to Lincoln relay West in accordance with t terms of the contract between the City and E. T. Tranberg under Improvement Resolution No.I877. Board signed and approved same in the amount of $70Z.63. Partial estimate No.I for the grade,curb and walk improvement on Lake Street from Division Street to Jefferson Blvd., in accordance with the terms of j the contract between• the. City and Eston Ball under Improvement Resolution No. I825. The Board signed and approved same in the amount of I,854.57. Claims amounting to I2,392.97 signed and approved by the Board.. The Board approved the release of the Williston Construction. Company on guarantee bonds which have expired on the following improvements: Frances Street from Grand Trunk R. R. to Cedar Street, expired 6-26-I926. Walnut Street from Sample Street to Indiana Avenue expired 6-29-26. Lawndale Avenue .from Lincoln Way West to VanBuren Street expired J I-I2-I926.
